OVERVIEW: The Petitioner owns the undeveloped Prairie Creek Subdivision lots and requests to combine Lots 120, 121 & 122 into 2 lots through a Certified Survey Map (Lots 1 & 2). The petitioner is also requesting a rezone of the property to allow for 4-unit buildings on the newly create Lots 1 & 2.

PLANNER COMMENTS: Staff provides the Village of Windsor Plan Commission with the following planning comments: Certified Survey Map 1.

Chapter 38, Article IV, Division 8 of the Windsor Code of Ordinances requires dedication of park land (or fees in lieu) and park improvement fees for all new residential development in the Village. The 3 existing lots allow 2 dwelling units on each lot for a total of 6 units. The proposed 2 lots would allow 4 dwelling units on each lot for a total of 8 units. Fees in lieu of park land and park improvement fees for the additional 2-units should be collected per Sec. 38-636 and Sec. 38-638.

Rezone 1.

The Future Land Use category for this portion of the Prairie Creek subdivision and the Pleasant Hill Estates subdivision to the east is Mixed Residential which allows a gross density of 4 to 12 dwelling units per acre. In addition, lots directly north and east are currently zoned MF-3, although currently vacant. Directly south is the Village of DeForest business park. The requested rezone from MF-2 to MF-3 is compatible with the surrounding zoning and Comprehensive Plan.

Staff Review 2.

The MF-3 zoning district requires a minimum of 16,000 SF of lot area for the first 3 units and 2,000 SF for each additional unit. Lot 1 of the proposed CSM is 0.493 SF and Lot 2 is 0.468 SF, which would potentially allow 5 dwelling units on each lot unless limited to 4 dwelling units through the approved conditions.

SURVEYOR COMMENTS: Staff provides the Village of Windsor Plan Commission with the following survey comments: 1.

Each sheet of the CSM should be signed, sealed and dated by the surveyor.

A graphic scale should be included on sheet 3 of 5.

The south dimensions for Lot 1 and Lot 2 should be 151.50’.

STAFF RECOMMENDATION: Depending on confirmation by the Village of Windsor Plan Commission of the above described comments, the Village of Windsor Plan Commission may take the following action: The Village of Windsor Plan Commission recommends to the Village of Windsor Board Conditional Approval for the Certified Survey Map & Rezone request for State at Main Development LLC (c/o Tom Jones) being all of Prairie Creek Subdivision Lots 120, 121 & 122, located in the NE ¼ of the NW ¼, Section 32, T9N, R10E, Village of Windsor, Dane County, Wisconsin, subject to the following conditions: 1.

Certified Survey Map a.

The Petitioner shall address the technical comments set forth in the Surveyor Comments section of this Staff Review to the satisfaction of the Village Planner.

b.

The Petitioner shall satisfy all conditions of approval by the Village of Windsor and any other approving authorities, and shall thereafter promptly record the Certified Survey Map with the Dane County Register of Deeds.

c.

The Petitioner shall submit cash payment to the Village of Windsor for Fees in Lieu of Land in the amount determined pursuant to Section 38-636(b) of the Village of Windsor Code of Ordinances prior to the Village signing the Certified Survey Map.

d.

The Petitioner shall submit cash payment to the Village of Windsor for Fees for Initial Improvement of Parkland in the amount determined pursuant to Section 38-638(e) of the Village of Windsor Code of Ordinances prior to the Village signing the Certified Survey Map.

Rezone a.

Lots 1 & 2 of the proposed CSM shall be limited to a single 4-unit residential building on each lot.

b.

The Rezone shall have a delayed effective date, and shall take effect at such time as the accompanying 2Lot CSM has been recorded in the Dane County Register of Deed’s office.

The Petitioner shall promptly reimburse the Village of Windsor for all costs and expenses incurred by Windsor in connection with the review and approval of the CSM and Rezone, including, but not limited to, the cost of professional services incurred by the Village of Windsor for the review and preparation of required documents, attendance at meetings or other related professional services.

4.

The Village Plan Commission’s recommendation expires one hundred-eighty (180) days from the date of adoption of this Resolution. Time is of the essence. If the Village Board is unable to or does not act on the Plan Commission’s recommendation prior to expiration, then this matter shall be re-referred to the Plan Commission prior to further action by the Village Board.
