We would like to take this opportunity to thank our Mayor, City Manager, Chief of Police and the Newport City Police for taking time out of your busy schedules to listen to our concerns regarding trespassing, panhandling and littering. Please let me introduce myself, I am Laura (McDowell) Klint, lifelong resident of Lincoln County. Born and raised in Toledo and Newport, my family moved from Toledo in 1965.The years have brought many changes on this corner and surrounding area and though it has become a busy hub 24/7 of foot and vehicle traffic it still pleases me to call this home. The reason for my letter is to bring awareness and hopefully a solution to an ongoing issue with litter Please refer to flash drive for photos. A two block radius between East Olive St and NE 2nd St, including my commercial property,is home to beer cans sometimes in brown paper bags, Liquor bottles, paper coffee cups, cardboard, clothes, cigarette butts and other miscellaneous items. After paying closer attention to the problems of trespassing and litter I began walking the two blocks regularly picking up what gets left on the ground, stuffed in the bushes and hedges in an effort for locals, tourists and businesses to have the enjoyment of looking and walking about a clean neighborhood. -

The NE corner of Starbucks is frequented by panhandlers and unfortunately more times than not their litter is left on the property. Please know that Starbucks, myself included, work diligently trying to keep this unsightly trash picked up. We are aware of the fact it is not against the law to panhandle however, intentional littering on someone else’s property is. Offensive Littering has earned a place in our Municipal Codes and State of Oregon Statutes. 8.10.040, Nuisances Affecting Public Health and Safety: page 232; M. Offensive Littering.

Discarding or depositing any rubbish, trash, garbage, debris, litter or other refuse upon the land of another without permission of the owner, or upon any right of way, park, beach or other public property, other than in a receptacle intended for refuse collection, and then only if the receptacle is intended for public use or with the permission of the person in charge of the receptacle.

164.805 Offensive littering. (I) A person commits the crime of offensive littering if the person creates an objectionable stench or degrades the beauty or appearance of property or detracts from the natural cleanliness or safety of property by intentionally: (a) Discarding or depositing any rubbish, trash, garbage, debris or other refuse upon the land of another without permission of the owner, or upon any public way or in or upon any public transportation facility; (b) Draining, or causing or permitting to be drained, sewage or the drainage from a cesspool, septic tank, recreational or camping vehicle waste holding tank or other contaminated source, upon the land of another without permission of the owner, or upon any public way; or (c) Permitting any rubbish, trash, garbage, debris or other refuse to be thrown from a vehicle that the person is operating. This subsection does not apply to a person operating a vehicle transporting passengers for hire subject to regulation by the Department of Transportation or a person operating a school bus described under ORS 801.460. (2) As used in this section: (a) “Public transportation facility” has the meaning given that term in ORS 164.365. (b) “Public way” includes, but is not limited to, roads, streets, alleys, lanes, trails, beaches, parks and all recreational facilities operated by the state, a county or a local municipality for use by the general public. Starbucks is one of several hot spots for panhandling and the accompanying photos show a relationship between a popular panhandling corner and litter. This isn’t to solely blame panhandlers, all inconsiderate people who frequent this area contribute to littering. One of our suggestions would be to put up Littering Ordinance signs throughout our City, especially in panhandling hot spots, that reminds people littering carries a fine and/or incarceration. For those known repeated offenders a day of community service picking up lifter may deter them from leaving their trash behind. We understand this may be a long shot to enforce but if nothing is tried nothing will be gained. On a larger scale, we must all work together at the City, State and National level to help eradicate the influx of a rapidly growing society of homelessness, panhandlers and litter. We greatly appreciate hearing whatever solutions you have that may curtail the issues we are faced with here in Newport. Yours Sincerely,

FYI: A brief follow up regarding trespassing since I have discussed this with the Mayor and Chief Malloy, photos are also included on flash drive. As you can see from the photos, which do not account for every time we have dealt with trespassing, we have encountered a habitual problem in this area. We give many thanks to the Newport Police and Chief Malloy for providing us with positive feedback to better understand the process in educating street people/transients about boundaries and trespassing. We personally thank Officer Steve Hallmark and Officer Jack Dunteman, your time and effort to help combat this issue exceeded any expectations of ours. Today, we can happily report a major change in fewer congregations of people/transients at the corner of NE 1st and Avery (notorious hang out on the padmount transformer) and under the eaves of the Avery Building. It has truly been a joint effort of business owners signing the Trespass Enforcement Authorization form, my monitoring the area and most importantly the Police responding. Thank you!
