8.4 “Placerville, a Unique Historical Past Forging into a Golden Future” City Manager’s Report May 9, 2017 City Council Meeting Prepared by: Dave Warren, Director of Finance Item #: 8.4 Subject: Adopt a resolution retroactively approving and affirming a side letter with the Placerville Police Officers’ Association and authorizing the City Manager to execute the same. ______________________________________________________________________________ Background: As mandated by the Public Employees’ Pension Reform Act of 2013 (PEPRA), the California Public Employees’ Retirement System (CalPERS) has begun doing periodic compliance audits (AKA public agency reviews) of all CalPERS agencies, including the City of Placerville. During 2015, CalPERS performed a public agency review of the City of Placerville and concluded that Article 17 (P.O.S.T./Education Incentive Maintenance) of the Placerville Police Officers’ Association (PPOA) Memorandum of Understanding (MOU) does not include the P.O.S.T./education incentive pay amounts for sworn officers who work twelve hour shifts or eighty-four hours every two weeks (Condition 3B). The City negotiated a side letter with the PPOA recently, and staff recommends the City Council adopt a resolution approving the side letter. Discussion: The P.O.S.T./education incentive pay amounts shown in Article 17 of the PPOA MOU are based on an eighty hour pay period. The City has a long standing past practice of paying sworn officers 5.00% more P.O.S.T./education incentive pay when they work an eighty-four hour pay period. The 5.00% adjustment in incentive pay is proportionately justified by the four additional hours these Officers have to work. No additional compensation will result from the approval of the proposed PPOA side letter. Adoption of the resolution will add language to the MOU which corresponds with current practice and satisfies the audit finding. Options: 1. Adopt the attached resolution approving the side letter as presented. 2. Adopt a resolution approving another side letter. 3. Direct staff to negotiate another side letter. Cost: Other than a minimal amount of staff time, there is no cost associated with tonight’s action. Budget Impact: The P.O.S.T./education incentive pay amounts shown in the proposed side letter with the PPOA were assumed in the Fiscal Year 2016/2017 adopted Operating Budget. DRW/5/4/2017 2:13 PM
