If a potential winner cannot be contacted within five (5) days after the date of the first attempt to contact him/her, the Administrator may select an alternate potential winner in his/her place at from the remaining nonwinning, eligible entries. 7. Winner Notification The potential winners will be notified by Facebook message or email. Potential winners will be required to complete, electronically sign and submit an Affidavit/Liability/Publicity Release within five (5) days of the date notice or attempted notice is sent, in order to claim his/her prize. Disputes Except where prohibited, participants in the Sweepstakes agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, or the administration of the Sweepstakes or the determination of winner, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration, to take place in the U.S.A. pursuant to the Rules of the American Arbitration Association, the effective, (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys’ fees; and (3) under no circumstance will a participant be permitted to obtain awards for and participants herby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant(s) and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Texas without regard to conflicts of law doctrine. For any matters which are not subject to arbitration as set forth in these Official Rules and/or in connection with the entering of any judgment on an arbitration award in connection with these Official Rules and/or the Sweepstakes, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to the County of Harris in the State of Texas. The parties agree not to raise the defense of forum non conveniens. 13.
