Complete this form and return via email to [email protected] with the $563 non-refundable booking fee payment. You are advised to get your application in ASAP as there are a limited number of marquees on offer. Once they sell out Council will no longer accept applications. See ‘Payment Details’ below for instructions on how to submit payment. NOTE: If all the marquees are sold out when we receive your application we will advise you immediately and not charge you any fees. Terms & Conditions of Marquee Hire Bondi Beach Marquee Program on Sunday 9 August 2015, is subject to the below terms & conditions: 1. An area of sand no greater than the size of the marquee can be used ocean side of the marquee. 2. Company tear drop banners may be placed in the sand in front of your marquee (ocean side) to demarcate your area. No other third party advertising such as alcohol branding is permitted outside of the marquee/s. 3. Food and drinks must be served in reusable, recyclable or biodegradable packaging, this includes but is not limited to: eating utensils, plates, cups, serviettes, stirrers. 4. Polystyrene products are strictly prohibited unless to transport food. 5. All polystyrene containers must be taken with you off site and not disposed of in the bins provided. 6. The sale of any items including food and beverage is strictly prohibited. 7. When serving alcohol, Responsible Service of Alcohol regulations must be complied with at all times. 8. Glass is not permitted outside of the marquee. 9. No charcoal cooking is permitted. 10. No smoking is permitted on the beach or inside the marquee. 11. For every cooking facility there must be a suitable fire extinguisher at hand. e.g. if you have 2 x BBQ’s you must have at least one suitable fire extinguisher per BBQ. 12. The marquee/s and surrounding area must be left empty, clean and tidy. All rubbish must be removed and disposed of correctly in the bins provided. 13. Marquees must be vacated by 3pm. 14. Noise including audio devices must be contained within the marquee area and must not negatively impact on other marquee hirers or the public. 15. No balloons are permitted. 16. Council’s waste minimisation strategy must be complied with at all times. All rubbish must be kept separate and disposed of into the correct bin (cardboard/paper, glass/ plastic, organic material and general waste). 17. If the marquee structure is

damaged in anyway due to the fault of the hirer, or one of its partners, employees, agents, contractors or invitees, the hirer will be invoiced and must pay for all damages. 18. At least 2 weeks prior to event day, you must submit a copy of a current public liability insurance policy for no less than $10million noting Waverley Council as an interested party. Damage and cleaning dEpOSIT CONdITIONS ■■The hirer’s representative must meet with Council’s representative to inspect the marquee after all patrons have vacated on event day to confirm the marquee has been left clean, tidy and free of damage. ■■If Council is satisfied that there has not been any breach of these terms and conditions, your $512 deposit will be refunded by cheque within 28 days after the day of the event. ■■If the marquee has not been left clean and damage free condition then Council will retain the $512 deposit. CANCELLATION OF THE EVENT 1. Council can terminate this agreement in its absolute discretion by notice to your representative at anytime prior to the event. The City2Surf event itself may also cancelled by the event organisers at any time in which case this agreement is immediately terminated. Council will not be liable to you for any loss or expenses arising out of this agreement or its termination or cancellation of the event. 2. If the event is cancelled or this agreement is terminated prior to 7am on the Tuesday prior to the event, Council will refund to the hirer the $512 deposit and the total hire fee (but will retain the non-refundable booking fee). 3. If the event is cancelled or this agreement is terminated between 7am Tuesday and 7am Wednesday in the week prior to the event, Council will refund to the hirer a sum equal to 75% of the $512 deposit and the total hire fee (but will retain the non-refundable booking fee). 4. If the event is cancelled or this agreement is terminated between

7am Wednesday and 7am Thursday in the week prior to the event, Council will refund to the hirer a sum equal to 50% the $512 deposit and the total hire fee (but will retain the non-refundable booking fee). 5. If the event is cancelled or this agreement is terminated between 7am Thursday and 7am Friday in the week prior to the event, Council will refund to the hirer a sum equal to 30% of the $512 deposit and the total hire fee (but will retain the nonrefundable booking fee). 6. If the event is cancelled or this agreement is terminated at any time after 7am on Saturday prior to the event, Council will refund the $512 deposit but will retain the total hire fee (and the non-refundable booking fee). INDEMNITY AND RELEASE The hirer releases Council from, and indemnifies Council in respect of, any liability for personal injury, death and/or property damage arising directly from the hire and use of the marquee and/or by the hirer, or its partners, employees, agents, contractors or invitees except where any such injury, death or property damage arises from the acts or omissions of the Council or its employees, agents or contractors.
