Risk Manager Codified Evidence Rules Pass Virginia Legislature By: Erin McNeill. Wednesday, March 14th, 2012 Huzzah! The codified Rules of Evidence has passed the Virginia’s legislature after some late opposition from four Senators. The Sands Anderson Risk Manager blog first reported on the proposed rules back in October. In a comment to that article, attorney and then-President of Sands Anderson Pierce Rucker noted, “We certainly have [Sands Anderson's] own Bunky Miller to thank, and many of his colleagues around Virginia, who toiled so tirelessly for years, mostly in anonymity, to bring to fruition the Guide to Evidence in Virginia under the auspices of the Boyd-Graves Conference/VBA and upon which the rules recently approved by the Supreme Court are based.” (Frank “Bunky” Miller became one of four named partners at the firm when the firm was named “Sands Anderson Marks and Miller” in 1978. Although the passage of the Rules of Evidence was not intended to be an anniversary gift, it seems serendipitous that the rules passed today, given that Miller will be recognized tomorrow for 50 years of active membership in the Virginia State Bar by the Richmond Bar Association at their March 15th luncheon. If signed into law by the governor, the rules will go into effect July 1, 2012. Passage of the Virginia Rules of Evidence leaves Massachussetts as the only state without codified evidence rules.
