ITEM& ISSUE Change of Floor Plan for Dispenser License No. 2746 ("License 2746") located at the Drury Plaza Hotel-Santa Fe, 228 East Palace. BACKGROUND AND SUMMARY There are currently two Dispenser Licenses located at Drury Plaza Hotel; License No. 2507 and License No. 2746. These Dispenser Licenses were approved by the Governing Body on February 26, 2014 and March 12, 2014. On August 26, 2015, the Governing Body considered and approved a change of floor plans for these licenses.
Santa Fe Cafe/Eioisa's ("Santa Fe Cafe") who holds License 2746 has applied for a change of floor plan/expansion of liquor licensed premises through the New Mexico Alcohol and Gaming Division. Santa Fe Cafe proposes the addition of the guest rooms and "kick back area" in the Drury Plaza Hotel to the approved licensed premises for License 2746. All service of alcoholic beverages will be provided under License 2746. If the change of floor plan/expansion is approved, the Drury Plaza Hotel management company will place Liquor License No. 2507 in a voluntary suspension and sell it. ACTION REQUESTED I request that the City Council indicate its decision on the change of floor plan/expansion for License 2746 which is located at the Drury Plaza Hotel-Santa Fe, 228 East Palace.

Dear Ms. Vigil: Enclosed is the floor plan application of Santa Fe Cafe, LLC which proposes the addition of the guest rooms in the Drury Plaza Hotel (the "Hotel") to the approved licensed premises of Liquor License No 2746 (the "License"). The License is currently operated for service of alcoholic beverages in the restaurant, the conference center, meeting rooms, the ballroom, the roof top bar and outdoor areas of the Hotel. The License provides almost all of the alcoholic beverage service at the Hotel. When the License was initially approved for operation at the Hotel, its approved licensed premises included the guest rooms. In 2015, the operator of the License transferred the guest room portion of its licensed premises to the hotel management company which hosts a kickback service for Hotel guests each evening under a separate liquor license. No service of alcoholic beverages has ever been provided to guest rooms at the Hotel. Santa Fe Cafe, LLC would like to expand its licensed premises to again include the Hotel guest rooms. That proposal is included in the enclosed floor plan application. If this expansion is approved. the hotel management company will place its liquor license in a voluntary suspended status and sell it. The management company and Santa Fe Cafe, LLC have determined that all service of alcoholic beverages can be provided under the License, including the evening kickback service. Therefore, the service area used for the kickback service at the Hotel is also a proposed addition to the licensed premises of the License, as shown on the floor plan application.
