ISSUE The growth and success of the Charter SELPA is due to the vested interest that each member has had in the success of this model. This shared investment demonstrates a partnership that is at the core of all that we do. It is essential that Charter SELPA policies and practices acknowledge the different types of partners within the Charter SELPA as well as the capacity that develops in subsequent years of operation. The Charter SELPA funding formula needs to be revised to reflect these beliefs. Currently the funding formula:
Treats each charter as a separate entity and does not adequately differentiate for organizations (CMO/Other) with two or more charters.
Allows for the administrative fee reduction in year three if the charter school demonstrates special education expertise. The current criteria “designated special education administrative expertise” does not recognize the special educational institutional capacity in a charter organization that develops over time.
BACKGROUND Our current Governance model recognizes each charter as a voting member, with one vote per charter. We are not proposing a change to governance; however, we are proposing a change in funding by recommending the date of entry for certain funding elements be based on the date of the organization entry to the Charter SELPA, not the date of the individual charter.

**Established by CEO Council action May 2011. 6% fee in year one, 5% fee in year two, and in year three, a charter may be eligible for a 4% administrative fee if the following criteria are met: Meets minimum CEO Council and Steering Committee participation requirements Timely submission of program reporting: e.g. IEP reporting, Pupil Count, etc. Timely submission of financial reports and meets maintenance of effort requirements No outstanding program compliance issues Demonstrated special education expertise with a designated person (not the CEO) who handles most routine day-to-day special education issues.

In 2012-13, the Charter SELPA was comprised of 171 charter LEAS, representing 68 partners (43 single charter partners and 25 CMO/Non-profits with two or more charters). In 2013-14, we are projected to have 192 charter LEAs, representing 83 partners (54 single charter partners and 29 CMO/Non-profits with two or more charters).
RECOMMENDATION - ALLOCATION PLAN REVISION Part 1 Establish two categories of Partnership: Single Charter Partner and Organization Partner based on criteria outlined below. Part 2 Establish for calculation of set-aside and administrative fee only - the Organization Partner’s date of entry is based on the date of entry of the Organization Partner, not the individual charter member. Part 3 Revise the administrative fee policy to reflect a 4% administrative fee in year five, based upon a criteria that the Single Charter Partner or Organization Partner is actively engaged in building special education institutional capacity. After adoption of the three proposals above, the allocation plan language would be revised to reflect these concepts and return for approval to full CEO Council.
PART 1 DETAIL Membership in the Charter SELPA continues to be based on each charter (designated by the specific CDS code given to the Charter). Each Charter has one vote in governance. However, for calculation of the administrative fee and the set-aside, the recommendation is to establish two categories of Charter SELPA partners as noted below: Single Charter Partner Charter school with one site (CDS code). Organization Partner
CMO with one Chief Executive Officer position (or one governing board), and more than one charter with membership in the Charter SELPA (multiple CDS codes) Non-profit corporation with one CEO position (or one governing board) and more than one charter with membership in the Charter SELPA (multiple CDS codes) The title of CEO may differ by organization, but the intent is that final decision making in the organization is vested in one leadership position.

PART 2 DETAIL ORGANIZATION PARTNER
Administrative fee at 6% in year one, 5% in year two, possible 4% in year three (no change) Determination of year one, two, three for administrative fee is based on longevity of Organization Partner, not the individual dates of each charter expansion. Set aside starts at 5% and reduces over time to 2% (no change). Determination of year one, two, three and four for set-aside, is based on longevity of Organization Partner, not the individual dates of each charter expansion. Vesting of the set-aside (completion of four years with the Charter SELPA) is based on the longevity of the Organization Partner as well. The proposal would provide for: A new CMO/Non-profit starting with the Charter SELPA in 2013-14, would start at 6% administrative fee in year one and reduce in year two, to 5%. However, in year two, when the rate drops to 5%, any expansion charters started in that year would be at 5% as well. A CMO/Non-profit with five years in the Charter SELPA and currently qualifying for the 4% administrative fee, would have their 2013-14 expansion charter qualifying for the 4% fee and the 2% set-aside. Under the current formula, the new expansion charter would have paid a 6% administrative fee and 5% set-aside. The proposal is only intended to impact calculation of the administrative fee and set-aside. For purposes of qualifying for federal funding or other possible funding sources based on prior year ADA, a new charter expansion is based on the year of entry of the charter, not the date of the Organization Partner’s entry.
