Counsel and Media Focuses On Company Safety & Compliance History 3/28/2013 Jury awards $58.5 million to family, says truck driver not adequately trained By David Tanner, Land Line associate editor The jury in a wrongful death lawsuit in Santa Fe, NM, has awarded the family of a crash victim $58.5 million, saying the driver of a tanker truck that made a left turn in the path of the victim’s oncoming vehicle did not have adequate training. The bulk of the responsibility for the crash lies with the management company that contracted with the trucking company, the jury said. ……… The award consists of $11.5 million in actual damages and $47 million in punitive damages to Santa Fe Trust, a fund set up for Udy’s family.

A glimpse into the safety and compliance history for Standard E&S shows the company in alert status in the driver fitness and vehicle maintenance categories in the public database Compliance, Safety, Accountability, known as CSA. Over the course of the past two years, the company underwent 139 inspections, with 13 of those producing driver violations. Of those, five are attributed to “driver lacking valid license for type of vehicle being operated.” Each one came with an out-of-service order. Standard E&S had one violation during that timeframe for “operating a CMV while fatigued,” and one violation for “requiring or permitting (a) driver to drive more than 11 hours.” Each of those carries enough weight to push the company into alert status in the driver fitness category, or BASIC. In the vehicle maintenance BASIC, the 139 inspections produced a 37 percent outof-service rate. The most serious violations consisted of one incident of defective leaf springs; one broken torsion bar; flat, underinflated or bald tires; three steering violations; and at least 33 incidents of defective or missing lights.
In terms of hours-of-service compliance, the company had some form-and-manner violations but was within the compliance threshold in the HOS BASIC. January 28, 2014 (MAYWOOD, Ill.) (WLS) -- Temperatures were well below zero Monday night when a truck crashed into a police car and another truck on the interstate in the western suburbs. The trucker accused of causing the crash that killed an Illinois Tollway worker and critically injured a state trooper has been charged. …..Authorities say Petrella, who worked for the tollway, was killed while helping a stranded semi-driver on the shoulder of I-88. Also there was state trooper Douglas Balder. His police lights were flashing, say officials, when another truck driver, 46-year-old Renato Velasquez, slammed into the stopped vehicles which then burst into flames. Petrella died at the scene, but Balder managed to crawl from his burning car. "He is expected to make it, but right now he does have some extensive injuries," said Hiram Grau, director, Illinois State Police. On Tuesday night, Velasquez was charged with four felonies related to driving while fatigued and beyond his approved hours. Motorist Paul Anzell says he witnessed the crash and believes Velasquez was driving behind another semi in the lane closest to the shoulder. "The first truck did get off that lane. The second truck, he never moved. He just kept going straight, no tail lights went on, no break lights. He just went right into it, and everything exploded," said Anzell. ….. I-Team: Trucking company records reveal past fatal accident Safety records reveal a pattern of problems for the trucking company involved in Monday night's fatal crash. The owner of the Naperville trucking firm DND International spent Tuesday afternoon with federal motor carrier inspectors and Illinois State Police. This isn't the first deadly accident that a DND truck has been involved in. Law enforcement and truck safety records reveal a DND truck in a fatal accident on I-55 in Sangamon County in August of 2012. The driver of the other truck died, but DND's owner says that one wasn't her driver's fault. "You can't be in the truck with the drivers so as much as we can do we control them. But I'm not there in there so I don't know what they do. Only thing I know, my drivers logs that I receive. It's all good." DND has 42 trucks in its fleet. Federal safety records reveal six crashes the past years and a host of safety violations: not-compliant driver work records and moving violations-mostly for speeding.
