CITY COUNCIL MEETING MINUTES February 18, 2014 7:00pm 1) Call to Order Fischer called the meeting to order at 7:00pm. In attendance: City Council: Mayor Cheryl Fischer, Mark Vanderlinde, Anne Hunt, Arlene Donahue, Bob Christians Staff: City Administrator Mike Funk, Assistant City Administrator Michael Barone, Community Development Director David Abel, Finance Director Brian Grimm, Police Chief Paul Falls; City Clerk Terri Haarstad Consultants: City Engineer Mark Erichson (WSB) Absent: City Attorney Ron Batty (Kennedy & Graven) Motion by Hunt second by Donahue to approve the agenda as amended. Motion carried 5 – 0. Add item 3b) Proposal by Bolton and Menk for a Value Engineering Study on the Proposed Water Treatment Plant
2) Persons to Be Heard Crystal Jensen (4729 Merganser) spoke about her concern about water quality, requested the City Council look at water treatment proposals from engineering firms other than WSB and associates and spoke in favor of a Reverse Osmosis Water treatment plant.
3) Special Presentations a) David Osmek, State Senator It was noted that Senator David Osmek will be arriving late and will give his presentation upon arrival. b) Robert Brown, Bolton and Menk, presented the City Council with a proposal for a value engineering study on the proposed water treatment plant, highlighted the qualifications of Bolton and Menk staff intended to serve on the project team should the proposal be approved and provided an overview of the proposed timeline. Motion by Hunt second by Christians to accept the Bolton and Menk proposal for a value engineering study at the rate of $10,000 in addition to airfare and hotel for Gordan Culp, Bolton and Menk consultant, to be conducted Wednesday February 26th, Thursday February 27th and Friday February 28th in Chaksa, MN with the attendance and assistance of WSB Engineering, Minnetrista City Staff and the City Council. Bolton and Menk will provide specific times and directions to City staff, WSB and the City Council. Motion carried 5 – 0.

5) Public Hearings a) None
6) Business Items a) Official Naming Status of the former Camp Kingswood Property (Three Rivers Park District) Abel presented the staff report as found in the City Council packet dated February 18, 2014. Motion by Vanderlinde second by Donahue supporting the official name of Kingswood Park for the Three Rivers Park District property formerly known as the Camp Kingswood property. Motion carried 5 – 0. b) Branding Discussion Funk presented the staff report as found in the City Council packet dated February 18, 2014. Motion by Hunt second by Christians to approve the contract with Tony Hessburg and Eleven. Motion carried 5 – 0. c) Noise Ordinance Discussion Abel presented Section 1005 of the Minnetrista City Code regulating construction related noise and explained how staff works with developers to educate them about noise regulations. Falls provided the City Council with statistics regarding noise complaints received by the police department and described the City Code enforcement process currently used. their subcontractors receive a copy of the noise ordinance. However, on-site signage should be effective in reminding contractors and subcontractors of the regulations. Discussion included: Whether or not a clause should be added to the ordinance to provide an exemption for emergency response Who gets cited if a violation occurs – the developer or the subcontractor Adding noise regulations in the developer’s agreement Whether or not work should be prohibited on all holidays or just the major holidays such as Christmas Day, Thanksgiving Day, New Years’ Day, Memorial Day, Labor Day and Independence Day. Motion by Christians second by Donahue to amend Section 1005 of the City Code to prohibit work on major holidays. Motion carried 5 – 0. Senator David Osmek arrived and provided the City Council with an update from the last legislative session. Of note: granting sales tax immunity to local municipalities, permitting express service buses to utilize the shoulders on Highway 494, raising the cap on allowable microbrew growler sales. He stated that the new legislative session begins in a week. Expected bills include a gas tax increase, a metropolitan area sales tax increase, giving MnDOT tax exempt status, a bonding bill and more. He informed the Council that while the meeting with the Met Council regarding the Minnetrista Water Treatment plant was positive, he does not expect SAC charges to be waived. He encouraged the City Council to look at the viability of applying for a Clean Water grant and encouraged the City to contact Representative Eric Paulsen to see if he has funding ideas.
7) Administrative Items a) Res. No. 13-14 Approving Claims Motion by Donahue second by Vanderlinde to approve Resolution No. 13-14 Approving the Claims. Motion carried 5 – 0. b) Council Reports i) Mayor Fischer – Has upcoming meetings with the Northwest Hennepin League of Municipalities, Planning Commission, Rotary and the St. Bonifacius/Minnetrista merger committee ii) Mark Vanderlinde – None iii) Anne Hunt – Attended a meeting last week for the Lake Minnetonka Conservation District (LMCD) where invasive species and DNR access points were discussed. iv) Arlene Donahue – None v) Bob Christians – Westonka Community and Commerce (WCC) had the moonlight trail event and thanked participants for making it successful. Has a St. Bonifacius Fire Advisory Committee meeting next Thursday. c) Staff Reports Falls informed the City Council that on March 6, 2014 area cities including Minnetrista will be hosting a community forum regarding relationship abuse

A forum regarding marijuana is temporarily scheduled in April. d) Upcoming meetings i) Set Upcoming Meeting Topics Funk informed the Council about upcoming meeting topics. Motion by Hunt second by Donahue to hold a joint meeting with the Parks and Planning Commissions during the special meeting scheduled for 5:30pm on March 3, 2014 pending availability of the Commissioners and a water sustainability expert such as Ali al-Hasan from the Met Council. Motion carried 5 – 0. Funk stated that he will contact Mr. al-Hasan or another water sustainability expert and will schedule a joint meeting on March 3rd, March 17th, or April 3rd depending on his availability.
