AUCTION Auction Procedure
The property will be sold using the “Freedom Tract” auction program. The property will be offered in tracts, combinations of tracts, or as an entirety, as the bidders desire. The offering is made in such a manner that all bids remain open until the auctioneer declares the bidding closed. The manner in which the bids total the greatest amount of money, configured as desired by Seller, resulting in the highest price for the Property, will be declared the winning bids. A 7% buyer’s premium will be added to the high bid(s) to determine the contract selling price.

Bid Approval
The final bid is subject to the approval of the Seller to sell the real estate. Seller reserves the right to accept or reject any or all of the high bids placed at the auction.
Title Evidence
Seller shall pay any expense of title search fees, which shall be paid to the title companies, covering the property, and purchaser shall pay the base premium charged by the Title Companies for an owner’s title insurance policy covering the property and issued by a local title company. Buyer shall pay the premiums charged for any endorsements to the Owner’s Title Insurance covering the Property and any lender’s mortgage title insurance policy or loan policy covering the Property.
A bidders seminar, designed to explain the Freedom Tract auction method, will be held 30 minutes prior to the auction.

Terms and Conditions
Survey
The terms and conditions of this auction shall be governed by the Contract for Sale of Real Estate. The Purchase Agreement form is available at www.curranmiller.com or from Curran Miller Auction/Realty, Inc. and should be reviewed prior to the auction. THE HIGH BIDDER(S) AT THE AUCTION WILL BE REQUIRED TO SIGN THE PURCHASE AGREEMENT IMMEDIATELY UPON THE CONCLUSION OF THE AUCTION. NO CHANGES OR ALTERATIONS TO THE PURCHASE AGREEMENT WILL BE MADE. A deposit of 10% of the total Contract Purchase Price shall be made on the day of the auction with the balance due within 30 days after delivery of insurable title to purchaser.
Buyers Premium
A 7% Buyer’s premium shall be added to the high bid(s) to determine the contract selling price.
Possession of the property will be at final closing after payment of full consideration.
Seller will provide a current survey, only if a tract division has created a need for a new legal description. The surveyor and type of survey performed shall be at the Seller’s option and sufficient for providing deletion of survey exceptions in the title insurance policy.
Closing
Closing under all Purchase Agreements shall be on a date no later than 30 days after delivery of insurable title to purchaser or his agent.
Broker Participation
A real estate broker can earn a Buyer’s Registration Fee under the Curran Miller Auction & Realty “Keys to Added Income” program by registering their prospect at least 48 hours prior to the auction on a form provided by the auction company, attend the showing of the property with their client and attend the auction with their client. Earnest Money Deposit
An earnest money deposit equal to 10% of the contract purchase price is payable at the signing of the Purchase Agreement. The earnest money deposit will be deposited in the local title companies. non-interest bearing escrow account.
