CITY OF THE COLONY, TEXAS ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, REPEALING IN ITS ENTIRETY ORDINANCE NO. 675, AND ESTABLISHING A FIFTEEN FOOT (15’) WIDE ALLEY RIGHT-OF-WAY LOCATED WITHIN THE CITY OF THE COLONY, DENTON COUNTY, TEXAS AND GENERALLY DESCRIBED AS AN APPROXIMATELY 0.042 ACRE TRACT OF LAND IN THE S.E. HAYES SURVEY, ABSTRACT NO. 648, CITY OF THE COLONY, DENTON COUNTY, TEXAS, AND WHICH IS MORE PARTICULARLY DESCRIBED AND OR DEPICTED IN EXHIBIT A, WHICH IS ATTACHED HERETO AND INCORPORATED HEREIN FOR ALL PURPOSES; PROVIDING FOR THE FILING OF A CERTIFIED COPY OF THIS ORDINANCE IN THE DEED RECORDS OF DENTON COUNTY, TEXAS; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING A REPEALER CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of The Colony, Texas, is a Texas home-rule municipality; and WHEREAS, Section 311.001(a) of the Texas Transportation Code generally provides that a home-rule municipality has exclusive control over and under the public highways, streets, and alleys of the municipality; and WHEREAS, Section 311.001(b)(2) of the Texas Transportation Code provides the authority for a home-rule municipality to open a public alley within the municipality; and WHEREAS, on or about January 7, 1991, the City Council of the City of The Colony, Texas, approved Ordinance No. 675, a copy of which is attached hereto as Exhibit B, which vacated and abandoned the fifteen foot (15’) wide alley right-of-way consisting of an approximately 0.042 acre tract of land in the S.E. Hayes Survey, Abstract No. 648, and being a portion of the Colony No. 31 Addition, an addition to the City of The Colony, Denton County, Texas, as described and depicted in Exhibit A, which is attached hereto and is incorporated herein for all purposes (hereinafter referred to as the “Alley Right-of-Way”); and WHEREAS, the Alley Right-of-Way remains the property of the City of The Colony, Texas, and has never been conveyed to the abutting property owners; and WHEREAS, the City Council of the City of The Colony, Texas, finds and determines it is in the public interest of the City to reestablish the Alley Right-of-Way as a public alleyway within the City of The Colony, Texas. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS:

SECTION 1. That the legislative findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2. That the City Council of the City of The Colony, Texas, does hereby repeal in its entirety Ordinance No. 675, approved by the City Council on January 7, 1991, and a copy of which is attached hereto as Exhibit B of this Ordinance. SECTION 3. That the City Council of the City of The Colony, Texas, does hereby establish the Alley Right-of-Way, as described and depicted in Exhibit A, which is attached hereto and is incorporated herein for all purposes, as a public alley within the City of The Colony, Denton County, Texas. SECTION 4. That the City Secretary and City staff is directed to file a certified copy of this Ordinance in the Deed Records of Denton County, Texas. SECTION 5. That if any section, article paragraph, sentence, clause, phrase or word in this Ordinance, or application thereto any persons or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this Ordinance; and the City Council hereby declares it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. SECTION 6. That all provisions of the Ordinances of the City of The Colony, Texas, in conflict with the provisions of this Ordinance be, and the same are hereby amended, repealed, and all other provisions of the ordinances of the City not in conflict with the provisions of this Ordinance shall remain in full force and effect. SECTION 7. That this Ordinance shall become effective from and after its date of passage in accordance with law.
