Authorizing Budget Transfer Dredging

Bar Harbor North Maintenance

The motion detailed ·below was prepared at the request of Port & Harbors Director Steve Corporon, who asked that it be placed before the City Council for consideration at its meeting of September 7, 2017. If adopted, the motion provides for authorizing a budget transfer of $46,500 from Appropriated Reserves of the Small Boat Harbor Fund to the Harbor Department's Bar Harbor North Maintenance Dredging capital account. The rationale for the transfer is detailed in Mr. Corporon's transmittal memorandum and requires no explanation on the part of my office. I concur with the Port & Harbors Director's recommendation . Mr. Corporon will be attending the City Council meeting of September 7, 2017, in order to address any questions and/or concerns that Councilmembers may have. A motion has been prepared for City Council consideration.

RECOMMENDATION It is recommended that the City Council adopt the motion authorizing the City Manager to transfer $46,500 from Appropriated Reserves of the Small Boat Harbor Fund to the Harbor Department's 2017 Bar Harbor North Maintenance Dredging capital account to fund dredging near the intersection of Float Nos. 17 and 16 and adjacent to the launch ramp where the large storm water outfall is located.

Bar Harbor North Maintenance Dredging

Maintenance dredging in two locations in Bar Harbor North has historically been performed every 8 to 10 years in order to remove sand and gravel sediment that is gradually deposited at the mouth of Hoadley Creek near the intersection of floats 17 and 16 and adjacent to the launch ramp where a large storm water outfall is located. Maintenance dredging was most recently performed in both of these locations by Pool Engineering in early 2016 when 1,068 cubic yards of material was removed at a cost of $98,644. Although maintenance dredging wa~ not expected to be necessary again for several years, the extraordinary rainfall event of Aug 20-21 deposited large amounts of sand and gravel in both locations (see areas .outlined in red on attached aerial photos). These deposits have made it difficult for vessels to maneuver in and out of their stalls on lower tides and impossible on minus tides. This is esp~cially critical for the stalls adjacent to the launch ramp which are where the Port and Harbors vessels moor. While not an emergency, having this material removed on the minus tides in later September before the fall and winter rains cause it to spread out under the floats will result in a significant savings in future dredging efforts and costs. The amount of material to be dredged is estimated to be no more than 450 CY. Pool Engineering has submitted a proposal for dredging and disposing of this material during the minus tides of the week of September 17. Their proposed cost includes a mobilization of $6,000 and $90/CY. (see attached proposal). With an estimate of 450 CY to be removed the estimated maximum cost is $46,500. Since these services would be provided by a local contractor for an amount that does not exceed $50,000, in accordance with subparagraph (13) of Section 3.12.050 (a) of the Ketchikan Municipal Code, competitive bidding, quotations, or the prior approval of the City Council is not required ; however, since this project is not currently included in the 2017 Harbor capital budget, approval by the City Council of a budget transfer from the Harbors reserve account will be required. Recommended motion: I move the City Council authorize a budget transfer of $46,500 from the Harbors reserve account to the Harbors Bar Harbor North maintenance dredging capital account.

When it is advantageous to the city to enter into a contract with a person, firm or

corporation for the same supplies or services under substantially the same terms as such person, firm or corporation is providing another municipal or state government, or the United States , where such supplies or services are being provided the other government unit on the basis of forma l bids, price quotations or other competitive proposal procedure or pursuant to a contract with or through such other government unit so that the benefit of the price quotation or other competitive proposal accrues to the city; (10)

When competitive bidding has been followed, but only one or no bids or

quotations are received, or the bids or quotations are rejected. In such a case, after council approval, the manager may proceed to have the supplies, materials, or equipment purchased , the services performed or the public improvements constructed without further competitive bidding or quotation; (11 )

The purchase of used vehicles or equipment when such purchase has been

determined by the manager to be in the best interest of the city; ( 12)

The purchase of wireress phone services, wireless phones, devices and related

accessories, when and .under such terms and conditions as the council, in its sole .I '

judgment, deems advantageous to the city; ( 13)

Purchases of supplies', materials, equipment or contradua1 services from a focal

business the cost of which does not exceed $50,000 in a singte transaction unless otherwise prohibited by state or federal law or the terms of any funding grant. For purposes of this subsection, a focal business is a business which at the time of the purchase is a business with a place of business within the Ketchikan Gateway Borough that holds a valid Afaska business Hcense and is registered with the Ketchikan Gateway Borough to file sales tax reports; (14)

Notwithstanding any provision in this chapter, the council may also exempt any

particular purchase from competitive bidding or other requirements by a nonemergency ordinance adopted pursuant to and as provided for in Sections 5-16 and 5-17 of the City Charter.
