RESOLUTION NO. 2010-03 A RESOLUTION OF THE TOWN OF MELBOURNE BEACH, BREVARD COUNTY, FLORIDA, AUTHORIZING THE TOWN MANAGER TO SUBMIT AN APPLICATION TO THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION UNDER THE FEDERAL CLEAN WATER ACT, SECTION 319 PROGRAM REQUESTING FUNDS FOR STORMWATER SYSTEM IMPROVEMENTS WHEREAS, The Florida Department of Environmental Protection (FDEP) is accepting applications for storm water system improvement projects under the Federal Environmental Protection Agency (EPA) Clean Water Act, Section 319 Program; and WHEREAS, This program solicits applications to construct projects that will improve the quality of storm water runoff into impaired waters; and WHEREAS, The Town of Melbourne Beach has identified areas of its storm water management system which is in need of improvements in order to reduce nonpoint source water pollution; and WHEREAS, The Town of Melbourne Beach proposes a projects in various basins of the Town to improve the quality of storm water runoff into the Indian River Lagoon; and WHEREAS, the Indian River Lagoon has been designated as an impaired water body; and WHEREAS, without financial assistance, the Town of Melbourne Beach does not have the resources to construct the necessary stormwater system improvements; NOW THEREFORE; BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN OF MELBOURNE BEACH, that the Town Manager of the Town of Melbourne Beach is authorized and directed to apply to the FDEP requesting funds under the Federal Clean Water Act, Section 319 Program for storm water system improvement projects as described in the application. BE IT FURTHER RESOLVED, that the Town of Melbourne Beach will commit matching funds for the stormwater quality improvement elements of the application as required by the Federal Clean Water Act, Section 319 Program. PASSED AND ADOPTED at a Regular Meeting of the Town Commission of the Town of Melbourne Beach, Florida this 21st day of April, 2010.

RESOLUTION NO. 2010-04 A RESOLUTION OF THE TOWN OF MELBOURNE BEACH, BREVARD COUNTY, FLORIDA ADDRESSING TOWN OWNED PROPERTY HELD IN FEE SIMPLE TITLE THAT IS AVAILABLE FOR USE AS AFFORDABLE HOUSING. WHEREAS, the Florida legislature has enacted legislation requiring each municipality to prepare an inventory list of certain Town owned real property that is appropriate for use for affordable housing; and WHEREAS, Town staff has reviewed all real property which the Town holds in fee simple title; and WHEREAS, all of the Town property that could be considered in accordance with the provisions of Section 166.0451, Florida Statutes, is restricted in some manner from use to support affordable housing in that it is occupied by a Fire Station, Public Works garage, Town employee/public parking lot, Town Hall, Town parking lot/ drainage retention area, Community Center, historical structure, or developed with park facilities. Now, therefore, be it RESOLVED by the Town Commission of the Town of Melbourne Beach, Brevard County, Florida, that the Town of Melbourne Beach has no real property within its jurisdiction to which the Town holds fee simple title that is appropriate for use as affordable housing. Be it further RESOLVED that this document was adopted after the conclusion of a public hearing held in accordance with the provisions of Section 166.0451, Florida Statutes. PASSED AND ADOPTED BY THE TOWN COMMISSION OF THE TOWN OF MELBOURNE BEACH, BREVARD COUNTY, FLORIDA, THIS 19th DAY OF MAY, 2010.

RESOLUTION NO. 2010-05 A RESOLUTION OF THE TOWN OF MELBOURNE BEACH, BREVARD COUNTY, FLORIDA, RELATING TO TOWN POLICIES AND PROCEDURES; MAKING FINDINGS; PROVIDING FOR A CASH MANAGEMENT POLICY FOR PUBLIC FUNDS; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the Town Commission finds that it is in the public interest that a policy be adopted for the management of public funds of the Town of Melbourne Beach NOW, THEREFORE BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN OF MELBOURNE BEACH, FLORIDA, as follows: Section 1. Exhibit A.

In the event that any term, provision, clause, Section 2. sentence or section of this Resolution shall be held by a court of competent to be partially or wholly unenforceable or invalid for any reason whatsoever, any such invalidity, illegality, or unenforceability shall not affect any of the other or remaining terms, provisions, clauses, sentences, or sections of this Resolution, and this Resolution shall be read and/or applied as if the invalid, illegal, or unenforceable term, provision, clause, sentence or section did not exist.
