FOOD AND BEVERAGE KIOSK FABRICATOR REQUEST FOR PROPOSALS Issue Date: November 8, 2017 Submission Date: November 17, 2017 (5:00 PM EST)

I.

INTRODUCTION

The Downtown Brooklyn Partnership, Inc., a New York not-for-profit corporation with an office at 1 MetroTech Center, Suite 1003, Brooklyn, NY 11201 (“Owner”) is seeking proposals from highly qualified individuals or companies (“Proposers”) in connection with the following project (the “Project”): Construction and installation of Two (2) Food Service Vending Kiosks to be located at Albee Square and Willoughby Plaza, Brooklyn, New York. II.

PLAZA LICENSE AGREEMENT INFORMATION

Albee Square Plaza and Willoughby Plaza were constructed and installed by the New York City Department of Transportation (“DOT”). The Downtown Brooklyn Partnership has a concession license agreement (“License Agreement”) with DOT for the operation, management and maintenance of the Plaza allowing for the operation and management of subconcession(s), where no leasehold or other proprietary rights are offered. III.

CONCEPTUAL DESIGN

The Downtown Brooklyn Partnership has worked closely with WXY Architects to develop a conceptual design and site plan for the Kiosk. The Fabricator is expected to adhere to this conceptual design and to work closely with The Downtown Brooklyn Partnership through a design-build process to navigate the fabrication process in accordance with this design. The Fabricator’s program and design requirements for the Project are posted online http://downtownbrooklyn.com/about/partner-with-us/jobs-rfps and attached hereto for the conceptual design plans prepared by WXY Architects (the "Architect"). The design, engineering, fabrication, and installation of two temporary structures to serve as food-serving kiosks For chosen scheme, review Architectural drawings, details and specifications and provide comments. Installation includes setting units, leveling the units with bearing plates, and anchoring each unit to its respective plaza. Installation also includes assisting with the electrical connection of the circuit breaker panel to electricity provided by others. Generate seed CAD details for pedestal supports, framing, connections, anchors, interface details, etc Develop and expand a Basis of Design document to generate a Structural Report that quantifies target performance criteria, framing layout, loads (live/wind/ice/seismic/thermal etc). Carry out pre-engineering of systems to confirm system depths, framing, connection configurations, etc Issue signed and sealed Engineering package covering structural design and loads imposed to sub-structure EXCLUSIONS

Design development • Design-Build services • Engineering- engage a New York State licensed Professional Engineer to provide calculations and signed and sealed shop drawings for use during fabrication upon approval by New York City Department of Transportation and Downtown Brooklyn Partnership Structural framing • Structural framing- framing to be constructed of rectangular tubular steel in varying sizes • Wall framing-minimum wall framing depth to provide a cavity allowing for rigid foam insulation and concealed wiring and piping within wall cavity. • Roof framing- designed to support water storage tanks which hold approximately 150 gallons of water • Floor structure- designed to accommodate anticipated floor loads consistent with food and beverage operations and provide an area for wastewater holding tanks • Doors- one personnel door at side and one aircraft hangar style door to operate as depicted in design drawings • Rigging- Structure will contain rigging points on roof for setting place and potential future relocation Exterior • Cladding- architectural cladding using stainless steel panels with 2B finish and minimum gauge thickness of 20ga; panels will be constructed with solid backing material of ¾” thickness; exterior panels will form a weather tight enclosure. • Doors- loading bay door and man-door • Signage- 2 lighted poster-sized signage display boxes on exterior for public messaging • Roofing- clad with sheet steel in thickness adequate to support anticipated live and snow loads, provides roof-curbs for equipment, penetrations and drainage Equipment150 gallon fresh water holding tanks. Roof will be treated to provide a water tight enclosure and have appropriate drainage piped to internal vertical leader that spills out at floor level. Interior • Insulation of wall cavities, roof and floor structure floor and ceiling. • Interior wall surfaces and ceiling to be clad with plastic laminate adhered to solid backing material of ¾” thickness. • Interior wall panels mounted with exposed fasteners for easy access to wall cavity for future work. • Floor to be constructed of 1- 1/8” plywood sub-floor material and covered with commercial grade rubber flooring. Electrical • Electrical loads to be evaluated and a load center with circuit breakers to be installed in the interior of the unit. • Circuits to be run out to locations as designated by vendors and specified receptacles will be installed at each designated location. 6 high voltage (208v AC or 230v AC) circuits are included in this scope. • Receptacles to be flush mounted. 3

Low voltage (120v AC) convenience power to be provided at 10 locations within the unit. Electrical lighting and switching to be included as indicated in design drawings. Electrical power to be provided to all equipment included in scope of work- roof vent fan, heaters, heating mats, lighted sign boxes, etc. Electrical stub-up and feeders is to be provided by others.

HVAC • Unit heaters for maintaining temperatures above freezing during winter months (freeze/ frost protection) • Roof-mounted 2500cfm exhaust fan for connection to hood, and a penetration through the roof with curb and cover for potential future AC unit (hood and connection of hood to exhaust fan excluded, future AC unit excluded) 7. Plumbing • 2 roof-mounted supply tanks with piping between tanks and 1 interior location • 1 sanitary drain piped to wastewater holding tank in floor structure • All tanks to have thermostatically controlled heating mats that prevent freezing during winter months • Wastewater tank to have evacuation connection at exterior rear of unit and evacuation pump. • Point-of-use hot water heater and any other plumbing scope exluded) • Plumbing of water holding tank, wastewater tank and associated in-wall piping and point-of-connection 8. Delivery, rigging and site installation • Delivery and installation of kiosks to locations approved by NYC DOT in Willoughby Plaza and Albee Square Plaza • Installation methodology involves setting the units in place, leveling and assisting with electrical connection of circuit breaker panel to stub-up and feeders VII.

PROPOSAL SUBMISSION PROCESS

Proposals received after the Closing Date will not be accepted. Proposals will be evaluated on the basis of content, as described below. Questions should be submitted no later than 11: 5 9 PM o n 11 /13/2017. Questions and responses from the Downtown Brooklyn Partnership will be shared by COB on Tuesday 11/14/2017. A. Proposals shall contain the following: 1.

Statement of qualifications including but not limited to the number of years of experience providing fabrication services, a list of past projects, letters of reference and examples of other kiosk fabrication work if applicable; B. If selected, the fabricator must show proof of the following: 1.

Complete copies of all relevant permits, licenses, operating certificates and other documents that provide or otherwise evidence the Proposer’s due authorization to fabricate and install and temporary structure in the City of New York must accompany its response to this Proposal, together with copies of any violations issued by any relevant city, state, or federal agency received in the last three years, and their status

Commercial General Liability with policy limits of not less than Three Million Dollars ($3,000,000) for each occurrence and Five Million Dollars ($5,000,000) in the aggregate for bodily injury and property damage. 3. Automobile Liability covering vehicles owned by the Design-Builder and non-owned vehicles used by the Design-Builder with policy limits of not less than One Million Dollars ($1,000,000) per claim and One Million Dollars ($1,000,000) in the aggregate for bodily injury, death of any person, and property damage arising out of the ownership, maintenance and use of those motor vehicles 4. The Design-Builder may achieve the required limits and coverage for Commercial General Liability and Automobile Liability through a combination of primary and excess liability insurance, provided that such primary and excess insurance policies result in the same or greater coverage as those required by DBP. 5. TERMS GOVERNING REQUEST AND SELECTION

The Downtown Brooklyn Partnership will review all Proposals for completeness and compliance with the terms and conditions hereof. The Downtown Brooklyn Partnership reserves the right to request additional materials, including those it may deem useful or appropriate to evaluate each Proposer’s qualifications and past experience, or clarification or modification of any submitted Proposal. Submission of a Proposal shall constitute the Proposer's permission to The Downtown Brooklyn Partnership to make such inquiries concerning the Proposer as The Downtown Brooklyn Partnership in its discretion deems useful or appropriate. The Downtown Brooklyn Partnership is not obligated to make any such request or to accept any unsolicited materials, clarification, modification or background information. The Downtown Brooklyn Partnership may conduct discussions with Proposers submitting acceptable proposals but it also may award a sublicense with no further discussions. The Downtown Brooklyn Partnership reserves the right, in its sole discretion, to reject at any time any or all Proposals, or to withdraw this Request without notice. The Downtown Brooklyn Partnership will select the Proposer which, in the sole judgment of The 5

Downtown Brooklyn Partnership and approved by DOT, most successfully demonstrates the necessary qualities to undertake the project. The Downtown Brooklyn Partnership reserves the full right to reject all Proposals if it so chooses. Under no circumstances will The Downtown Brooklyn Partnership pay any costs incurred by a Proposer in responding to this Request. The review or selection of a Proposal submitted by a Proposer will create no legal submission or equitable rights in favor of the Proposer, including, without limitation, rights of enforcement or reimbursement. Failure by The Downtown Brooklyn Partnership for any reason to select a Proposer or to enter into an agreement with a Proposer once selected as a result of this Request will not create any liability on the part of The Downtown Brooklyn Partnership or any of its members, officers, employees, agents, consultants or other Proposers. Submission of a Proposal in response to this Request will constitute a waiver of any claim against any of the foregoing for any costs incurred or for any matters arising thereunder or in connection with the review of such Proposal by The Downtown Brooklyn Partnership. The successful Proposer shall be required to complete and file VENDEX questionnaires if the aggregate value of City contracts during the immediately preceding twelve-month period equals or exceeds $100,000.
