Agreement to Participate with

Assumption of the Risk, Waiver, and Release of Liability In consideration of my child(s)_________________________________________ being allowed to participate in this Kansas Athletics, Inc. activity, Rock the Track, I hereby release and hold harmless Kansas Athletics, Inc., the University of Kansas, the State of Kansas and its Board of Regents, and any of their respective students, employees, directors, members, coaches, or agents, from any and all liability for negligence or any other claim, demand, action, judgment, loss liability, cost and expenses (including without limitation, attorney’s fees and costs) for property damage, personal injury or wrongful death, arising out of or in connection with (whether directly or indirectly) or as a result of my engaging in this Kansas Athletics, Inc. activity. I hereby voluntarily waive any and all claims, both present and future, that may be made by me, my family, estate, heirs or assigns. Further, I understand that my child’s participation in this event or activity may involve vigorous physical activity, and may result in certain risks, including but not limited to death or serious unavoidable injuries and that equipment provided for my protection may be inadequate to prevent serious injury. I voluntarily permit my child’s participation in this activity with knowledge of the danger involved and hereby agree to accept any and all inherent risks of property damage, personal injury or death. I further agree to indemnify and hold harmless Kansas Athletics, Inc., the University of Kansas, the State of Kansas, and its Board of Regents for any and all claims arising as a result of my child’s engaging in this activity or any activities incidental thereto, wherever, whenever or however the same may occur. I also give Kansas Athletics, Inc. or its designee, the irrevocable right to take and use my child’s name, picture, likeness, photograph, and/or verbal statement in all forms of media existing now and in the future for any advertising or promotional activity proposed by Kansas Athletics, Inc. I further waive any rights I may have in connection with any use of the material, including any right to inspect or approve the finished use, including any written copy that may be created in connection with such use. I understand that this waiver is intended to be as broad and inclusive as permitted by the laws of Kansas and agree that if any portion is held invalid the remainder of the waiver will continue in full legal force and effect. I further agree that the venue for any legal proceeding shall be in the state of Kansas. I acknowledge that I have read this Assumption of the Risk, Waiver, and Release of Liability in its entirety and fully understand its contents. I affirm that I am freely signing this agreement. I understand that by signing this agreement, I am giving up legal rights and/or remedies which may be available to me.
