ARTICLE I NAME This organization shall be known as Des Plaines Youth Baseball, here in after referred to as “DPYB.”
ARTICLE II OBJECTIVE Section 1 The objective of Des Plaines Youth Baseball shall be to foster firmly in the children of the community the ideals of good sportsmanship, honesty, loyalty, courage and respect for authority so that they may be well adjusted, stronger and happier children and will grow to be good, decent, healthy and trustworthy citizens. Section 2 To achieve this objective, DPYB will provide a supervised youth baseball program. All Directors, Officers and Members shall bear in mind that the attainment of exceptional athletic skill or the winning of games is secondary and that the molding of future citizens is of prime importance. It shall always be recognized that the game belongs to the children and the only concern to the adults is “Was it a good game?” Section 3 In accordance with Section 501(c)(3) of the Federal Internal Revenue Code, Des Plaines Youth Baseball shall operate exclusively as a notforprofit educational organization providing a supervised baseball program. No part of the net earnings shall inure to the benefit of any private shareholder or individual; no substantial part of the activities of which is carrying on propaganda, or otherwise attempting to influence legislation, and which does not participate in or intervene in any political campaign on behalf of any candidate for public office.
ARTICLE III MEMBERSHIP Section 1 Eligibility Any person interested in active participation in Des Plaines Youth Baseball may apply to become a member. Section 2 Classes There shall be the following classes of Members: A. Player Members. DPYB will accept any eligible player to compete regardless of residential location, but shall have no rights, duties or obligations in the management or in the property of DES PLAINES YOUTH BASEBALL. B. Regular Members. Only regular members in good standings, which include (All Officers, Board Members, Committee Members, Managers, Volunteer Umpires and other elected or appointed officials) are eligible to vote at the General Election Meeting. The Secretary shall maintain the roll of membership to qualify voting members. Any person actively interested in furthering the objectives of Des Plaines Youth Baseball may become a regular member upon election. C. Board of Directors. The Board of Directors shall consist of the following positions; President, VicePresident, Treasurer, Secretary, Major (Pony 13/14 age), AAA (11/12), AA (9/10), A (7/8) & Stars of Tomorrow (5/6) Coordinators. All positions are voting positions. In the case of shared positions, only one person may serve on the board and will be the voting member. Section 3 Suspension or Termination Resignation or action of the Board may terminate membership. A. The Board, by a majority vote, shall have the authority to discipline, suspend, or terminate the membership of any Member of any class when the conduct of such person is considered detrimental to the best interests of DPYB. The Member involved shall be notified of such meeting, informed of the general nature of the complaint, and be given an opportunity to appear at the meeting to answer such complaint. B. The Board shall, in case of a Player Member, give notice to the manager of the team of which the player is a member and to the parent(s) or legal guardian(s). Said manager shall appear, in the capacity of an advisor, before the Board, which shall have full power and authority to suspend or revoke such player’s right to future participation. The player member’s parent(s) or legal guardian(s) must be notified about the
disciplinary meeting and invited to be present. C. The Board reserves the right to remove a suspended player from the allstar eligibility list.
ARTICLE IV – FEES Fees for Regular members shall be fixed at amounts determined by the Board prior to the registration date. A reasonable participation fee will be assessed as a parent(s) or legal guardian(s) obligation to assure the operational continuity of Des Plaines Youth Baseball. At no time should payment of any fee be a prerequisite for participation in the baseball program. Should any parent(s) or legal guardian(s) of Player Member(s) be unable to pay the assessed fee, the Board may consider and approve alternatives. Members who fail to pay their fixed fees prior to a given season’s last evaluation date may, by a vote of the Board, be dropped from the rolls and shall forfeit all rights and privileges of membership. There will be no refunds of fees after draft day.
ARTICLE V MEETINGS All meetings will be governed by Roberts Rules of Order. Section 1 Annual Meeting The Annual Meeting of the Members of Des Plaines Youth Baseball shall be held prior to October 1 of each year for the purpose of electing the Board of Directors, receiving any outstanding final reports, and for the transaction of business as may properly come before the general meeting. Section 2 Notice of Board Meetings Notice of each meeting of the Board shall be mailed (emailed) or otherwise delivered to each Board Member at least 48 hours in advance stating the place, time, purpose and agenda of the meeting. Section 3 General Board Meetings (open to the public) Board meetings are open for parents/guardians to attend. The date, time and place are to be posted on the DPYB website. Section 4 Board Meetings The closed Board Meeting,is to follow the General Board meeting. Section 5 Special Meetings Special meetings may be called as deemed necessary by the President or by a majority of the Board, lacking a call by the President, subject to giving fortyeight (48) hours notice of the meeting and place.
ARTICLE VI BOARD OF DIRECTORS Section 1 Authority The management of the property and affairs of Des Plaines Youth Baseball shall be vested in the Board of Directors. Section 2 Annual Election and Term of Office Election of the Board of Directors and coordinators shall be by a majority vote of all members present or represented by a properly executed and signed absentee ballot filed with the Secretary prior to the General Meeting. The term of office is one year with a maximum service of three years in any board position. Exceptions may be voted by 3/4ths vote of the members present at the general meeting. The office of President will be required to be filled by a person who has served on the board of directors in the previous year. Section 3 Vacancies If any vacancy occurs in the Board of Directors, by death, resignation or otherwise, it may be filled by a vote of the remaining Board of Directors at any regular meeting or at any special meeting called for that purpose. Section 4 Duties and Powers A. The Board shall have the power to appoint such standing committees, as it shall deem appropriate and to delegate such powers to them as the Board shall deem advisable and which is properly delegated. B. The Board shall have the sole authority to approve all team managers and coaches, pending background checks. C. The Board may adopt such rules and regulations for the conduct of its meetings and the management of DPYB, as it may deem proper. D. The Board shall have the sole responsibility for the determination of awards, but may appoint individuals to assist in the processes necessary for determining the award recipient.
ARTICLE VII MANAGERS, COACHES AND UMPIRES Section 1 Team Managers and Coaches The Board shall approve all team managers by majority vote. Managers shall be responsible for the selection of their teams and coaches and for their actions on the field. Managers shall appoint their own team coaches (maximum of two (2)), subject to approval by the Board. Section 2 Umpires Umpires shall be appointed annually by the Chief Umpire(s), who shall be responsible for their assignments and for their actions on the field. Section 3 Officers While holding such office, the President may coach or umpire, but may not be the manager of a team. While holding such office, the Player Agent(s) may coach or umpire, but may not be the manager of a team. While holding such office, the Chief of Umpires may coach or umpire, but may not be the manager of a team. Should any disputes or conflicts arise during a game due to a President, Player Agent, or Chief of Umpires coaching, they should remove themselves from the game. The team manager and second coach should continue the game. If the manager and second coach are unavailable another league office must take over the game.
ARTICLE VIII AFFILIATION Section 1 Charter Des Plaines Youth Baseball is not affiliated with the Little League organization. Section 2 Rules and Regulations The Official Playing Rules and Regulations as published by Little League Baseball, Incorporated, Williamsport, Pennsylvania, shall be binding on Des Plaines Youth Baseball,subject to agreements with other teams in interleague play. Section 3 Intra/Inter League Rules The Intra/Inter League Rules of Des Plaines Youth Baseball shall be adopted by the Board at a meeting to be held not less than one month prior to the first scheduled game of the season as exceptions with the Rules and Regulations of Little League Baseball, Incorporated.
ARTICLE IX – FINANCIAL AND ACCOUNTING Section 1 The Board shall decide all matters pertaining to the finances of Des Plaines Youth Baseball and it shall place all income in a common league treasury, directing the expenditure of same in such manner as will give no individual or team an advantage over those in competition with such individual or team. Section 2 The Board shall not permit the contribution of funds or property to individual teams but shall solicit funds for the common treasury of Des Plaines Youth Baseball in order to discourage favoritism among teams and to endeavor to equalize the benefits of DPYB. Section 3 The Board shall not permit the disbursement of Des Plaines Youth Baseball funds for purposes other than the conduct of DPYB activities. Section 4 No Officer, Board Member, or Regular Member, with the exception of umpires and summer concession stand workers, shall receive, directly or indirectly, any salary, compensation or emolument (other than trade professional) from Des Plaines Youth Baseball for services rendered as Officer, Board Member or Regular Member. Section 5 All monies received shall be deposited to the credit of Des Plaines Youth Baseball, and check or cash, upon presentation of receipt; the Treasurer shall make all disbursements. Those on the Des Plaines Youth Baseball approved signature list shall sign all checks. Section 6 The fiscal year of Des Plaines Youth Baseball shall begin on the first day of September and shall end on the last day of August. Section 7 Distribution of Property upon Dissolution. Upon dissolution of Des Plaines Youth Baseball and after all outstanding debts and claims have been satisfied, the Members shall direct the remaining property of Des Plaines Youth Baseball to another Federally Incorporated entity which maintains the same objectives as set forth herein, which are, or may, be entitled to exemption under Section 501 (c)(3) of the Internal Revenue Code or any future corresponding provision.
ARTICLE X—RULES RULE I – RULES AND REGULATIONS So that all will be equally informed, the game rules and regulations governing Little League Baseball must be made available. One copy will be available at all times in the Concession Stands. A copy will be given to all managers and officials of the League. A copy will be shared with any member upon request.
RULE II – LEAGUE BOUNDARIES Des Plaines Youth Baseball has no residency boundaries.
RULE III – DES PLAINES YOUTH BASEBALL TEAMS A. Des Plaines Youth Baseball consists of five (5) divisions: Stars of Tomorrow, A, AA, AAA, and Major Each team is permitted to have one Manager and two Coaches. The number of teams in each division shall be determined by the Board prior to player draft. B. No unauthorized adult or child shall be permitted in the dugout. C. The maximum number of players for each team shall be determined by majority vote of the Board prior to the draft. Des Plaines Youth Baseball will strive to have teams consist of not less than 11 players or more than 14 players, depending on registration for a given year.
RULE IV – PLAYERS & MANAGERS The official playing rules and regulations for the current year, as published by Little League Baseball, Inc., Williamsport, PA, shall be binding on this league unless in conflict with this constitution or bylaws or if superceded by the Inter/Intraleague house rules of this League. These rules and regulations are to be reviewed annually and, once approved by the Board, are binding for the current season. Exceptions may be made for issues that compromise safety. In accordance with Little League rules and standards, no child shall be discriminated against based upon gender, nor can they be prohibited from playing baseball, either in regular season play or tournament play. Ejection The umpire has the authority to eject any player, manager, coach or spectator from a game. Refer to Little League Rule 4.06(i)(ii) and 9.01(c)(d) & (e) and 9.02(a). Any player ejected from a game must sit on the bench in the dugout until such time that the player’s parent or guardian allows the player to leave the ballpark. The official scorekeepers will be notified of the player’s ejection. Any manager, coach or spectator ejected
from a game must leave the grounds of the ballpark. 1) The Umpire and the ejected player’s manager or the ejected manager, coach or spectator must submit detailed written incident report explaining their actions to the league President within 24 hours. 2) A meeting of the Board will be held within 72 hours, and prior to the affected party’s next scheduled game, to discuss the incident and take any action necessary, such as a game(s) suspension for unsportsmanlike conduct, to curtail any further incidents from occurring. The affected party will not participate in any game until the Board has met. 3) The game umpire (or proxy, if necessary), the player’s manager, the ejected manager, or coach, may attend the Board meeting in order to make brief statements and/or answer questions from the Board. In no case will a player be allowed to be present, although a player’s parent or legal guardians may attend the meeting. 4) Any player, manager or coach ejected from a game during the regular season must be approved by the Board to be eligible for participation in an AllStars postseason tournament. 5) All decisions of the Board are final. Suspension In the case of a player suspension, the player will not play in the subsequent game(s) in which his or her team participates. The player will be required to attend the game(s) in full uniform and sit on the bench in the dugout. The player must comply with the full suspension before s/he may return to season play. Following a second occurrence, the player will be suspended until such time the Board convenes and determines an appropriate course of action, such as further suspension or league expulsion. Incident review procedures follow Paragraphs (1), (2), (3),(4) and (5) above. In the case of a manager suspension, the manager will not be allowed to participate in the subsequent game(s) in which his team participates, nor will he/she be allowed at the field during such game. Any manager, coach, player or spectator accused of discouraging or misleading any player so that the player does not participate in a regular or tournament game, will be suspended at once. Incident review procedures follow Paragraphs (1), (2), (3), (4) and (5) above.
RULE V – MOST VALUABLE PLAYER There is to be an award for each A, AA, AAA and Major division team for their most valuable player. Team members will choose their most valuable player by secret ballot. The player chosen is not to be notified until the presentation of the MVP Award at the end of the season picnic. In the event of a tie, the Manager and the coaches of the respective team will cast the deciding vote.
RULE VI – SPORTSMANSHIP AWARD A trophy is to be awarded to one player on each A.AA.AAA, and Major division teams at the end of the season picnic. The Major Division award shall be voted on by the players on each team, casting a single ballot for another player on their team who they feel is deserving of this award. The vote is by secret ballot. The manager will be in charge of distributing ballots to the players to vote secretly and is responsible for keeping the winner’s name secret. In the event of a tie, the manager and coaches shall cast the tie breaking vote. In the minor division, individual managers have the choice to use the Major Division ballot system above, or they may decide for their team which player they feel deserves the award. The qualities to be considered in voting for the Sportsmanship Award shall be sportsmanship, teamwork, friendship, fair play, cooperation, loyalty, discipline, enthusiasm, citizenship and courage. Any players suspended at any time throughout the season are ineligible to receive the sportsmanship award. RULE VII – SELECTION OF PLAYERS – DRAFT FOR 11/12, 9/10, 7/8 AGE DIVISION TEAMS AND RULES REGARDING PLAYERS A. The draft will be conducted by presiding league officials, preferably the President, Player Agent(s) and Division Coordinator(s) of the Division (three people required). Each team shall be represented by its manager and no more than one coach, as selected by that manager. No other individuals will be allowed to attend the draft, either inside or outside of the draft room. B. No team may have more than eight players of the same age. C. The Board recognizes one manager and up to one coach per team prior to the draft. The children of the manager and the coach are assigned to their respective teams before the draft begins and do not need to be drafted. D. The sibling rule covers the pick of a player whose sibling is already a team member. For the sibling rule to apply, the parent or guardian must request that the siblings be on the same team. If any team manager picks a player who has a sibling on another team, the manager of the team having the sibling may
challenge that pick. The choosing manager will then pick another player and the challenger must take the child on his or her next pick. E. Teams may not select a second nonsibling player who is the Child of a sponsor. Subsequent sponsor children must be selected by other teams within their respective division. F. The Board reserves the right to vote to increase the number of teams or decide that it is in the best interest of the League to redraft that season. The redraft will follow the same procedure. RULE VIII – SCHEDULING OF GAMES A. DPYB schedules are filled to near capacity up front with the expectations that not all games will be able to be played during the course of the season. It is understood that if postponed games are to be rescheduled during the season, they would likely be played on Sundays. If a team has just one or two postponed games, they may not be rescheduled at all. B. All regularly scheduled season games will start as scheduled. 1. Any team failing to field eight (8) players within fifteen (15) minutes after the official starting time of a game will forfeit that game, and the opposing team shall be declared the winner. Every effort shall be made to play an exhibition game so that the players that show up get to play ball. Umpire(s) shall wait 15 minutes after schedule start time to state “Play Ball”. 2. Any team with a coach or manager and eight (8) players in the dugout must field a team at the umpire’s call of “play ball.” There will be no delays (beyond 15 minutes grace period) to wait for a manager, coach, player or equipment. The opposing team will supply any missing equipment needed to play the game. 3. No team will be scheduled to play five games within a calendar week, nor scheduled to play league games on four consecutive days (including rainout makeup dates.) 4. Any game with a tie score that cannot be completed due to weather or to darkness, will be resumed from the exact spot it was stopped – after one complete inning of play, preceding the regular game the next time the two teams are scheduled to play each other again, or the next rainout date if they do not meet again. C. Postponed Games
1. Makeup dates and shall be made available on the season schedule. 2. Makeup games may be played on available makeup dates. 3. The Player Agent(s) shall schedule rainout games as follows: 1 st postponed game played at first available makeup date 2n d , 3 rd , 4 th , 5 th , etc. . . . 4. The player agent is to notify the appropriate chief of umpires and the concession stand coordinator with date and time of the makeup game. 5. Player agent and division coordinators will compose a rainout procedure sheet to be given to all managers at the manager’s meeting. It is possible that not all postponed games will be rescheduled. RULE IX – TOURNAMENTS A. The Board will decide if the divisions of DPYB will enter a team (or teams) in any postseason tournaments. B. Umpires. Des Plaines Youth Baseball umpires selected for any postseason tournament games shall be selected by the Chief of Umpires (pertains to division). C. All Star Manager, Coaches and Team Selection. The managers of the each age division shall nominate a manager for all star tournament play, subject to Board approval. The selected manager of each team AllStar Team shall choose the coaching staff, subject to Board approval. D. The Board shall vote on tournaments in which Des Plaines Youth Baseball will participate. AllStar teams Team managers will evaluate and rank their players near the conclusion of the regular season and prior to the AllStar player tryouts. This evaluation will rate player performance throughout the season and will take into account ability, desire, and game sense/knowledge. Near the end of the season, DPYB will hold an open tryout for the 7/8, 9/10, and 11/12 year old age divisions. All managers from these divisions will evaluate the players from their respective age divisions. The results will be accumulated and tabulated independently and monitored by the President. The managers in the division will arrive at a consensus of the team, subject to Board approval. The season evaluations will be used in conjunction with the
evaluation at AllStar tryouts to select the team(s). RULE X – ADDITIONAL FEE STRUCTURE A. The Board will determine the team sponsorship fee. Sponsor fees are due by the first of March each year. At the end of the season, sponsors will be contacted inquiring as to their sponsorship intent for the next season. A reminder notice regarding sponsor fees will be sent to each intended sponsor in January. B. The yearly player registration fees will be determined by the Board of Directors. The Board may institute additional discounts. A uniform will not be issued to a player until all fees are received by DPYB, unless alternative arrangements have been approved by the Board. Each registration will include a nonrefundable application fee ($25.00). C. Each player could be asked to participate in the annual fund raising drive. Each player will be required to sell a set amount that is determined by the Board. In lieu of participating in the fundraiser, parent(s) or guardian(s) may elect to pay an additional fee as set by the Board. Funds must be submitted to DPYB by the deadline set by the Board prior to player participation in any subsequent games, unless alternative arrangements have been approved by the Board. D. If a player cannot meet the full financial obligation of the player’s yearly registration fee, due to financial hardships, the DPYB Board may decide on a reduced, or fully compensated registration fee for that player and his/her siblings if applicable. These situation will be heard and discussed by members of the board on a case by case basis. If for any reason there is a surplus of the deposit money at the end of the season, the DPYB Board will vote to determine how it should be distributed. ARTICLE XIAMENDMENTS These Bylaws are binding for the current Season. In the case of a conflict between these Rules and the Inter/IntraLeague House Rules, the Inter/IntraLeague House Rules shall govern. Any other Rule changes proposed during the year shall be voted on for implementation the following year.
