If Buyer is not an individual (e.g., Buyer is a legal entity, such as a corporation, LLC, or partnership, a public officer or is signing on behalf of an individual Buyer as an attorney in fact), then Buyer should complete an appropriate alternate form of Buyer’s Financing Contingency Affidavit (see e.g., MSC-2010B).

Buyer’s Financing Contingency Affidavit COMES NOW (print name) _____________________________________________________________ (“Buyer”) and, first being duly sworn and on his/her oath, states the following with respect to the above Contract regarding the above Property: 1) I am a Buyer under the above Contract; and 2) I have done all things reasonably necessary to make a good faith effort to obtain financing as described in Section 5 of the Contract, but have been unable to do so; and 3) Despite request, I have been unable to obtain a Notice from my prospective lender of my inability to obtain financing as described in Section 5 of the Contract; and 4) Buyer declares the Contract terminated and requests return of the Earnest Money (Mutual Release form MSC-4050 attached). Under penalties of perjury, I declare that I have examined this Affidavit and to the best of my knowledge and belief it is true, correct and complete. Buyer
