WATER PROBLEMS PROGRAM

The City has started a special reporting and monitoring system in an attempt to gather data that will help us try and pinpoint the exact cause and location of problems within our water distribution system. The two main problems that have been identified to date are 1) being below standard levels of pH and 2) chlorine residuals. We are trying to determine the cause for these two problems which could be non-toxic bacteria growth or improper crossconnection from a private well system. Contributing factors also include reduction of water consumption in specific portions of the system, inadequate turn-over of water, numerous dead-end lines, and a system well beyond its anticipated life expectancy. In efforts to accumulate all the data possible, we urge all citizens/consumers that are experiencing quality of water issues (discoloration, odor, taste) to report the issues directly to City Hall for recording purposes. • Motion carried to approve check journal 2011 1A in the amount of $29,979.32. • Motion carried to approve Option 2-PPK POS CDHP-HCR 1187 8/10 as the city’s health plan for 2011 – further to provide an additional $50.00 per month toward the employee’s share of the health insurance on a one time basis. • Motion carried to authorize the purchase of a spare pump for the northeast lift station from Enviro-Line Company in the amount of $1,510.32. • The council determined that they would discuss the annual extended service warranty contract with Microcomm for the telemetry system used at the water tower at their next meeting. • Motion carried to convene into the Peabody Development Corporation. • Motion carried to go into executive session at 7:35 p.m. for 15 minutes for the purpose of preliminary discussions relating to the acquisition of real property and also invited Mac Manning and Shane Marler. • The governing body came out of executive session at 7:50 p.m. There was no action taken, no motions made. • Motion carried to reconvene back into regular council meeting. • Shame Marler presented the 2010 Peabody Main Street Annual Report. Marler informed the council that the Marion County commission had vetoed the proposed TIF District in the Historic District of Peabody. • Manning reported that the Kansas Department of Labor made an inspection on December 22, 2010 of all the city’s facilities and departments. There were several electrical problems in city hall and they have been corrected. The city must report back to the Dept of Labor by March 4, 2011.

Manning stated that a letter had been sent. • Mayor Larsen reported that the railing has been installed to the stair and around the mezzanine at the public works building.

Meeting adjourned at 8:16 p.m. January 31, 2011 Regular Meeting • Motion carried to approve check journal 2011 1B in the amount of $36,122.68. • Randy Dallke was quite disturbed about the idea of the City trying to sell the th 1996 fire pumper to the 4 Fire Protection District. • Motion carried to convene into the Peabody Development Corporation. • Motion carried to enter into executive session at 7:09 for 20 minutes for the purpose of preliminary discussions relating to the acquisition of real property and also invited Mac Manning and Shane Marler • The governing body came out of executive session at 7:29 p.m. • Motion carried to authorize the president and secretary to sign a letter of intent to purchase the real estate located at 115, 117, 121, 123 an 125 N. Walnut from Brock and Sheryl Baker for the purchase price of $100,000.00. • Motion carried to reconvene back into the regular council meeting at 7:45 p.m. • Motion carried to authorize the designation of the Floral Exhibition Hall / Roundhouse, located at the city park as an historical site. Further to direct the Peabody Historical Society to make application to register the site on the National Historical Register. • Motion carried not to renew the annual extended service warranty contract with Microcomm. • Manning advised the council that the city had received a letter from Marion County concerning the Redevelopment District TIF in the Peabody Historic District advising the city that the county had voted in Resolution No 006-101 to protest the proposed Redevelopment District TIF in the Peabody Historic District. Manning also received Resolution 2011-01-10 from USD 398 which opposed the proposed Tax Increment Financing District for the City of Peabody. • Motion carried that the council gives its full support and appreciation for the work on the Baker property and the attempt to establish a TIF District by Shane Marler. • Motion carried to approve Resolution No 001-2011: Resolution of Support for Public Housing Development. • Motion carried to approve a letter of commitment by the Commerce Bank, St. Louis, MO for the acquisition of Kansas Historic Rehabilitation Tax Credits for the Baker Lofts project. • Motion carried to approve a letter of Admission to Entity as Historic Participant and Acquisition of Kansas Historic Rehabilitation Tax Credits with the Historic Preservation Partners, Topeka, Kansas. • Motion carried to approve an Agreement for Development Service between Davis Preservation, LLC Topeka, Kansas and the City of Peabody. • Motion carried to approve payment of invoice for Housing Study for the City of Peabody in the amount of $4,029.00. • Motion carried to authorize the purchase of Jayhawk Court Software in the amount of $3,590.00. Funding to come from Police Diversion Fund $1,000.00 and $2,590.00 from the General Fund. • Motion carried to approve Chief Burke attending the Background Investigation for Public Safety Positions and Conducting Deducting Death and Homicide Investigations training seminars. • Motion carried to authorize Chief Burke to determine what training is required for the Police Department based on availability in his budget without bringing it to the council for approval.

MARCH 2011 January 31, 2011 (Cont.) • Motion carried to go into executive session at 8:19 p.m. for 20 minutes for the purpose of discussing non elected personnel and invited Mac Manning and Chief Burke to attend the session. • The governing body came out of executive session at 8:39 p.m. • Motion carried to accept the resignation of Cindy Harms as Municipal Court Clerk effective March 1, 2011. • Motion carried to accept the resignation of Police Officer Brad Cady effective February 28, 2011. • Darren Pickens received a quote from JCI, Lee’s Summit, MO on remote dialers for the two small lift stations - installing and start up services was $4,894.80. This was sent to the finance committee for further review. • Pickens reported that crews have had to pump the lift station at Olive Street about three times a week for the past month. Where the pipe goes into the ground is where it is freezing up and stopping the flow. Pickens obtained a bid from Middlecreek Corporation to relocate this line at a cost of $8,200. This was sent to the finance committee. • Administrator Manning reviewed his report with the council. • The latest the city can file a proposition for the April general election was on or before February 15, 2011 regarding a liquor store. It would require a petition to be circulated and getting 30% of the people who cast a vote in the last general election for the office of Secretary of State for the State of Kansas. • Jim Rippe, Chairman of the Peabody Planning Commission updated the council on the planning commissions’ progress in updating the Peabody Zoning Ordinance. The commission is planning on having a public hearing on the new zoning ordinance on Monday March 21, 2011 at 7:00 p.m. • Rose reporting for Fire Committee addressed the attempt to sell the city fire truck th to the 4 Fire District. He stated he had limited discussions with the assistant chefs and fire chief. The whole thing had gotten out of hand and it was a dead issue now. • Mayor Larsen thanked the council for the effort and support on the city buying the Baker buildings in the downtown area. This should be the spark toward improvement of the whole area.

This is a monthly column in the “City Newsletter” by Mac D. Manning, City Administrator/Clerk for the City of Peabody. The purpose of this column is to give the straight facts about the street talk and gossip concerning things that are happening in the City. Notice is hereby given to all interested parties that the Peabody Planning Commission will hold a public hearing on proposed amendments to the Zoning Regulations and Zoning Map for the City of Peabody on Monday, March 21, 2011, at 7:00 p.m., in the cafeteria of the Peabody – Burns Jr./ Sr., High School, 810 N Sycamore, Peabody, Kansas. The amendments address the proposed general updating of the City of Peabody Zoning Regulations and Zoning Map. Other topics on the same general subject may be considered by the Peabody Planning Commission for amendment to the City of Peabody Zoning Regulations at this public hearing and included within any recommendations regarding the same to the Mayor and City Council of the City of Peabody. Any person wishing to be heard regarding this matter may submit written comments to the Peabody Planning Commission prior to or at the public hearing, or may present written and/or oral comments at such public hearing. All persons wishing to be heard concerning this matter shall be afforded an opportunity to do so. Upon conclusion of said public hearing, the Peabody Planning Commission may make recommendations concerning the adoption of the proposed amendments to the Zoning Regulations and Zoning Map to the Mayor and City Council of the City of Peabody. The Peabody Planning Commission may continue consideration of this matter at the conclusion of the public hearing to a future date without further notice.

A copy of the proposed amendments to the Peabody Zoning Regulations and Zoning Map are available for inspection in the offices of the Peabody Zoning Administrator, 300 N. Walnut, Peabody, Kansas, and the Peabody Township Library, 218 N. Walnut, Monday through Friday during normal business hours.

Completed applications must be received no later than March 31, 2011 Applications received after that date will be denied, regardless of postmark date.
