Planning Commission Staff Report April 3, 2018 Laura Abernathy, Planning Coordinator Use on Review Annual Review – Tammy Halverson (Mountain View Care) of 1681 Joedy Street

Background On March 6, 2017, the applicant named above was approved for a Use on Review to operate an adult care facility within a Medium-Density Residential zoning district at 1681 Joedy Street. Individuals residing in the facility require limited assistance and receive room, board and transportation services. The applicant is registered with the State of South Dakota. The maximum capacity for the facility is six residents, with two caregivers present at all times. The decision by the Sturgis City Council was based on the installation of hard surfacing and an ADAcompliant ramp being installed within six months. On September 6, 2017, a site visit by City staff concluded that the hard surfacing and ramp were not installed due to contractor issues. City staff gave the applicant a six-month extension. On March 2, 2018, City staff followed up with the applicant and found that the applicant had not met the conditions required by the City Council at the March 2017 meeting. On March 6, 2018, City staff gave an update to the Planning Commission, and Commission requested that the ADA ramp be installed within 30 days, and the applicant shall provide a signed contract with a contractor to complete the project within a timely manner. At the April 3, 2018 meeting, the Planning Commission will receive an update from the applicant to see if these conditions have been met. Recommendations If the applicant can show that the ramp has been installed and has a signed contract to install hard surfacing this spring, City staff would recommend that the Use on Review can continue for another year. If these conditions are not met, City staff would recommend a review by the Sturgis City Council for a final determination. Budget Impact At this time there is no direct financial impact to the City budget.

General Information Laura Abernathy Spoke to Tammy about deadline for hard surfacing and wheelchair ramp. Requesting 6 month extension. Will mention to P&Z at 9/6 meeting General Information Dave Smith Laura and I called and talked with Tammy about the 6 month extension she is working on having this completed by May she is actually having a contractor come this weekend to provide her with a bid. Tammy will contact us on Monday or Tuesday to let us know who she has hired to complete the work of installing the ramp and hard surfacing. General Information Dave Smith The conditional use permit was discussed at last night?s planning & zoning meeting. Commissioners were advised that the owner of the care facility was to have installed the hard surface and the handicap ramp with in the first 6 months but did not compete the work. They were also advised that our office provided her with a 6-month extension to complete the work. As of today, the ramp and hard surface requirement has not been completed. They want to see Ms. Halverson at the next P&Z meeting and she needs to have the ramp installed and a signed contract with a contractor or paving company showing she is on the list to have the hard surface completed. I will be contacting Tammy today to advised her. General Information Dave Smith Tammy called back and was advised of the outcome of last nights planning & zoning meeting. She was told that the ADA handicap ramp would need to be installed within the next 30 days, and that she would need to have a signed contract with the contractor that would be installing the hard surface as required. Also Tammy will need to attend the next planning & zoning meeting on April 3rd, Laura will send her a letter about our conversation and the dates she will need to attend p&z Planning Commission Hearing Laura Abernathy Pending Will need to have a signed contract for someone to complete hard surfacing and have ADA ramp installed
