Crowdfunding
Crowdfunding is the practice of funding a project or venture by raising monetary contributions from a large number of people, typically via the Internet. Examples of crowdfunding sites would be any of the following: GoFundMe, Kickstarter, YouCaring, Kiva, GiveForward, Indiegogo, etc. A student-athlete’s eligibility to compete in intercollegiate athletics in a particular sport is jeopardized if he or she uses his or her name, picture, athletics skill or reputation to earn pay in any form in the sport, including funds through a crowdfunding website for items of need. In Division II, under current NCAA legislation, a student-athlete’s name or picture generally cannot be used to promote or to solicit funds for a commercial product or service of any kind. This prohibition applies to traditional, brick-and-mortar businesses, commercial websites, for-profit crowdfunding sites and other on-line businesses that seek to use a student-athlete’s name, picture or likeness for any commercial purpose (e.g., promotion, generation of revenue). Further, a student-athlete may not use his or her name, picture or athletics reputation, or another student-athlete’s name, picture, or athletics reputation to solicit funds through a personal on-line profile or crowdfunding site, except as permitted by NCAA legislation.
Ethical Conduct Sports Wagering
Sports wagering includes placing, accepting or soliciting a wager aka “bet” (on a staff member’s or student-athlete’s own behalf or on the behalf of others) of any type with any individual or organization on any intercollegiate, amateur or professional team or contest. Examples of sports wagering include, but are not limited to, the use of a bookmaker or parlay card; Internet sports wagering; auctions in which bids are placed on teams, individuals or contests; and pools or fantasy leagues in which an entry fee is required and there is an opportunity to win a prize; sporting event contests where a fee is required to participate. The following individuals shall not knowingly participate in sports wagering activities or provide information to individuals involved in or associated with any type of sports wagering activities concerning intercollegiate, amateur or professional athletics competition: (a) Staff members of an institution’s athletics department; (b) Non-athletics department staff members who have responsibilities within or over the athletics department (e.g., chancellor or president, faculty athletics representative, individual to whom athletics reports); (c) Staff members of a conference office; and (d) Student-athletes.
Amateurism
Specifically Restricted Activities
If a student-athlete’s name or picture appears on commercial items (e.g., T-shirts, sweatshirts, serving trays, playing cards, posters, photographs) or is used to promote a commercial product sold by an individual or agency without the student-athlete’s knowledge or permission, the student-athlete (or the institution acting on behalf of the student-athlete) is required to take steps to stop such an activity in order to retain his or her eligibility for intercollegiate athletics. Such steps are not required in cases in which a student-athlete’s photograph is sold by an individual or agency (e.g., private photographer, news agency) for private use. A student-athlete’s involvement in promotional activities specified below are prohibited: Name-the-Player Contest. A student-athlete may not permit use of his or her name or picture in a “name-the-player” contest conducted by a commercial business for the purpose of promoting that business.
Athletics Equipment Advertisement. A student-athlete’s name or picture may not be used by an athletics equipment company or manufacturer to publicize the fact that the institution’s team uses its equipment.
Promotional Contests. Receipt of a prize for winning an institutional or non-institutional promotional activity (e.g., making a half- court basketball shot, being involved in a money scramble) by a prospective or enrolled student-athlete (or a member of his or her family) does not affect his or her eligibility, provided the prize is won through a random drawing in which all members of the general public or the student body are eligible to participate.
