Use of Isolation and / or Restraint for Students on IEP or 504 This district is committed to providing a safe and beneficial learning environment for all students. Although restraint and isolation of any student should generally be avoided, there are circumstances where such actions are necessary to preserve the safety of students and school staff. Definitions: As defined by state law (RCW 28A.600.485): “Isolation means excluding a student from his or her regular instructional area and restricting the student alone within a room or any other form of enclosure, from which the student may not leave.” “Restraint means physical intervention or force used to control a student, including the use of a restraint device. Restraint device means a device used to assist in controlling a student.” Use of Isolation and Restraint: Isolation or restraint shall only be used in response to unpredicted, spontaneous behavior, as defined in Washington’s special education regulations (WAC 392-172A-03120) or as specified in a student’s Individualized Education Program (IEP), Aversive Intervention Plan (AIP), or accommodation plan under Section 504 of the Rehabilitation Act (504 Plan), in a manner consistent with the requirements of Washington’s special education regulations. Isolation does not include situations where students in a classroom are directed to leave the classroom due to the unsafe behavior(s) of a classmate with disabilities who remains in the room with staff supervision, unless the remaining classmate is being physically blocked from also leaving the room. Restraint does not include use of a harness or specialized seatbelt with students whose disabilities require transportation supports for non-behavioral reasons, e.g., maintaining proper physical positioning in a wheelchair. Review Procedures: 1. The incident was reviewed with the student, as determined appropriate by certificated staff knowledgeable about the student and his or her disability, to address the behavior that precipitated the incident. 2. The incident was reviewed with the parent/guardian by either the principal or designee. 3. The incident reviewed with the staff members by principal to ensure proper procedures were followed. Notification Procedures: 1. Notification to Parents/Guardians: a. A verbal attempt to notify the parent(s)/Guardian(s) the day of the incident will be initiated by the District, but not later than 24 hours of incident. b. Parent(s)/Guardian(s) will be provided written notification of incident postmarked within five (5) business days of its occurrence. 2. Notification to the District: a. The District will be provided a written incident report within two (2) business days of the incident. Such report shall be submitted to the Special Education Department.
