Considerations and Checklist for Development 1. There are wetlands all over the state. To be assured that the proposed project does not impact wetlands, contact the US Army Corps of Engineers to have undeveloped land slated for development evaluated for the presence of wetlands. http://www.saw.usace.army.mil/Missions/RegulatoryPermitProgram/Contact/CountyLocator.aspx There also may be isolated wetlands that are regulated by the State. Please refer to question #10 below for program staff contact information. 2. Contact the Natural Heritage Program http://portal.ncdenr.org/web/nhp/request-information to determine if the site area has endangered species. Additionally, you should consult the U.S. Fish and Wildlife’s endangered species database at http://www.fws.gov/endangered/. Please note that the listing of the Northern long-eared bat may affect your landclearing activities, visit the USFWS website for guidance: http://www.fws.gov/midwest/endangered/mammals/nleb/Interim4dRuleKeyNLEB.html 4. For proposed projects on currently developed sites, contact the Division of Waste Management UST section to determine if underground storage tanks are present: http://portal.ncdenr.org/web/wm/ust/cab. 5. For land disturbance of greater than 1 acre, you will need an approved Erosion and Sediment Control Plan (E/S) and a NPDES Construction Stormwater permit from the Division of Energy, Mineral and Land Resources - Land Quality Section. http://portal.ncdenr.org/web/lr/erosion. Please note: The North Carolina Sedimentation Control Commission may delegate authority to implement the Sedimentation Pollution Control Act to cities and counties that adopt a qualifying local erosion and sediment control ordinance in compliance with State requirements. These requirements may be more stringent and thus require permits for land disturbances less than 1 acre. If development is to occur on a barrier island, adjacent to a water body, coastal marsh, in or over the water, or along the ocean front, a Coastal Area Management Act (CAMA) permit may be required within the coastal counties. http://portal.ncdenr.org/web/cm/permits 7. Any development that is located in a coastal county and requires a soil erosion and sedimentation control plan or a Coastal Area Management Act (CAMA) permit http://portal.ncdenr.org/web/cm/permits may need to obtain a state coastal stormwater permit. http://portal.ncdenr.org/web/lr/coastal-stormwater (Coastal Counties: Beaufort, Bertie, Brunswick, Camden, Carteret, Chowan, Craven, Currituck, Dare, Gates, Hertford, Hyde, New Hanover, Onslow, Pamlico, Pasquotank, Pender, Perquimans, Tyrrell, Washington) 8. To determine whether development activities are subject to NPDES post-construction stormwater requirements or other stormwater permitting requirements, please consult the Stormwater Permitting Interactive Map: http://portal.ncdenr.org/web/lr/sw-permitting-map. 10. Any construction activity along the Goose Creek Watershed, Jordan Lake Water Supply Watershed, Randlemen Lake Water Supply Watershed, Catawba River, Neuse River and Tar-Pamlico River basins will need to comply with the 50’ buffer and may need wetlands delineation from the U.S. Army Corp of Engineers and/or stream determinations, buffer variances, and stormwater management approvals from the Division of Water Resources, Wetlands Branch, 401 and Buffer Permitting Unit. http://portal.ncdenr.org/web/wq/swp/ws/401/riparianbuffers 11. Development adjacent to waters that have been classified as trout waters should have an undisturbed buffer zone 25-feet wide. There is an allowable amount of encroachment within the buffer zone but, it must have special approval. Also, Trout moratoriums on construction activities, established by the NC Wildlife Resources Commission, may apply to your project if working within designated trout waters or the 25’ trout buffer zone. Exemptions to this condition may require written approval by the resource agency: http://www.ncwildlife.org/contacts.aspx. 12. If demolition will occur, please note the following: The Health Hazards Control Unit (HHCU) of the N.C. Department of Health and Human Services, must be notified of plans to demolish a building, including residences for commercial or industrial expansion, even if no asbestos is present in the building. Obtaining a demolition permit from the local city or county building inspections department does not meet the notification requirements of the state. Considerations and Checklist for Development 13. Development near streams classified as a water supply source may be subject to local land-use restrictions. Non-contact cooling water and boiler blow-down discharges need to have permits, which are issued by DWR, Wastewater Branch. http://portal.ncdenr.org/web/wq/swp/ps/npdes/generalpermits 15. For wastewater collection and disposal you may need a permit from the Division of Water Resources (Water Quality Permitting Section, Wastewater Branch for direct discharge to surface waters http://portal.ncdenr.org/web/wq/swp/ps/npdes or Non-Discharge Permitting Unit for spray irrigation or residual applications: http://portal.ncdenr.org/web/wq/aps/lau. 16. If county water and sewer is available, contact the County or City Public Works Department for permitting requirements. Contact the city/county planner and local governing authorities where the development is proposed to verify if there are any rules or requirements (e.g. for private drinking water wells, zoning, ordinances for development, Fire Marshal, etc.). Other important items for consideration:  SEPA (State Environmental Policy Act: http://portal.ncdenr.org/web/deao/sepa  Surface Water Classifications Map (please note: certain stream classifications can dictate more stringent permitting requirements).
