Notice to Proposers The Pewitt Consolidated Independent School District is requesting statements of qualifications for Architectural and Engineering services. Submittals will be received at the Administration Building, Business Office, U.S. Hwy 67 West, Omaha, Texas 75571 until August 28, 2015 at 4:00 p.m. Submittal envelopes should be plainly marked: RFQ Architectural and Engineering Services, Due August 28, 2015. Any submittal received later than the specified time, whether delivered in person or mailed shall be disqualified. The Pewitt Consolidated Independent School District will not be responsible for delivering mail from the post office. The Pewitt Consolidated Independent School District will not be responsible for submittals delivered to any location other than the one specified above. Firms are encouraged to hand deliver submittals well ahead of submittal opening time. The district, through its duly authorized constituted officials, reserves the right to reject any, part of any or all submittals, to accept any submittal deemed most advantageous to the Pewitt Consolidated Independent School District based on qualifications and demonstrated competence and to waive any informalities. The District reserves the right to hold all qualification statements for ninety (90) days from the receipt date without action. Pewitt Consolidated Independent School District is a public entity subject to the provisions of the Texas Public Information Act (Tex. Govt. Code Ch. 552). Responses to this invitation may be subject to release as public information unless the response or specific parts of the responses are exempted from public disclosure under such Act. The firm must stamp in bold red letters the term “CONFIDENTIAL” or “PROPRIETARY” on every page of any part of a qualification that the firm claims is confidential or proprietary. All qualifications and parts of qualifications that are not marked as confidential or proprietary will be considered public information after the submittal is opened. The District assumes no liability or responsibility for release of any information not properly marked. In the event that the District receives a request for disclosure of material marked “confidential” or “proprietary”, the District may request an opinion from the Texas Attorney
General concerning whether such material must be disclosed. Copyrighted qualifications are unacceptable and will be disqualified as non-responsive. The firm shall be responsible for any cost incurred in the preparation of qualifications and participation in the evaluation process. There is no expressed or implied obligation by Pewitt Consolidated Independent School District to reimburse any individual or firm for any costs incurred in preparing or submitting qualifications, for providing additional information when requested by Pewitt Consolidated Independent School District or for participating in any selection demonstration/interviews, including discovery (pre-contract negotiations) and contract negotiations. The statement of qualifications may be withdrawn or revised prior to the scheduled time for opening, provided request for such withdrawal is received in writing before the time set for opening. Any interlineation, alteration, or erasure made before receiving time must be initialed and dated by the signer of the submittal, guaranteeing authenticity. The District’s intent is to review and evaluate all qualifications in accordance with the criteria articulated in ATTACHMENT “B”. Even though specific project information is required as a part of ATTACHMENT “A”, firms are encouraged to provide additional information that will be utilized during the evaluation process. Professional brochures containing information such as past and current projects, personnel resumes, and organizational history, are strongly encouraged. The District’s intent is to select an architectural / engineering firm or firms, based on individual firm qualifications for selected architectural / engineering services as indicated on ATTACHMENT “C”. Once selected by the District, the selected firm(s) will be eligible to provide architectural / engineering services for the District. Selection to provide architectural / engineering services as a result of this solicitation does not guarantee or deny future architectural / engineering work with the District. Based on the Scope of Work and needs of the District, the District will select a firm(s) and will negotiate a contract with the selected firm(s). The District’s intent is to negotiate and utilize contract AIA B101-2007, with modifications, at a fair and reasonable fee. If the District is unable to reach a contract agreement with the selected firm, the District will terminate further discussions and proceed to the next firm deemed most appropriate for the applicable work. All contract revisions and approvals are subject to approval by the district’s legal counsel and the PCISD Board of Trustees.

Target date for firm contract: INSTRUCTIONS TO PROVIDERS 1. Firms shall submit five (5) statements of qualifications, one marked “original” and four (4) copies. All submittals shall be the property of PCISD and will not be returned. 3. Firms shall submit their statement of qualifications endorsed in blue ink with the names of the providers for the submittal and enclosed in an opaque sealed envelope, clearly marked RFQ for Architectural and Engineering Services. They may be addressed or delivered in person to Andy Reddock, Superintendent, P.O. Box 1106, U.S. Hwy 67 West, Omaha, Texas 75571, prior to August 28, 2015. No electronic submittals will be accepted or considered. The submittals are to be submitted and signed longhand in blue ink. Failure to comply with this instruction could be cause for disqualification of this submittal. 4. Submittals which are not signed by individuals making them shall have attached thereto a Power of Attorney evidencing authority to sign the submittal in the name of the person for whom it is signed. 5. Submittals which are signed for a partnership shall be signed longhand in blue ink by all partners or by an attorney in fact. If signed by an attorney in fact, there shall be attached to the submittal a Power of Attorney evidencing authority to sign the submittal executed by the partners. 6. Submittals which are signed for a corporation shall have the correct corporate name thereof and the signature of the president or other authorized officers of the corporation signed longhand in blue ink written below the corporate name. 7. If a vendor contemplating submitting a statement of qualifications is in doubt as to the true meaning of any part of the specifications or contract documents, he may submit a written request for an interpretation thereof to Andy Reddock, Superintendent, P.O. Box 1106, U.S. Hwy 67 West, Omaha, Texas 75571. Each person submitting a written request for an interpretation will be responsible for its prompt delivery at least ten (10) days prior to the submittal due date. The Pewitt Consolidated Independent School District will not be responsible for any other explanation or interpretation of the proposed documents.
8. The Pewitt Consolidated Independent School District is exempt from taxation under the Sales Tax and Use Tax Laws, and the provider shall not include such taxes. 9. Firm’s attention is called to the statutory requirements of the State of Texas relative to licensing of corporation organized under the laws of any other state.
Architectural and Engineering Services Request for Qualifications The Pewitt Consolidated Independent School District is receiving Request for Qualifications (RFQ) for selected architectural and engineering services in compliance with Government Code 2254. The Pewitt Consolidated Independent School District Board of Trustees has begun a strategic planning initiative that should provide a long range plan relative to the educational needs for the community. As part of the strategic planning, the District would like to begin long range planning for its facilities. This plan would be used, potentially, to call a general bond election for renovations, additions, and new school construction for Pewitt Consolidated schools within the next few years. Pewitt Consolidated ISD will receive statements of qualifications from qualified architectural / engineering firms in an effort to select a firm(s) to produce and finalize a Long Term Facility Planning Needs Study which will include specific facility design data, educational facilities programming and educational presentation materials for the District. All materials produced will be used by the District to communicate the Long Term Strategic Facility Planning Needs to the citizens of the Pewitt Consolidated community. The selected firm will also be called to plan, review and/or certify various projects as needed throughout the term of the contract. These projects may or may not be part of the long range facility plan. Additionally, any firm selected may be required to assist in planning for a bond election. A list of the Specific Project Scope of Work for this RFQ is included in ATTACHMENT “C”. The District reserves the right to adjust the Scope of Work and completion schedule at any time based on district budget and current district needs. Each respondent will be asked to complete a questionnaire, which illustrates the firm’s information, experience, financial information, available services, and references. Firms desiring to be considered are asked to provide all information requested in Attachment “A”. A panel made up of the Pewitt Consolidated ISD Administration will evaluate this information. This panel may then select a firm or firms to be recommended to the Board of Trustees. The Board will select a firm or firms, based on qualifications, to perform professional services as per the Scope of Work included in Attachment “C”.

INSURANCE Prior to performing Architect’s services, the Architect will be required to procure and maintain, with a company or companies authorized to do business in the State of Texas by the Texas Department of Insurance and satisfactory to the District, such insurance that will protect the Architect and the District from claims as set forth below, which may arise out of, or result from, the operations under the contract. 6. All such policies of insurance shall contain a provision that they shall not be cancelled or altered nor the amount of coverage reduced until at least thirty (30) days after notice of such cancellation, alteration, or reduction has been delivered to the District. The general and automobile liability policies shall name the Pewitt Consolidated Independent School District as an additional insured. 7. An “Original Certificate of Insurance” will evidence compliance with the insurance requirements and must be submitted with the packet. 8. Other insurance requirements as agreed upon in the contract attachment for each individual project. IDEMNIFICATION CLAUSE TO THE FULLEST EXTENT PERMITTED BY LAW, THE ARCHITECT SHALL INDEMNIFY THE OWNER FROM AND AGAINST ANY AND ALL LIABILITY FOR DAMAGES ARISING OUT OF OR RESULTING FROM THE ARCHITECT’S PERFORMANCE OF ITS WORK, BUT ONLY TO THE EXTENT SUCH DAMAGES ARE CAUSED BY OR RESULT FROM AN ACT OF NEGLIGENCE, INTENTIONAL TORT, INTELLECTUAL PROPERTY INFRINGEMENT, OR FAILURE TO PAY A SUBCONTRACTOR OR SUPPLIER COMMITTED BY THE ARCHITECT, THE ARCHITECT’S AGENT(S), THE ARCHITECT’S CONSULTANT(S) UNDER CONTRACT, OR ANY OTHER ENTITY OVER WHICH THE INDEMNITOR EXERCISES CONTROL. NON APPROPRIATION OF FUNDS If the Board of Education for any reason fails to appropriate funds for the service, the district will notify the vendor immediately and the district will no longer be obligated to fulfill its responsibilities under the contract.
MULTIPLE PROVIDERS The District reserves the right to award this contract to multiple providers if this is the best and most efficient selection method to insure due diligence to the District. SPECIAL TERMS AND CONDITIONS The successful firm(s) must have the necessary capability of delivering the requested service in complete compliance with the description and features contained in this request. The firm(s) shall maintain in a company or companies lawfully authorized to do business in the State of Texas such insurance as will protect the firm and the district from claims set forth which may arise out of or result from the firm’s operations under the contract and for which the firm may be legally liable, whether such operations be by the firm or anyone directly employed by the firm or by anyone for whose acts the firm may be liable. The firm shall purchase and maintain the insurance as described in the Insurance Requirements in this document. Failure of the firm to maintain adequate insurance coverage shall not relieve the firm of any contractual responsibility or obligation. The successful firm shall be responsible for damage or breakage caused by their employees. The firm must report such damage to the District. The District reserves the right to make the repairs and charge the firm for the damaged incurred. Texas Education Code Chapter 22, Subchapter C requires service vendors of school districts in Texas to obtain criminal history record information regarding covered employees and to certify to school districts that they have done so. Covered employees with disqualifying convictions are prohibited from serving at a school district. Service firm must obtain the criminal history record information on all existing employees who will have continuing duties relating to this contract. In the event that the successful firm requires a separate agreement, in addition to the terms, conditions, and specifications of the submittal, a copy of the agreement must accompany the submittal. The agreement will have to be approved by the District’s attorney prior to the award of the contract. The submittal document shall govern in the event of conflict with the terms of a vendor’s agreement. APPLICATION SIGNATURE Until a contract resulting from this process is executed, no employee, agent or representative of any professional services provider shall make available or discuss its submittal with the press, any elected or appointed official or officer of the District, or any employee, agent or other representative of the District, unless specifically allowed to do

ATTACHMENT B REQUEST FOR QUALIFICATIONS ARCHITECTURAL / ENGINEERING SERVICES PROCUREMENT PROCESS Selection of Qualified Providers: A committee of Pewitt Consolidated ISD Administrative staff will review responses submitted. Based on the “evaluation” and selection criteria described in this document, the committee will select a short-list of respondents. Pewitt Consolidated ISD anticipates selecting one or more firms for presentation to the Board of Trustees for approval. When needs arise, the District will select an approved firm based on District needs and requirements. Recommendation of Firms: The Pewitt Consolidated ISD review committee will recommend a firm(s) for Board of Trustee approval.
EVALUATION CRITERIA Qualifications of all business entities will be evaluated using the following selection criteria. a. Corporate Background & References (20%) b. Financial Qualifications (10%)
Firm will provide financial documents which provide evidence of financial stability. Firms shall submit audited financial statements including income statement, balance sheets and statements of changes for three (3) most recently completed fiscal years. If audited financial statements are not available, provide evidence of the level of third party review of the financial statements. Forms may also provide documenting source(s) and levels of financing (e.g. a letter from a financial institution describing a relationship with the Firm). F.

ATTACHMENT C REQUEST FOR QUALIFICATIONS PROJECT SCOPE OF WORK General Scope of Work The Pewitt Consolidated Independent School District Board of Trustees plans to call a general bond election for renovations, additions, and new school construction for Pewitt Consolidated Schools within the next few years. Architectural Long Term Facility Planning Services and Bond Planning Services will be required prior to the calling of a bond election. Pewitt Consolidated ISD will receive statements of qualifications from qualified architectural firms in an effort to select a firm(s) to produce a comprehensive 10 Year Strategic Facilities Master Plan. This Plan will be used to provide Bond Programming Planning Services and educational presentational material for the District. All materials produced will be used by the District to communicate the 10 Year Strategic Facility Planning Needs and Bond Planning Program to the Pewitt Consolidated community. The selected firm will also be called to plan, review and/or certify various projects as needed throughout the term of the contract. These projects may or may not be part of the long term facility plan.
Specific Project Scope of Work The Board of Trustees will retain the professional services of an Architectural / Engineering Firm(s) to produce the following Bond Program Planning: • Review, research, and analyze the existing demographic studies and student enrollment data maintained by the District to project future student growth within the district. Using this data and current enrollment data, project future facility planning projects required for PCISD for the next 10 years. • Review PCISD’s current grade configuration structure. Research, analyze, and recommend any and all changes required to best serve the Pewitt Consolidated community and students of PCISD in providing future Pewitt Consolidated school for service and use. • Review, research, analyze, and validate/ justify the District’s current Strategic Plan and its related planning and facility assessment data to recommend projected facilities /buildings to serve PCISD. Include in this building recommendation estimated project costs for all planned facilities. • Provide Pewitt Consolidated ISD with an updated comprehensive 10 Year Strategic Facilities Master Plan for all existing and projected facilities for the District.
• Provide the District with updated individual architectural / engineering project space and building programing for all existing and proposed new facilities with total estimated project costs projections. • Produce public educational bond planning materials and multimedia presentations as required to educate the Pewitt Consolidated community concerning future facility needs as addressed in the revised 10 Year Strategic Facilities Master Plan. • Provide the District with current educational and school design research which justifies the needs and rationale for building new schools, renovating existing schools, or adding to schools for Pewitt Consolidated ISD. Research data shall justify any needs for Pewitt Consolidated ISD to pursue a future bond submittal with the intent to provide Pewitt Consolidated with facilities that support 21st Century education.
Texas Education Code Section 44.034, Notification of Criminal History. Subsection (a), states “a person or business entity that enters into a contract with a school district must give advance notice to the district if the person or an owner or operator of the business entity has been convicted of a felony. The notice must include a general description of the conduct resulting in the conviction of a felony.” Subsection (b) states “a school district may terminate contract with a person or business entity if the district determines that the person or business entity failed to give notice as required by Subsection (a) or misrepresented the conduct resulting in the conviction. The district must compensate the person or business entity for services performed before the termination of the contract.”
