January 9, 2017 1.

ROLL CALL:

Mayor Stewart called the regular meeting to order at 7:00 p.m. and Mrs. Dritz called the roll. There was a moment of silent prayer followed by the Pledge of Allegiance to the flag. Mayor Stewart asked that Father Kennedy’s daughter, who needs our prayers as well as Mary Thurwachter whose husband passed away, be remembered. PRESENT:

Mayor Stewart, Vice Mayor Aridas, Vice Mayor Pro Tem Deringer, Councilmember Balfour, and Councilmember Moorhouse.

APPROVAL OF MINUTES:

Councilmember Deringer made a motion to approve the regular meeting minutes of December 12, 2016. Councilmember Balfour seconded the motion. Motion passed 5-0. 3.

AGENDA APPROVAL:

Vice Mayor Aridas made a motion to approve the agenda as submitted. Councilmember Moorhouse seconded the motion. Motion passed 5-0. 4.

a. * VAR16-0002- Consideration of a request for a Variance relative to Chapter 17.5 Subdivision and Platting Regulations, Section 17.5-54, Access Points, for the property located at 327 W. Lantana Road

in order to allow an exit-only driveway onto North 4th Street located 60’ from the higher classified street (Lantana Road) where Town Code requires 180’. Mayor Stewart introduced this item on the agenda. Attorney Lohman swore in members of the public who wished to comment on the agenda item. Mayor Stewart introduced this item on the agenda and asked for disclosures. Councilmember Moorhouse disclosed he spoke with the Town Manager, Vice Mayor Aridas disclosed he spoke with the Town Manager and drove by the property, Councilmember Balfour disclosed he spoke to the Town Manager, drove by the property and he is familiar with Mark Albright and his properties in town, Councilmember Deringer disclosed he spoke with the Town Manager and did research on the property, Mayor Stewart disclosed he spoke with Town Manager and David Thatcher. David Thatcher gave recommendations for the Plan Review Committee and the Planning Commission. The applicant, Mark Albright, gave an overview of his request and answered questions from Council. David Thatcher read from a letter he received to Mark Albright, from Doug Marek of Pugliese Corporate Center stating confirmation that an easement across the west end of the property would be granted. The following individuals from the public commented on the agenda item: Erica Wald, 613 S. Atlantic Drive Richard Schlosberg, 417 S. Atlantic Drive. Councilmember Moorhouse made a motion to reopen public comment. Councilmember Balfour seconded the motion. Motion passed 5-0. Attorney Lohman swore in additional members of the public.

The following individuals from the public commented on the agenda item: Joe Basil, 555 Hypoluxo Road, Lyn Tate, 806 Lagoon Lane Mark Albright addressed Council with a final statement and answered questions from Council. There was Council discussion. Councilmember Moorhouse made a motion to approve the request for Variance VAR16-0002 to allow an exit-only driveway onto North 4th Street located 60’ from Lantana Road at the property located at 327 W. Lantana Road. Vice Mayor Aridas seconded the motion. Motion passed 4-1. (Nay- Mayor Stewart) b.

Consideration of a Request by the Finnish American Rest Home, Inc., to release a Unity of Title.

Councilmember Moorhouse disclosed he spoke with the Town Manager, David Thatcher, and Attorney Lohman, Vice Mayor Aridas disclosed he spoke with the Town Manager, Councilmember Balfour disclosed he drove by the property, Councilmember Deringer disclosed he spoke to David Thatcher and the Town Manager, Mayor Stewart disclosed he spoke with the Town Manager and Peter Makila, the Finnish Counselor. The applicant’s representative, Laila Lane, gave an overview of the request and answered questions from Council. There was Council discussion. Councilmember Moorhouse made a motion to open public comment. Councilmember Balfour seconded the motion. Motion passed 5-0. The following individuals from the public commented on the agenda item. Sayu Barish, selling agent for Finnish American Rest Home, Inc., 7541 Nemec Dr. North. Mayor Stewart stated if the property was rezoned to R3, then the Council would be in favor. Councilmember Deringer made a motion to deny the release of the Unity of Title for the Finnish American Rest Home, Inc. Councilmember Moorhouse seconded the motion. Mayor Stewart encouraged the applicant to contact David Thatcher to follow the proper procedures. Motion passed 5-0. c. Consideration of a request for a Platting Exception for Equity One, Inc., for the property located at 1001-1501 S Dixie Highway and 457 Greynolds Circle (Lantana Village Square) relative to Section 17.56(d) of the Town’s Code of Ordinances. Mayor Stewart introduced and explained this item on the agenda and asked Council for disclosures Councilmember Moorhouse disclosed he spoke with Attorney Lohman and the Town Manager, Vice Mayor Aridas, Councilmember Balfour, Councilmember Deringer and Mayor Stewart disclosed they spoke with the Town Manager. David Thatcher gave recommendations for the Plan Review Committee and the Planning Commission. The applicant, Janna P. Lhota, Esq., gave an overview of her request and answered questions from Council. The following individuals from the public commented on the agenda item: Richard Schlosberg, 417 S. Atlantic Drive.

Attorney Lohman clarified that the Platting Exception section of the Town Code states if Council finds that it satisfies certain criteria the exception shall be granted.

Councilmember Moorhouse made a motion to approve the Platting Exception for 1001-1501 S. Dixie Highway. Vice Mayor Aridas seconded the motion. Motion passed 5-0. d.

Consideration of the proposal to construct sidewalks along the west side of South Broadway using the Annual Contract for Concrete Repair and Construction Projects with West Construction, Inc., in an amount not to exceed $25,089.00.

Mayor Stewart introduced and explained this item on the agenda and asked Council for disclosures. Mayor Stewart disclosed he owns property at 611 W. Branch Street. There were no other disclosures. The following individuals from the public commented on the agenda item: Richard Schlosberg, 417 S. Atlantic Drive.

Councilmember Balfour made a motion to approve the use of West Construction, Inc., under the Annual Contract for Concrete Repair and Construction Projects, in order to construct sidewalks along the west side of S. Broadway from W. Branch Street south to Hypoluxo Road in an amount not to exceed a total of $25,089.00. Councilmember Deringer seconded the motion. Motion passed 5-0. e.

Report and status update from the Greater Lantana School Community Education Council.

Mayor Stewart introduced and explained this item on the agenda. Education Council Chair Rosemary Mouring stated her thoughts and feelings about the audio from the December 12th Council meeting discussion regarding the Education Council and resigned from her Chair position. There was Council discussion. By consensus, the Council directed the Town Manager to schedule a joint meeting between the Greater Lantana School Community Education Council and the Town Council as soon as possible. f.

Discussion of parking on Town Right of Ways.

Mayor Stewart introduced and explained this item on the agenda. The following individuals from the public commented on the agenda item: Ed Sheedy, 610 S. Atlantic Drive, Dr. Leonard Griff, 209 S. Atlantic Drive, Richard Schlosberg, 417 S. Atlantic Drive.

There was Council discussion. Councilmember Balfour made a motion to limit parking to 1 hour. Motion died for lack of a second. Attorney Lohman stated that staff could be directed by consensus to draft proposed changes to the ordinance to regulate parking on the island and schedule it to be brought before Council for first reading and clarified that the changes would be for the R1A district only. There was Council discussion. Vice Mayor Aridas made a motion to reopen public comment. Councilmember Balfour seconded the motion. Motion passed 5-0. The following individuals from the public commented on the agenda item: Dr. Leonard Griff, 209 S. Atlantic Drive By consensus, Council directed the Town Manager to schedule the proposed changes to the Ordinance to come before Council for first reading at the January 23rd Town Council meeting. Town Manager Manzo clarified details of the proposed changes. There was Council discussion. Vice Mayor Aridas made a motion to amend the agenda to add Item 7, Statements from the Public. Councilmember Balfour seconded the motion. Motion passed 5-0. 7. STATEMENTS FROM THE PUBLIC: Lyn Tate, 806 Lagoon Lane, gave an update on police presence on the island and expressed concerns with the no left turn sign on Hypoluxo Island. Joni Epsteinfeld, 326 S. Atlantic Drive, expressed concerns with the no left turn sign on Hypoluxo Island Erica Wald, 613 S. Atlantic Drive, expressed concerns with the Building Department process on checking contractor insurance. Richard Schlosberg, 417 S. Atlantic Drive, urged Council to support environmental protection. Diane Vilagi, 605 SE Atlantic Drive, clarified that the Hypoluxo Homeowners Association never requested the no left turn sign and she believes it was at the request of a homeowner, not the association. 8.
