On approaching Malton continue on the bypass and follow the A64 past Scagglethorpe to Rillington. PLANNING There are two separate planning permissions. By Decision No. 13/00652/MOUT dated 17th March 2014 planning permission was granted for the erection of 10 dwellings. The permission was subject to the provisions of a Section 106 Agreement which provides inter alia for the erection on site of 3 affordable dwellings and a contribution of £27,500 to be paid in lieu of 0.5 units of affordable housing. It also provides for an off-site POS contribution of £23,270. The proposed development is in accordance with Drawing No. AP180:02C. However, the owners have decided to retain the site of Plot 10 (C-Type dwelling) because of its potential impact on 56 Low Moorgate. By Decision No. 16/00354/MOUT dated planning permission was granted for the erection of 18 dwellings. The permission was subject to the provisions of a Section 106 Agreement which provides inter alia for the erection of 5 affordable dwellings and a contribution of £39,182 to be paid in lieu of the provision of 1.3 units of affordable housing. A POS contribution is not required because this second phase will attract the payment of Community Infrastructure Levy. The proposed development is in accordance with Drawing No. AP 180:103C. A copy of the two layout plans and the planning permissions, along with the Section 106 Agreements, are available for inspection at the selling agent’s office. THE SITE The site comprises an area of grassland and the former orchard of 56 Low Moorgate and is shown by red verge on the site plan. MODE OF SALE Offers are invited for the freehold of the overall site. Offers to purchase should be in a finite sum and any conditions applicable to the offer should be clearly stated. It is envisaged that offers will be subject to the grant of Reserved Matters. SPECIAL CONDITIONS 1. The vendors do not undertake to accept the highest or indeed any offers submitted. 2.
