Entry Restrictions

Open only to Australian residents who are: •

aged 18 or over; and



present at the Moët & Chandon Spring Champion Stakes Day at Royal Randwick Racecourse on 10/10/2015.

Directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter, or of the agencies or companies associated with this competition or jockeys, trainers, bookmakers and promotional staff associated with the Race are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. Competition Period

9:00am (AEDT) on 10/10/2015 until forty-five (45) minutes prior to the scheduled start time of the Moët & Chandon Stakes race (as determined by Australian Turf Club) on 10/10/2015 (the Race).

Venue

Royal Randwick Racecourse, Alison Rd, Sydney, New South Wales 2031.

Entry Method

During the Competition Period, entrants must purchase a bottle of Moët & Chandon Non-Vintage to share with friends (Eligible Purchase) for on premise consumption from the Venue to receive a golden bubble(s) (subject to stocks remaining), each containing a ‘winner’ or ‘consolation’ message (Golden Bubble Ticket). Entrants receive: •

One (1) Golden Bubble Ticket with any Moët & Chandon Piccolo 200ml purchase;



Four (4) Golden Bubble Tickets with any Moët & Chandon 750ml purchase; and



Eight (8) Golden Bubble Tickets with any Moët & Chandon 1.5L purchase.

Entrants who receive a Golden Bubble Ticket revealing a ‘winning’ message must follow the instructions on the Golden Bubble Ticket to make their way to the ‘meeting tree’ at the Venue (Draw Location) at the time specified on the Golden Bubble Ticket. Once an entrant has arrived at the Draw Location, they must provide their details and follow the instructions of the Promoter’s representative including watching the Race from a designated track-side area. Each Golden Bubble Ticket containing a ‘winning’ message will also contain a name of one of the horses in the Race (Allocated Horse). Winner Determination

The entrant with the Golden Bubble Ticket with the Allocated Horse that corresponds to the horse that places highest in the Race according to the official placings of the Race (as determined after correct weight has been declared and after any challenges have been determined) will be the winner.

If, after making all reasonable attempts, the Promoter cannot locate the winner within 30 minutes of the official Race determination, or the winner does not present themselves to the Promoter’s representative within 30 minutes, their entry will be deemed invalid and the Promoter reserves the right, in its discretion, to award the prize to the entrant whose Allocated Horse corresponds to the horse that placed 2nd highest in the official placings of the Race (as determined after correct weight has been declared and after any challenges have been determined). This process will continue until a winner claims their prize within the allocated timeframe. Prize Redemption

To claim their prize, the winner must, present their winning Golden Bubble Ticket containing the highest placed Allocated Horse to the Promoter’s representative.

Dead Heat

In the event of a dead heat whereby two horses in the Race have tied and the Race officials are unable to establish the highest placed horse, the Promoter will place the two winning Golden Bubble Tickets from those corresponding tied horses into a draw and the first Golden Bubble Ticket drawn will be deemed the winner.

Scratched Horses

Entrants bear the risk of their Allocated Horse being scratched from the Race at any time, and will not be given a different Allocated Horse in the event that their original Allocated Horse corresponds to a horse that has been scratched from the Race.

Prize Details

There is one prize to be won. The prize is a trip to Paris for the winner and one companion (who must be aged 18 or over) valued at up to $10,000 (inc GST) depending on the winner’s point of departure. See paragraph 8 for full prize details and conditions.

Prize Pool

The total prize pool is valued at up to $10,000 (inc GST).

Entry Limits

Entrants are limited to one entry per person.

Retain Golden Bubble Ticket Requirements

Entrants must retain their original Golden Bubble Ticket to verify their entry and if applicable, claim the prize.

Winner Notification and Publication

The winner will be announced verbally and by Public Address System at the Venue at the conclusion of the Race and will receive confirmation in writing by email. The winner’s details will be published at http://moet-hennessycollection.com.au/magazine/competition-winners on 12/10/2015.

All publicly displayed advertising material for this competition will include a prominent message regarding responsible consumption of alcohol. Entry and continued participation in this competition is subject to the Venue’s liquor serving policy.

The competition will be conducted during the Competition Period.

Entries must be received during the Competition Period. Failure of an entrant to provide their original Golden Bubble Ticket (as per the Retain Golden Bubble Ticket

Requirements) (without alteration) to the Promoter upon request may, at the Promoter’s discretion, result in an invalid entry. 6

Golden Bubble Tickets are void if lost, stolen, forged, mutilated or tampered with in any way.

The Promoter is not liable for late, lost, incomplete, misdirected, incorrectly submitted, delayed or illegible entries, correspondence or claims for prizes due to error, omission, tampering, theft, destruction or otherwise.

The prize is a trip for the winner and one companion (who must be aged 18 years or over) to Moet & Chandon Maison in France which consists of return economy airfares (including airfare taxes) for the winner and their companion from the winner’s nearest Australian capital city to Paris, 3 nights accommodation (twin share) in a minimum three to four star hotel (as determined by the Promoter) for the winner and their companion, airport transfers in Paris, a dining experience at the Maison, a tour, a tasting and a lunch at Trianon, and return transfers to Epernay. Flights and accommodation are subject to booking and availability. Travel must be booked within 12 months of the draw date. The prize cannot be taken during major event/peak/public holiday periods or any other exclusion periods as specified by the Promoter or the prize supplier/s. All other costs associated with the prize, including but not limited to any additional transfer costs, additional meals, additional taxes, insurance and other ancillary costs are the responsibility of the winner and his/her companion as incurred. Once travel has been booked, any changes will incur fees which are the responsibility of the winner and their companion as incurred. The winner and their companion must depart and return at the same time. The prize is subject to any additional terms and conditions specified by the prize supplier/s. The winner and their companion are responsible for ensuring that they have all necessary documents to travel to Paris, France including a current passport and any visas that may be required.

In the event that the value of the Parisian dining experience offered as part of the prize is less than the amount specified by the Promoter, the balance will be forfeited and no cash will be supplied in lieu. Any costs incurred over the specified amount for the dinner are not the responsibility of the Promoter and must be borne by the winner and their companion, as incurred.

The winner will be notified in accordance with the Winner Notification and Publication section of these conditions. By entering this competition, each entrant requests that his or her full address not be published.

The winner (and their companion) must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to the Promoter using their names and images in promotional material.

The Promoter may require the winner to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion.

If a winning entry is deemed not to comply with these conditions of entry, the entry will be discarded the prize will be awarded to the person who has the Golden Bubble Ticket containg the Allocated Horse that corresponds to the horse that placed 2nd highest in the official placings of the Race (as determined after correct weight has been declared and after any challenges have been determined).

The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person (including without limitation the winner or their companion) who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this competition, is contrary to law or is

otherwise inappropriate. The winner is fully responsible for the acts and omissions of their companion/s and the Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, the winner and their companion if their companion breaches these conditions, whether or not legally bound by them. 15

The Promoter may in its absolute discretion cancel the prize or otherwise cease to provide any benefit of the prize to a winner (and their companion, if applicable) if the winner (or their companion, if applicable), in the opinion of the Promoter, is under the influence of alcohol or any other drug, behaves aggressively or offensively, or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate.

The Promoter’s decision is final and no correspondence will be entered into.

The prize is not transferable or exchangeable and cannot be redeemed for cash. If for any reason the winner or their companion does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited and cash will not be supplied instead. The Promoter accepts no responsibility for any variation in prize value. If the prize or any element of the prize is unavailable for any reason, the Promoter may substitute for that prize or element of that prize another item of equal or higher value as determined by the Promoter, subject to the approval of the NSW gaming authority if required.

The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).

Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage, loss or delay in transit to the prize.

The Promoter may communicate or advertise this competition using Facebook. However, the competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook. Each entrant completely releases Facebook from any and all liability.

As a condition of accepting or participating in any prize the winner’s companion accepts these conditions.

If for any reason any aspect of this competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the NSW gaming authority if required.

The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought. Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may collect entrants’ or their companions’ personal information (including through its contractors or agents) or disclose entrants’ or their companions’ personal information to its related companies, contractors and agents to assist in conducting this competition,

storing data or communicating with entrants or their companions. If the entrant has marked the “opt-in” box on the entry form, the entrant consents to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future promotional and marketing purposes regarding the Promoter’s products including contacting the entrant via electronic messaging. The Promoter is bound by the Privacy Principles in the Privacy Act 1988 (Cth). The Promoter’s Privacy Policy, located at http://moet-hennessy-collection.com.au/customer-service/privacysecurity/privacy-policy.html, contains information about: (i)

how entrants or their companions can seek access to the personal information the Promoter holds about them and seek the correction of such information;

(ii)

how entrants or their companions can complain about a privacy breach and how the Promoter will deal with such a complaint; and

(iii)

whether entrants’ or their companions’ personal information the Promoter holds about them will be provided to overseas companies, and if so, which countries those companies are located.
