A LOCAL LAV^ PROHIBITING CLUTTER, LITTER AND DEBRIS IN THE VILLAGE OF HARRISVILLE
Section 1. Title This iccai law shall be entitled "Prohibiticn pf Clutler, Litter and DeOris in lhe village of H a r r i s v i l l e , New York."

JuTzk Mobile Home: Any enclosed dwelling built upon a chassis, motor vehicle, cr b^er used or designed lo be u^ed fcr either permsnent or te.'nnorary living and/cr sleeping purposes including motor homes, Iracic campers, camping trailers, campers, travel trailers, pop-up trailers, lent trailers and over-night trsilers; which is no longer suilabie fcr human habitation, J'jnk Vehicls: Any motor vehicle, whether autcmcbiie, bus, trailer, trjck, tractor, motor home, motorcycle, mini-bicyeic, or snowmobile, or any ether device originally inlend'eil for Iravei cn the public liighways, which meets ail of the follcwinz conditions: 1) it is unregistered; 2) X ' is either abandoned, wrecked, stored, discarded, dismantled, or panly dismantled; 3) it is net in any condition for legal use upon the public highway. With respect lo any motor vehicle not required to be licensed or motor vehicle not usually used on public highways, the fact that such motor veiiicle has remained unused for more than six months and is not in condition to be removed under its own power shall be presumprive evidence that such motor vehicle is a junk vehicie, Yafxi: Any open space located on llie same lot with a building. Clutter, Litter and Debris Prohibited In order lo preserve and promote reasonable q»iaiity of environment and aesthetics and lo prohibit actions and conduct which offends the sensibilities and lends to debase lhe community and reduce real estate values, the deposit, accumulation, or maintenance of clutter, litter or debris regardless of quantity in any: A.

Section 4. Variance A.
If there is a practical difficuUy in storing or maintaining such clutter, Utter of debris in an area other than front or side yards, or out of sight of persons lawfully irav^-i.ng :he public highways, the applicant may appeal to U« zoning board of appeals for a variance from the provisicns of this law.
B.
in making its determination, the zoning board of appeals shall take into consideration the benefit to the applicant if the variance is granted, as weighed against the detriment to the lieallh, safely and welfare of the neighborhood or community by such grant. In making such delerniination lite boartt shall also consider: (1) whcUicr an undesirable change will be produced in the ciiaractcr of UJC neighborhood or a detriment lo nearby properties will be created by the granting of the variance; ^2) wheltier the benent sought by the appUcant can be achic'/cd by some method fear^ibie for the applicant to pursue, other than a variance; (3) whether lhe requested variance is substanUai; (4) whether the proposed variance will have an adverse effect or impact on the physical or environmental conditions in lhe neighborhocd; and (5) whether the alleged difficulty was self-created, which consideration shall be relevant lo the decision of the board of appeals, but shail not necessarily preclude the granting of the variance.

The board of appeaJs shall grant the nunimum variance that it shail deem necessary and adequate and at the same time preserve end protect the character of the neighborhood and ilie health, cafaiy and welfare of the coipmunity.

All fees for appeals shall be as establisneii by lown board resolution.

Any v i o l a t i o n o f t h i s law i s an o f f e n s e p u n i s h a b l e by a f i n e n o t exceeding $350.00 f o r c o n v i c t i o n o f a f i r s t o f f e n s e ; f o r c o n v i c t i o n o f a second o f f e n s e b o t h o f which were committed w i t h i n a p e r i o d o f f i v e (5) y e a r s , p u n i s h a b l e by a f i n e not l e s s t h a n $350.00 nor more t h a n $700.00 o r imprisonment f o r a p e r i o d not t o exceed s i x (6) months, o r b o t h ; and, upon c o n v i c t i o n f o r a t h i r d o r subsequent o f f e n s e a l l o f which were committed w i t h i n a p e r i o d o f f i v e (5) y e a r s , p u n i s h a b l e by a f i n e not l e s s t h a n $700.00 nor more t h a n $1,000.00 o r imprisonment f o r a p e r i o d n o t t o exceed s i x (6) months, o r b o t h .
