Donation Boxes • Discuss results of stakeholder survey • Discuss options proposed to strengthen ordinance

Background • In 2015, the City began studying donation boxes and

the side effects of boxes. • "Donation Boxes" Chapter of the Arlington City Code was adopted April 26, 2016. • Legal concerns raised in early 2017 as deadline for compliance was reached.

Outreach to stakeholders • Stakeholder meeting was held May 10, 2017 with

several donation box operators. • Concerns relayed to Municipal Policy Committee on November 28, 2017. • Written survey regarding possible amendments to ordinance conducted throughout December 2017 and January 2018.

Proposed deletions • Delete screening fence requirement from

Section 3.03 • Delete requirement of proof of non-profit corporation or proof of written agreement to solicit on behalf of non-profit from Section 3.03 • Delete restriction of one box per platted lot from Section 3.03

Proposed additions • Add additional zoning use districts eligible for the placement of donation boxes

• Available non-residential zoning use districts to consider: Community Commercial (CC), Office Commercial (OC), and Non-residential Planned District (PD).

Proposed amendments • Add GPS coordinates to application process • Add a specific radius that operators agree to

keep clean of debris (i.e. 20 ft) • Add a minimum distance requirement in place of the one box per lot requirement (i.e. 300 ft) • Modify the box size requirement from 50 square feet to 120 cubic feet • Change the permit revocation trigger from two NOVs to one citation issuance

Implementation • If recommended by the committee, a

proposed ordinance to amend the Donation Boxes Chapter can be drafted to incorporate the proposed changes. • The timing of adopting an amendment is entirely at the discretion of the City Council. • No additional public hearings are required for adoption.
