LEGAL GUIDELINES As a PAC Captain, it is very important that you are aware of the legal guidelines by which The Home Depot PAC must abide. The following “Do’s” and “Don’ts” are very easy to learn, absolutely critical to follow, and mandated by federal law.
Do Describe the PAC’s purpose.
- To support our Company’s long-term success by contributing to candidates for federal and state office who understand the concerns and interests we share as associates of The Home Depot.
Clarify that contributions are strictly voluntary.
- All contributions are voluntary and an associate has the right to refuse to contribute without reprisal.
Explain that the contribution amount is entirely up to the associate.
- The PAC suggests a guideline of 0.5 to 1 percent of gross annual salary. This is merely a suggestion. Associates may contribute more, less, or not at all. The Home Depot will not advantage or disadvantage any associate by reason of the amount of their contribution or their decision not to contribute.

- Political contributions are not tax deductible, nor are the matching contributions made through PAC Match.

The following victories directly imPACted the Central Region: Illinois • Governor Rauner signed a bill allowing THD to get back sales taxes paid to the state on private label credit card bad debt. It is estimated to save Home Depot $1 million per year. • A personal information protection bill passed that included a number of suggestions from THD regarding personal data collection which helps keep our customers’ data more secure. Missouri • Legislation was introduced that would increase the sales tax holiday to cover purchases up to $1,000 on qualified Water Sense and Energy Star products, saving our customers money on efficient products for their homes. • We kept consumer choice a priority as we defeated numerous local plastic bag bans that would have created a checkerboard of regulations.

The following victories directly imPACted South Florida/Puerto Rico: Florida: • A huge new tax on our business operations that would have instituted mandatory combined reporting was defeated. This would have cost THD an additional $30-40 million in taxes. Puerto Rico: • We defeated the latest Value Added Tax (VAT) reform proposal that threatened to significantly hurt sales by imposing a 16% VAT to replace the 7% sales tax. This tax increase would have boosted costs dramatically for our customers while imposing burdensome tax collection requirements and increasing our cost of doing business in Puerto Rico.

This would have cost THD an additional $6 million in taxes. • THD re-instituted a two-day sales tax holiday for all hurricane preparedness materials under $2,500, helping to keep our customers safe during storms. Texas • THD worked to reinstate the three-day Energy Star sales tax holiday, saving our customers money on efficient products for their homes. • THD helped defeat a bill that would have required a zip code to be entered on all credit card purchases over $200. It would have slowed down the checkout process for our customers and would have required additional POS software and training for our cashiers. • Helped defeat a bill backed by credit unions that would have created significant financial penalties on retailers who were part of a data breach.

The following legislative priorities and victories directly imPACt the Human Resources Department: • Legislation to defund the National Labor Relations Board’s ambush election and micro-union rules would prevent harmful union policies from fragmenting our stores. • Predictive scheduling legislation, which would have taken away our flexibility in scheduling associates’ shifts, was defeated in three states. Such regulations are burdensome for our stores by penalizing retailers for adjusting employee schedules to fit demand. • Legislation passed in Georgia allows us to issue payroll cards to associates instead of paper checks. This bill protects our associates without bank accounts from using predatory check cashing locations.
