THIS INDENTURE, made and entered into this _ _ day of _ __ , 2001, by and between CHESTER STAMBAUGH and VELMA STAMBAUGH, husband and wife, of P 0 Box 56, Donnelsville, Ohio, 45319, of the first part, GRANTORS, and STEVEN GRANT CAMPBELL, of 12 Davidson Road, Havelock, North Carolina, 28532, of the second part, GRANTEE:
WITNESSETH: That the parties of the first part, for and in consideration of a gift and for past services, have bargained and sold, and by these presents, do convey unto the said party of the second part, STEVEN GRANT CAMPBELL, the following described property, lying and being in Lewis County, Kentucky, and described as follows, to-wit:
PROPERTY DESCRIPTION Two certain tracts or parcels of land lying and being in Lewis County, Kentucky, on the waters of Schultz Fork ofBriery Creek, and more particularly described as follows, to-wit: FIRST PARCEL: BEGINNING at a stone in the side of the road, comer to Jones; nence with Ruggfes line East to Sexton's line; thence with Sexton's line to Dow Johnson's line; thence with Dow Johnson's line to the line of Chas. Johnson; thence North with Chas. Johnson's comer in branch by the road; thence with the branch or creek (Schultz) Southwest direction to the beginning comer, containing about 80 acres, more or less. SECOND PARCEL: BEGINNING at a beech in Big Branch; thence running a Southwest course down the branch to the forks of Tobacco Bed Branch and comer on a stone; thence running down said Branch to the mouth; thence straight across; thence straight up the hill to a red oak comer at the Clay Bank; thence running straight up Mud Spring Branch to the mouth to the big chestnut by the side of the road; thence running a straight line from chestnut to a beech, the place of beginning, containing fifty (50) acres of land, more or less.
515 Being the same property conveyed to Chester Stambaugh and Velma Stambaugh, his wife, by deed from Jerry Stambo, widower, dated September 5, 1967, recorded in Deed Book 109, page 155, Lewis County Court Records. There is excepted from this 12.089 acres conveyed to the Commonwealth of Kentucky, Department of Highways, dated May 21, 1990, recorded in Deed Book 156, page 689, Lewis County Court Records. The property is subject to a right of way to Grayson Rural Electric Cooperative, dated June 15, 1979, recorded in Right of Way Book 5, page 221, Lewis County Court Records. IT IS UNDERSTOOD BY AND BETWEEN THE PARTIES HEREIN THAT THE GRANTO RS, CHESTER STAMBAUGH AND VELMA STAMBAUGH, HUSBAND AND WIFE, HEREBY RETAIN A LIFE ESTATE IN THE FOREGOING DESCRIBED PROPERTY FOR AND DURING THEIR NATURAL LIVES.
TO HAVE AND TO HOLD the said premises and appurtenances thereunto belonging to the Grantee, STEVEN GRANT CAMPBELL, his heirs and assigns forever with covenants of General Warranty, SUBJECT HOWEVER, to the hereinabove retained life estate of the Grantors. CONSIDERATION CERTIFICATE We, the undersigned Grantors and Grantee, do hereby certify pursuant to KRS Chapter 382, that the property above described is transferred by gift and without monetary consideration and fair market value of the property is $22,400.00. We further certify our understanding that falsification of the fair market value of the real estate is a Class D felony, subject to one to five years imprisonment and fines up to $10,000.00.
