Standing Timber & Land Sale Offered By Sealed Bid 41 acres +/Talladega County, Alabama As exclusive agent for the property owner we are pleased to offer for sale 41 acres of timberland located in Talladega County, AL. This tract is located about 3 miles southeast of Winterboro. Bidders may bid on timber-only, land-only, or land & timber together (see the required Bid Form on Page 3 for more detail). General Bid Terms: Bidders must use the bid form provided. A Bid Deposit of 10% required for a bid that includes land (no Bid Deposit required for timber-only bids). For a land bid, please mail or hand deliver your bid and deposit check (no verbal or fax bids). Timber bids may be mailed, faxed or hand delivered. The bid opening will be public. Terms of Offering & Additional Information 1. Bidders are welcome to inspect the land at any time up to bid opening. Enter at your own risk. Use the attached maps as an aid. Call Tom Brickman at 205-936-2160 to get the gate combo. See directions below (# 13).

2. The bid opening is Thursday, July 17, 2014 at 2:00 PM, central time at the office of Cyprus Partners (see office address on Page 1). If a winning bid is awarded, the winner will be notified by Monday, July 21, 2014.

3. The property owner reserves the right to reject or accept any or all bids regardless of price. The owner reserves the right to negotiate with any bidder. The owner reserves the right to withdraw the Property from the market at any time without notice.

4. Bidders may bid on combinations of timber-only, land-only, or land and timber together. The land owner will determine the winning bids, if any, in their sole discretion. Timber is being offered for sale on a lump-sum, pre-paid, clear-cut basis, subject to Alabama Best Management Practices For Forestry. A successful timber bidder will have to negotiate access agreements with landowners between the property and Co Rd Pine 12”+ stump and hardwood 18” + stump may be cut inside the SMZ’s. SMZ’s are unmarked. Buyers will be given 12 months until July 21, 2015 to cut and remove the timber. A performance bond of 5% of the bid amount (minimum $2000) will be required for a timber-only sale when the timber is paid for. Timber volume estimates are shown below (#12).

5. Successful Bidders and the Owner will execute either the “Land Sale Contract” or the “Timber Sale Contract” as soon as practical after awarding the bid. These documents are part of the terms of this sale and stipulate the sale conditions and responsibilities of Buyer and Owner. Bidders should be comfortable with these documents before placing a bid. Call Cyprus Partners for copies. Failure to agree to the terms of these contracts can be grounds for rejection of a bid regardless of bid amount.

6. The property is for sale in it’s “as-is” condition, subject to the conditions, requirements and exceptions stipulated in the “Land Sale Contract” or the “Timber Sale Contract”. Mineral rights will not be warranted by the owner, though it is the owner’s intention to convey any mineral interest owned, if any. Lack of public access will be a permitted title exception.

7. Bids not submitted on this Bid Form can be disqualified. Bids for land require a Bid Deposit of 10% of the bid amount. Bid Forms and Bid Deposit checks should be submitted in a sealed envelope marked “Knight Sale” on the outside. Bid deposit checks must be bank certified funds and made out to “Cyprus Partners Escrow Acct.”. Bids for land without a bank certified Bid Deposit check can be disqualified. Bid Deposit checks are not required for timber-only bids.

8. No bids will be accepted after 2:00 PM on bid-day. Bid deposit checks of unsuccessful bidders will be mailed back by First Class U. S. mail within 7 days of the bid opening.

9. Per-acre bids or bids for less than the entire tract can be disqualified. In the event of tie bids, the tie bidders will be allowed to submit new bids. Bidders mailing bids should confirm receipt of their bid by phone with Cyprus Partners prior to bid opening. 10. A real estate closing will be at the office of Matthew West in Talladega, with conveyance by Warranty Deed. 11. Cyprus Partners & the Owner do not warrant the acres, boundaries, fair market value, zoning, access, condition of title, timber volume or value, mineral ownership or suitability of this property for any particular use. By signing the Bid Form, bidders warrant that all information in this brochure has been independently verified to the bidder’s satisfaction, and that the Bidder is not relying on any information provided by Cyprus Partners or the Owner. 12. 13. Directions: from the intersection of U S Hwy 280 and AL Hwy 21 (Broadway Ave.) in Sylacauga, go north on AL Hwy 21 for 8.3 miles. Turn right onto Main Street in Sycamore and go east 0.5 miles. Take the second left onto Cemetery Road, go 200 feet crossing the railroad track and bear right keeping on Cemetery Road. Go 1.2 miles to a dirt road and yellow pipe gate on the left. Look for Cyprus Partners sign. This gate is locked so call for combo. You will need a pickup truck from this point on. Go through the gate and go 2.7 miles (watch for pink flags marking the route when there are forks) to a dirt road on the left (look for a Cyprus Partners sign). Go 1.2 miles to the end of the road. From here you are about 150’ from the SE corner of the 41 acre tract. The south line is painted white. You’ll have to walk from here. Use the topo map as a guide.
