RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLACERVILLE APPROVING THE SUMMARY VACATION OF EXCESS PUBLIC RIGHT-OF-WAY FOR A PORTION OF BROADWAY AND AUTHORIZING THE MAYOR TO EXECUTE A QUITCLAOM DEED RELINQUISHING THE UNDERLYING FEE TITLE OF THE SAME WHEREAS, the real property described in Attachment “A-3” and “B-3”, attached hereto and incorporated herein by reference, constitutes excess right of way adjacent to Broadway Street and is not required for street or highway purposes; and WHEREAS, the City desires to vacate said excess right of way. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Placerville as follows: 1. The City of Placerville hereby vacates as excess right -of-way that certain real property described in Attachments “A-3” and “B-3” attached hereto and incorporated herein by reference. 2. The vacation of this right-of-way is made pursuant to Section 8334 and 8335 of the California Streets and Highways Code as authorized in Division 9, Part 3, Chapter 4, Article 2 of said code. 3. This summary vacation is based upon the fact that said right-of-way is not required for street or highways purposes, has not been used for street and highway purposes and has not been used for public utility purposes. 4. The City Clerk is directed to record this resolution in the office of the Recorder-Clerk of the County of El Dorado, State of California. 5. The Mayor is authorized to execute a Quitclaim Deed, relinquishing the underlying fee to the rea; property described herein above and City Clerk is directed to record said Quitclaim Deed. The foregoing Resolution was adopted at a regular meeting of the City Council of the City of Placerville held on June 28, 2016, by Councilmember _____________, who moved its adoption. The motion was seconded by Councilmember ____________. A poll vote was taken which stood as follows:
