Contract Administration & Contract Law This program covers the administration of local government contracts and the basic elements of Contract Law. Administration of contracts applies to contracts being carried out by internal or external providers and the program will look at the process from the selection of the contractor through to practical completion. The basic elements of Contract Law, including some features and changes in standard form contracts will also be provided. Current requirements and foreshadowed developments for NSW public sector contracting will be covered with particular reference to local government. OBJECTIVES To provide participants with: • An overview of the form of a Contract • An understanding of Standard form Contracts • An understanding of risk sharing as affected by the form of Contract • An awareness of Latent and other Conditions • An overview of the duties and discretions of the Superintendent • Information on the documentation that is used during the Contract • An understanding of contract terms and contract documents • An awareness of some features and changes in standard form contracts • Case studies showing ‘what can go right’ and ‘what can go wrong’ from local government and other public sector sources OUTCOMES

Upon completion of the program, it is expected that participants will be able to: • understand the legal obligations of the contract process and relationship • be able to professionally administer various forms of contract • understand the contract process before, during and at the conclusion of the contract • be able to negotiate with the contractor during the contract • have a working knowledge of current and foreshadowed NSW government guidelines and codes of practice for contracting out and capital procurement.

Contract Administration & Contract Law Tom Anderson Associate Professor, Faculty of Engineering, University of Technology, Sydney.

Tom is Associate Dean, International and Enterprise Development at UTS: Engineering. As Associate Dean Tom has introduced the Master of Engineering Management in China, Taiwan and Singapore. He has led the development and introduction of offshore undergraduate BEngSc and BE degrees in Hong Kong. Tom has received a number of awards for teaching excellence including in 1999 the Australian National Award for University Teaching. Prior to his academic appointment Tom was employed for 17 years as a design engineer, project manager and contract administrator. He was directly responsible for the supervision of the contract for the Twin Bridges over Mooney Mooney Creek. At their time of construction these bridges were the second longest cantilever box girders in the world.

SUGGESTED PARTICIPANTS The program has been designed for local government practitioners, including engineering, finance, administration and any other managers who are involved in the decision making process regarding the use of contracts and competitive tendering in their organisation. Design or construction staff working in the field or office will benefit from this program.
