ZONING AMENDMENT BYLAW NO. 3941

A Bylaw relating to amend regulations for temporary buildings and structures. _____________________________________________________________________________________

The Council of the Corporation of the City of Port Coquitlam enacts as follows: Citation 1.

This Bylaw may be cited for all purposes as “Zoning Amendment Bylaw No. 3941, 2016”.

Purpose 2.

The purpose of this Bylaw is to amend certain regulations applicable to temporary buildings and structures.

Administration 3.

That the Zoning Bylaw be amended as follows: 1)

In Section I, Definitions, by adding the following definitions in alphabetical order: Special Event Facility means a temporary accessory structure that is used for an activity such as a fair, festival, exhibition or public gathering event and is in place for a period of less than 7 consecutive days in any 30-day period. Seasonal Facility means an unheated temporary accessory structure and may include a fabric-covered frame structure which is attached to the ground that is used for an activity such as the sale of seasonal plants and trees or the protection of stored goods and is in place for a period of less than 6 months in any 12-month period. Storage Container means an unaltered shipping container without heating, wiring or other improvements that is used for temporary accessory storage. Tent Structure means a temporary accessory structure that has a fabric-covered frame that is either attached to the ground or a foundation and is in place for a period exceeding 6 months. Tree House means a temporary accessory structure that is not attached to the ground and is used for children’s play activities.

In Section III, Supplementary Regulations, Section 2, Accessory Buildings and Structures a)

In Subsection 2.1 by inserting “and structures” between “Accessory buildings” and “are permitted in every zone”; 3941 1

b)

In Subsection 2.6 by inserting “other than a tree house with a floor area of less than 10 m2” between “An accessory building or structure” and “in a residential zone must not exceed a height of”;

c)

In Subsection 2.7 by inserting “other than a special event facility” between “No part of an accessory building or structure” and “including projections, eaves and gutters, in a residential zone”;

d)

In Subsection 2.8 by inserting “or structure other than a special event facility” between “No accessory building” and “in a zone other than a residential zone”;

e)

In Subsection 2.9 by inserting “or structure other than a tent” between “No accessory building” and “in a zone other than a residential zone”; and,

f)

By inserting the following new subsections: “2.12 No storage container shall be used, placed or stored on any lot unless: a. the storage container is located in an agricultural, heavy industrial, general industrial, highway commercial, large format commercial, institutional or comprehensive development zone with these uses; b. the storage container is used only for storage purposes; c. in agricultural zones, the storage container is used for storage of agricultural products or equipment; d. the storage container is not sited within the front or exterior side setback areas; e. the number of storage containers is limited to the greater of 2 storage containers per lot or 1 storage container per 0.4 ha of lot area, up to a maximum of 4; and, f. the storage container is not stacked. 2.13

No tent structure shall be used, placed or stored on any lot unless: a. the tent structure is located in an agricultural, heavy industrial, general industrial, institutional or comprehensive development zone with these uses; and b. in agricultural zones, the tent structure is used for agricultural purposes.”

PROPOSED ZONING AMENDMENT BYLAW NO. 3941 AND PROPOSED OCP AMENDMENT BYLAW NO. 3942

Intent of the Bylaws: The amending Bylaws provide for changes to the City’s regulation of temporary buildings and structures such as fabric-covered structures, modular steel containers, pre-constructed buildings and regulation of structural additions such as industrial awnings. In summary, the amendments would allow shipping containers to be used for storage purposes in industrial, highway commercial, institutional and agriculture zones; treat modular buildings as permanent structures; eliminate the current 5-year limit for tents and restriction on their height; remove application of design controls for temporary buildings; and, clarify parking requirements. Inspection of Documents: A copy of the proposed Bylaws may be inspected in the Corporate Office, 2580 Shaughnessy Street, Port Coquitlam, BC, between the hours of 8:30 am and 4:30 pm, except Saturdays, Sundays, and any Statutory Holiday, between March 29, 2016 and April 11, 2016 at 4:00 pm Further information is available at www.portcoquitlam.ca/publichearings or details can be obtained from the Development Services Department at 604. 927.5442. Also available for inspection is the "Zoning Bylaw, 2008, No. 3630" and “Official Community Plan No. 3838” (which would be amended by the proposed Bylaw) and various reports referring specifically to the purpose of the amending Bylaw. Public Participation: At the hearing the public will be allowed to make representations to the Council respecting matters contained in the proposed Bylaws. All persons who believe their interest in property is affected by the proposed Bylaws will be afforded a reasonable opportunity to be heard, or to present written submissions respecting matters contained in the Bylaws. All written and verbal submissions will become part of the Public Hearing record. After the Public Hearing has been completed, Council can no longer receive additional or new information on the proposed amendments.
