Dear Ms. Kafoury and Ms. Madkour: This firm represents Multnomah County Sheriff's Office Command Staff members, Timothy Moore and Jason Gates, in matters relating to the County's internal investigation of Sheriff Staton. The Mr. Moore and Mr. Gates have direct knowledge of Sheriff Staton's workplace conduct and are willing to fully cooperate with the County's investigation. Although they will cooperate with the investigation, Mr. Moore and Mr. Gates fear retaliation from Sheriff Staton. Sheriff Staton has engaged in increasingly erratic behavior, has threatened loss of employment to each member of his Command Staff on multiple occasions, and has also threatened to personally sue each member. Based upon their years of experience, Mr. Moore and Mr. Gates reasonably anticipate being subjected to Sheriff Staton's retaliatory behavior. As you know, such retaliation would constitute an unlawful employment practice under ORS 659A.203. As they participate in the investigation, my clients request that they not be subject to any retaliation from Sheriff Staton for the remainder of his tenure. Although no such retaliatory decisions have been made, the threats have been serious and are real. Mr. Moore and Mr. Gates further request reassurance from the County that it will indemnify and defend them from any actions taken against them individually by Sheriff Staton.
