Booking of Prisoners

Fight Crime, Promote Safety 437.1

PURPOSE The purpose of this policy is to establish a procedure for the operation and booking of persons into our detention facility.

437.02

DETENTION FACILITY CLASSIFICATION The Minnetrista Police Department is a class IV Municipal Holding Facility. A “Class IV Municipal Holding Facility” means an adult detention facility operated by a municipal government used to confine prisoners for up to 4 hours. Juveniles may also be held up to 4 hours.

437.03

STAFFING The facility administrator will be the Administrative Supervisor. The daily operation of the detention facility will be the responsibility of the Administrative Supervisor, the on–duty Patrol Supervisor (in the absence of the Administrative Supervisor), or the booking officer on-duty (in the absence of a supervisor). It will be their responsibility to ensure compliance of this policy. The Administrative Supervisor will be responsible for the training of the staff. It will be the responsibility of the arresting officer to do the booking of the arrested person(s). On-duty Supervisors may assist the officer with the booking procedure and monitoring when practical, but it will be the arresting officer’s ultimate responsibility to ensure the booking procedure is complete and to monitor prisoners during their detention. When practical, same sex searches and supervision of prisoners must occur.

437.04

CONSTITUTIONAL RIGHTS A detainee’s constitutional right to privacy can be violated if records are improperly disseminated. Detainee’s records will be maintained in strict accordance with the provisions of the Minnesota Government Data Privacy Act. Specifically, the public, without need of identification or authority, may obtain the following four items: 1)

Whether or not a detainee is in custody, and if and where they had been transported to.

What the charges, holds or detainers are.

3)

What the conditions of the release are.

4)

The time, date, and place of the next court appearance, if known.

The Director will oversee the Police Department’s Data Compliance pursuant to Minnesota State Statute 13.05 sub 13 and will process all other information or requests for information. 437.05

DANGEROUS ITEMS There will be no dangerous items allowed within the detention area of the Minnetrista Police Department. This would include but not be limited to matches, lighters, guns, and knives. Any law enforcement officer(s) entering the detention area will deposit all weapons, including knives, in the weapon lockers prior to entering the detention area. This does not include electronic incapacitating devices, batons and chemical agents. Exception to this policy: When a situation or condition exists, that would promulgate the need for such weapons for tactical purposes of the officers or detainee(s) safety, or training exercises when the detention area is unoccupied.

437.06

PRISONER PLACEMENT Placement: No prisoner will be placed into any cell until he/she has been properly searched, except that unruly prisoners who are combative may be placed into a cell prior to the completion of the booking process, if it is in the best interest of the department and the prisoner, and all harmful objects have been taken from him/her. This occurrence must be documented on the booking form. Officers are not restricted to booking at the Minnetrista Police Department. If the officer believes that for officer safety and or the prisoners personal well being or other documented reasons the officer has the discretion to transport the prisoner to a full-time Detention Facility or jail for booking and processing procedures.

437.07

MEDICAL DISABILITIES AND RESPONSIBILITIES 1)

Prisoners with physical disabilities and those who display symptoms of severe despondency or mental illness or considered to be a danger to self or others shall be transported to a full-time adult detention facility as soon as possible. Prisoners who have complex medical conditions and/or care needs may also be transported to a full-time detention facility at the discretion of a supervisor.

Ridgeview Medical Center and Hennepin County Medical Center provide 24 hour health care to detainees.

Detainees suspected of having communicable disease will be separated from other detainees.

4)

Officers shall have appropriate medical personnel respond to attend to any detainee in the holding facility that becomes injured or complains of a medical condition requiring medical attention.

5)

Officers will follow department policy 109 for the notification of a supervisor in the event of a prisoner injured while in the holding facility.

6)

No medication will be dispensed to any detainee. Medication, which the detainee may have had at the time of the arrest, may only be dispensed upon the detainees request and only by medical personnel (physician or paramedic).

7)

The officer shall note any medical attention given to a prisoner on the booking form and document this in their report.

437.08

DETENTION FACILITY PROCEDURES 1)

Officers shall back their vehicles into the garage and close the overhead door.

Officers shall secure all weapons in one of the gun lockers. This will include duty firearm, backup weapon, and knives.

Holding Facility a)

All prisoners brought into the holding facility shall be handcuffed unless medical or other documented reasons are noted in the officer’s report.

b)

Prisoners shall be brought into the booking facility through the sally port garage entrance.

c)

When entering the booking facility through the interior of the police department, officers shall secure their duty firearms, back-up weapons and knives in the gun locker located outside the holding facility entrances before entering the holding facility.

The entrances accessing the holding facility will remain closed and secured at all times.

Searching of Prisoners a)

All prisoners will remain handcuffed behind the back until the individual has entered the booking area and circumstances are deemed safe for the handcuffs to be removed.

b)

Violent prisoners shall remain handcuffed throughout the booking procedure until placed in a holding cell.

c)

Officers shall conduct a thorough search of the prisoner prior to being placed in a cell.

d)

All personal property shall be removed from the prisoner including; purses, wallets, jewelry, belts, etc. and entered on the property inventory portion of the booking form. Eyeglasses may remain with the prisoner during the booking process. Jewelry which can not be removed may remain with the prisoner during the booking process.

e)

Upon completion of a thorough custodial search of the prisoner by the officer, a metal detection device scan will be performed as well.

BOOKING PROCESS AND ADMISSION Booking Form and Property inventory 1)

Officers will complete a booking form sheet on all prisoners brought into the booking facility.

2)

All requested information shall be filled out completely including an inventory list of all property taken from the prisoner.

3)

All money shall be counted out loud and in front of the prisoner and documented on the booking form.

4)

The detainee’s personal property shall be placed in a booking locker.

5)

All prisoners shall be finger printed and photographed before their release. (except juveniles not booked for targeted offenses)

SEPARATION OF PRISONERS

The following prisoners will be housed separately from sight and sound.

437.11

1)

Female prisoners from male prisoners

2)

Juvenile prisoners from adult prisoners.

3)

Combative and intoxicated prisoners from all others.

4)

All juvenile offenders under ten years of age and status offenders (truants, tobacco, curfew, runaway, etc) must be placed in a non-secure room. (I.E. open soft interview room). They may not be held in a cell or juvenile holding room under any circumstance.

5)

When a juvenile is in either the juvenile holding room, cell, or any other part of the booking facility when an adult prisoner is present, the officer shall cover any interior booking room windows, including cells to protect the sight of the juvenile from the adult prisoner. (paper with tape or a provided window covering)

INSPECTIONS The following inspections will be accomplished as indicated: 1)

Annual Inspections A fire inspection of the facility must be conducted in accordance with the applicable fire codes on an annual basis by a State Fire Marshall or local fire official. Documentation of the inspection must be in compliance with the department of Corrections 2911.7300 sub1-2.

Daily Inspections There shall be an inspection of the facility by a Patrol Officer. The inspection will include a visual inspection of the holding facility to detect building and equipment deterioration, safety, hazards and unsanitary conditions. The log sheet will be turned into the Administrative Sergeant upon completion of the inspection.

Officer Inspections It is the Officers’ responsibility to perform cell checks on any prisoner who is placed in a holding cell. Officers will conduct prisoner welfare checks every fifteen minutes and will document this on the booking form. Officers will check the holding cell before a prisoner is placed inside the cell and after the prisoner is released.

INSTRUMENTS OF RESTRAINT Instruments of restraint, such as handcuffs, chains, irons, and straitjackets must not be used as punishment. 1) Instruments of restraint must not be used except in the following circumstances a) As a precaution against escape during transfer b) On medical grounds by direction of a consulting or attending physician or licensed psychologist c) By order of the facility administrator or person in charge in order to prevent a prisoner from injuring himself or herself, others, or from damaging property 2) The facility administrator shall develop written policies and procedures to govern the use of restraints. 3) Instruments of restraint must not be applied for any longer than is strictly necessary. 4) Each incident involving the use of restraints consistent with item 1, sub item (b) or (c), must be documented and on file.

PRISONER VISITATION 1) Prisoners are allowed non-monitored audio visits with the prisoner's attorney. 2)

When a visit to a prisoner is denied on the belief that the visit might endanger the security of the facility, the action and reasons for denial will be documented.

3) Visitors must register, giving name, address, relationship to prisoner, and nature of business. 4) Visiting will not be audio monitored. 5) Visits by parents, guardians, and attorneys with juvenile prisoners will be as unrestricted as is administratively possible.

CORRESPONDENCE A prisoner must be provided a copy of the Bible or sacred book of another religion at the expense of the appointing authority.

BEDDING, LAUNDRY, AND CLOTHING REMOVAL Removing clothing and bedding. 1) The facility administrator shall develop a policy and procedure for dealing with incidents in which prisoner’s misuse clothing or bedding. 2) Clothing and bedding should be removed from a prisoner only when the prisoner's behavior threatens the health, safety, or security of self, others, or property. 3) Clothing and bedding must be returned to the prisoner as soon as it is reasonable to believe that the behavior that caused the action will not continue.

437.16

EMERGENCY PLANS AND PROCEDURES (SEE ATTACHED MAP AS WELL) The facility administrator shall develop a written emergency plan. The plan must include: 1) Location of alarms and fire fighting equipment 2) Emergency drill policy 3) Specific assignments and tasks for personnel 4) Persons and emergency departments to be notified 5) A procedure for evacuation of prisoners 6) Arrangements for temporary confinement of prisoners

There must be a documented quarterly review of emergency procedures by the person in charge of the facility that includes: 1) Assignment of persons to specific tasks in case of emergency situations 2) Instructions in the use of alarm systems and signals 3) Systems for notification of appropriate persons outside the facility 4) Information on the location and use of emergency equipment in the facility 5) Specification of evacuation routes and procedures

ADMISSIONS

Admission policies and procedures must include the following: 1) Showering and delousing facilities

SEARCHES AND SHAKEDOWNS Visitors 1) Visitors may be pat searched if reasonable suspicion exists that they may introduce contraband into the facility. Visitor belongings will always be searched.

Regular Inspection of Facility 1) The facility must be regularly inspected for contraband, evidence of breaches in security, and inoperable security equipment. Facility inspections must be documented.

Inspection of Materials 1) All materials delivered to or transported from the facility must be inspected for contraband before distribution and the inspection must be documented.

437.19

COUNT PROCEDURE Formal counts must be completed with an official entry made in the daily log after each mass movement and at least once every eight hours.

437.20

DELIVERY, SUPERVISION, AND CONTROL OF MEDICINE Policy for storage, delivery, and control of medicine 1) The facility shall not stock supplies of legend drugs 2) Medicine is to be stored in a locked area 3) The storage area must be kept locked at all times 4) Medicine requiring refrigeration must be refrigerated and secured 5) Prisoners are not permitted in the medicine storage area

6) Only staff authorized to deliver medicine may have access to keys for the medicine storage area 7) Prescribed medicine must be kept in its original container, bearing the original label 8)

Poisons and medicine intended for external use must be clearly marked and stored separately from medicine intended for internal use

Procedures for delivery of medicine 1) All medicine administered by injection must be administered by a physician, registered nurse, or licensed practical nurse. Diabetics under physician order and direct staff supervision must be permitted to self-administer insulin. 2) No prisoner while receiving a legend drug may receive any non-legend drug without approval of the attending physician. 3) Must report to the physician any adverse reactions to drugs. Any reports shall be included in the prisoner’s file. 4) Must report to the attending physician a prisoner’s refusal of prescribed medicine, and an explanation made in the prisoner’s record. 5)

Must ensure that no prisoner is deprived of medicine as prescribed because of penalty or staff retaliation.

6) Delivery of medicine shall not be done by prisoners. 7) A physician must be contacted for instructions before the next prescribed medicine dosage time for all newly admitted prisoners who are either in possession of prescribed medicine or indicate a need for prescribed medicine.

437.21

EMERGENCIES AND SPECIAL OCCURRENCES Prisoner death. When a prisoner's death occurs: 1) The date, time, and circumstances of the prisoner's death must be recorded in the prisoner's record 2) If the prisoner dies in the facility, the coroner, medical examiner, or sheriff must be notified immediately

3) Personal belongings must be handles in a responsible and legal manner

4) Records of a deceased prisoner must be retained for a period of time in accordance with law

5) The facility administrator shall observe all pertinent laws and allow appropriate investigating authorities full access to all facts surrounding the death
