Annexure - 1 Terms and conditions terming part of Transportation Contract of our domestic & export consignments GUIDELINES FORMING PART OF OUR TERMS AND CONDITIONS Vehicle Placement 1.

You have to contact us everyday between 1500 - 1700 hrs. to ascertain whether any load is available for your station for the next day.

2.

Generally the truck-booking information will be given to you the previous day, but we also expect you to provide us trucks even if we book them by 1100 hrs. for the same day dispatch.

3.

It will be the specific responsibility of the transporter to check and verify the vehicle documentation to ensure uninterrupted journey en-route. The vehicle permits, PUC, insurance must remain valid throughout the journey.

4.

If the given lot is not lifted within 48 HRS from the time of call/indent raised. We may hire vehicles from the market at prevailing freight rate and the differential amount shall be debited to you.

5.

Any penal charges like demurrage, detention which are paid due to late / non placement of vehicles, will be debited to your account.

Loading and Unloading 1.

Trained staff must be deputed for proper supervision, loading and documents preparation and ensure that your bilty clerk reports/present/available at factory/dispatch dept. on or before 8.30 am.

2.

Your staff is responsible to properly count and get loaded all the packages into the truck. They must also exercise proper supervision during loading and stacking inside the truck to avoid damages to the consignment during transit.

3.

Sufficient lashing is to be done to prevent damage to the consignment where necessary and material must be covered with good quality tarpaulin/PVC sheets etc. You should provide for hay / grass as dummage for Oil consignments where necessary for long distance stations to prevent damage & leakage to drums / HDPE containers.

Documents 1.

We will issue all the documents necessary for transportation of the consignment. However, it will be the responsibility of your staff to ask for and collect all the documents from us / our CHA .    

Consignment Challans, Invoices, Delivery Memo etc; Central Excise Gatepass (Ex. GP1); Where applicable, Road Permit, Sales Tax Form, Octroi Form etc. Your staff must carefully fill in the relevant Carriers/Drivers information in such forms.

2.

Based on the above documents and the weighbridge slip, the G C Note must be prepared and handed over to us as an acknowledgement of having received the consignment for onward transportation to the destination in safe and sound condition.

3.

Your staff must be suitably instructed to exercise utmost care in preparation of relevant transit documents and also ensure that they are all handed over to the driver of the truck before it leaves the factory gate.

4.

The driver must be advised to ensure safe handing over of all documents.

Transit Time 1.

You must adhere to the transit time specified for the destination. Delayed deliveries will attract late delivery penalty @ Rs. 250/- per ton per day. However, the penalty amount charge by the consignee towards late delivery shall be debited to you.

Transhipment In case of any mishap, prior approval needs to be taken from us before doing any transhipment. Therefore direct vehicles placement is essential to avoid transhipment. General 1.

You will have to submit a Bank Guarantee / Security Cheque for from a Nationalized/First class Bank with regard to performance and surety towards materials safety.

Payment will be released after a credit period of 30 days from the date of submission of the bills along with receipted LR duly acknowledge, signed and stamped by our consignee.

3.

The amount paid by you towards Octroi / Entry Tax, etc. shall be reimbursed on submission of the original receipts in consignee’s name.

4.

The driver of the vehicle must be clearly instructed, that in the event of detention of the truck by any Government Agency, due to a mechanical failure, an accident or any other reason, he should immediately contact your nearest office and/or our nearest office and inform all the necessary details to enable us to take action if necessary. In this case the vehicle and consignment must be properly guarded and not abandoned.

5.

We reserve the right to add, delete or alter any of the terms and conditions governing this contract.

6. All our consignments will be carried by you at 'CARRIERS RISK'. Under this you will be fully responsible for all the transit risks and losses arising due to damage, shortage, theft, rain, fire, accident and any other causes. Any negligence in protection of our interests will make you liable to make good the losses from the claims arising due to these causes. These claims will be fully borne by you and are recoverable against your freight bills. 7.

The standard / special terms and conditions printed on your Goods Consignment Notes (LR’s) will not be binding on us. This transportation contract will be governed by the terms & conditions set out in this letter and the Annexures attached herewith.

8.

Your staff and workmen should be strictly instructed not to loiter around in any department without adequate reason. They would be sent out by the Security staff if they do not comply with the factory regulations. The identification badge/token given to them must be prominently displayed.

9.

Smoking is strictly prohibited in factory premises. All your staff, workmen and vehicle operating crew is to be positively warned about "no smoking" restrictions.

10. BOTH THE PARTIES AGREEDTO WAIVE OFF THE PROVISION OF THE “THE CARRIAGE BY ROAF ACT, 2007 & THE MULTIMODEL TRANSPORTATION OF GOODS ACT, 1993”. ALL THE ABOVE OPERATING INSTRUCTIONS / GUIDELINES FORM PART OF OUR TERMS AND CONDITIONS FOR TRANSPORTATION OF OUR GOODS BY YOU. You will be held solely responsible in the event of any deviation or noncompliance of the above terms and conditions resulting in any loss to us.
