PART 1 - INTRODUCTION NAME OF THE PLAN • This contributions plan has been prepared in accordance with the provisions of Section 94 of the Environmental Planning and Assessment (EPA) Act 1979 and may be referred to as the Woolgoolga Town Centre Car Parking Developer Contributions Plan 2004.

FORMULA FOR DETERMINING CONTRIBUTIONS The formula to be used for the calculation of contributions under Section 94 of the EPA Act is as set out below. Contribution = N x R Where:

PURPOSE OF THE PLAN The purpose of this plan is to enable Council to require a contribution towards the provision of car parking in the Woolgoolga Town Centre.

AREA TO WHICH THE PLAN APPLIES The plan applies to all land within the Woolgoolga Town Centre under Coffs Harbour City Local Environmental Plan 2000 as shown in Map 1.

DEFERRED OR PERIODIC PAYMENTS

INDEXING OF CONTRIBUTION RATES

Where the applicant can demonstrate that the settlement of the contribution, in terms of the above, is unreasonable in the circumstances of the case, the Council may accept deferred or periodic settlement. In such a case, the applicant needs to make a written request and satisfy Council in accordance with the following:

Council will review the contribution rates to ensure that the monetary contributions reflect the costs associated with the provision of the car parking.



there are valid reasons for deferred or periodic payment;



no prejudice will be caused to the community deriving benefits from the car parking facilities required by the proposed development;

 

no prejudice will be caused to the operation of this plan; the provision of the car parking facility in accordance with the adopted works schedule will not be adversely affected.

Applications for deferment of payments will be subject to the following conditions: 

The deferment will be for a fixed period not exceeding six months from the date the contribution becomes due;



The applicant must agree to pay the Council interest on contributions or on so much thereof as shall remain outstanding from time to time computed from the date that the contribution becomes due at the appropriate rate of interest;



Payment of the contributions and the interest must be secured by delivery to the Council of a guarantee in writing issued by an appropriate institution.



Deferments will not be granted based on progressive land sales.

The contribution rates will be reviewed on the basis of the relevant index published by the Australian Bureau of Statistics as the Australian National Accounts income and expenditure in accordance with the following formula: RC = C x Where:

“RC” is the Revised Contribution “New index” is the index listed in Table 1 being relevant to car parking at the time of review

“C” is the previous contribution rate “Previous Index” is the index listed in Table 1 relevant to car parking at the time of calculation of the contribution rate. The Council may also review the works schedule, the estimate of costs of the car parking facilities, floorspace projections, land acquisition costs or other aspects relating to the contribution plan. “appropriate rate of interest” means the seven year local government interest borrowing rate applicable from time to time, and “appropriate institution” means a licensed bank or other institution where securities comprise authorised investments under the Trustee Act 1912.

PART 2 – STRATEGY PLANS CAUSAL NEXUS The anticipated increase in commercial and retail development within the Town Centre will place a greater demand on existing car parking areas. This will require the provision of additional public car parking facilities in the Town Centre. Existing public parking within the Town Centre can be categorised into one of the two following categories: 

on-street parking;



off-street parking.

Demand Commercial and retail development generates a demand for car parking to facilitate operation of their activities. This contributions plan aims to provide funding for convenient public car parking spaces within the Town Centre. The demand for parking space can be estimated using the parking demand standards for retail and commercial development provided in the Coffs Harbour City Council Car Parking Development Control Plan. This plan estimates a demand of one space per 23m2 of retail floor space and one space per 40m2 of commercial floor space. Based on the floor space projections to the year 2021, the total demand for parking in the Town Centre is expected to require the provision of 600 car parking spaces. A proportion of the demand for car parking generated as a result of increased development will need to be provided on-site. However, Council will accept a contribution from the developer in lieu of on-site car parking spaces where the provision for onsite parking will adversely affect the viability and/or integrity of the proposed development and conflict with the intentions of the Woolgoolga Town Centre Masterplan. Each proposal will be assessed on its merit.

PHYSICAL NEXUS This plan identifies the location of existing and proposed car parking facilities within the Woolgoolga Town Centre based on the Woolgoolga Town Centre Study (refer Map 2). The majority of parking consists of onstreet parking. This study has been the basis for calculating the supply of car parking spaces within the Woolgoolga Town Centre.

TEMPORAL NEXUS Car parking facilities required as a consequence of anticipated development up to the year 2021 are included in the works schedule. Timing for the provision of these works is based on the commercial/retail floorspace development which will require an additional 135 spaces.

The car parking strategy currently adopted for the Woolgoolga Town Centre is for the provision of one off-street public parking site. This proposed car parking area is zoned Special Uses (Car Park) under Coffs Harbour City Local Environmental Plan 2000 and can accommodate 80 car parking spaces. The location of these sites is shown in Map 2. The Coffs Harbour City Off-Street Car Parking Development Control Plan requires the provision on parking spaces on development sites to meet the full demand, generated by each development. Where this parking space cannot be provided on-site Council will accept a contribution for car parking. This contribution is put towards the parking site shown in Map 2 and forms part of Council’s Contributions Plan. The Contributions Plan provides the following Schedule of Works. Long-term options for additional and improving car parking opportunities in the Town Centre are to set aside short-term shopper parking in west Market Street, longterm employee parking in the eastern section of Market Street, and modify the angle of onstreet parking to nose-in parking in the majority of the streets in the Town Centre to provide safer and more efficient parking.

COST OF WORKS The total cost of works for the Market Street parking site is the construction of the facility itself. This will include the following works:      

excavation of subgrade; gravel pavement surfacing; drainage works; bitumen surfacing; linemarking and signage; and treatment of entrance from Market Street.

Therefore, the contribution rate can be calculated as follows:

Note: The year of completion is indicative only with works to be scheduled according to demand.

Based on the floor space projections to the year 2021 discussed previously, the total demand for parking in the Town Centre is expected to require the provision for 600 car parking spaces, this represents an additional 135 spaces. Given that a percentage of this parking demand will be met by on-site provision, demand can be satisfied by the abovementioned car parking site and through the utilization of the road reservations of Queen and Market Streets to provide the additional 55 spaces.

Hence, the contribution rate = $5,342.80 per parking space. Notes:  The above contribution rate may need to be reviewed in line with any changes in the cost of works, demand and development activity  A planning levy of 2.5% is included to cover plan preparation and administration costs.
