PURPOSE To review and approve the Milliken Town Center Subdivision and Site Plan for the Milliken Police Station and Meeting House. Approval of this subdivision and site plan is one of three companion actions necessary by the Town to allow for the construction of a new Police Station, municipal court, community meeting room, park and public plaza in downtown Milliken. The other two actions are approval of a rezoning and development plan, and the vacation of the adjoining alley. BACKGROUND and ANALYSIS: A Minor Subdivision plat and site plan has been completed by Frederick Land Surveying, Inc. and the Town’s architect, Ross-Sheppard Architects, to meet the requirements of the Land Use Code. A subdivision replat and site plan must be reviewed and approved by the Town before development can begin for the new Police Station, municipal court, community meeting room, park and public plaza. The Milliken Town Center Subdivision (sheets 1and 2) meets all the submittal criteria of the Land Use Code. The subdivision is considered a minor subdivision final plat because this site was previously platted within the town. The existing property parcels, lots 10-23 along with the north 5 feet of Broad Street abutting Lots 12 to 16 on the south of Block 37, Milliken Subdivision and the south 12.5 feet of Lot 10 and Lot 11 to 23, Block 38 Milliken Subdivision are being replatted to Lot 1, Block 38 and Lot 2, Block 37. This subdivision replat will eliminate lot lines presently located under existing and proposed buildings on the site.
The Subdivision Regulations require review by the Planning Commission and approval by the Town Board of a site plan before building permits can be issued. The site plan for the Milliken Police Station and Meeting House meets the following criteria as enumerated in the Subdivision Regulations. 1. All of the information required on site plan is shown. Staff comment: All required information for the site plan is shown. 2. The lot size and lot dimensions are consistent with what is shown on the approved final plat. Staff comment: This requirement is met. 3. No buildings or structures infringe on any easements Staff comment: No existing or proposed buildings exist on any easements. 4. The proposed site grading is consistent with the requirements of the current Town of Milliken Master Drainage Plan, on file at the Town Hall. Staff comment: The site grading has been approved by the Town’s consulting engineer, Lamp Rynearson, and is consistent with Town requirements. 5. The density and dimensions shown conform to the density and dimensional standards at Section 16-3-490 of this Chapter or to the approved PUD requirements. Staff comment: The density and dimensions conform to the MU-C-D zone district standards and Section 16-3-490. 6. The applicable community design principles and development standards have been adequately addressed and the proposed improvements conform to Article II of this Chapter. Staff comment: The proposed improvements conform to Milliken Downtown Commercial Standards and Article II of the Land Use Code, except as may be waived by the Town Board. A General Development Information narrative is enclosed that provides a discussion of the proposed site design and use of the site. The site plan contains the drawings for the site layout (Sheet C1.00), demolition of existing buildings (Sheet C2.00), site grading plan (Sheet C3.00), utility plan (Sheet C4.00), drainage (Sheet C5.00), photometrics (Sheet E1.0), landscaping (L1.00) and a cover sheet (C0.00). The cover, photometric and landscaping sheets have some minor technical corrections that need to be made, and these can be made prior to signing and recording the documents. The Planning Commission at their May 7 hearing approved the minor subdivision and site plan by a vote of 4-0. From the discussion at the hearing the Planning Commission asked the staff to look into three issues regarding screening of the site from the property to the north, traffic circulation through a property to the north and possible safety issues involving the detention pond. The first issue involved a concern by the property owner to the north that the site should be screened to separate his property from the Town’s. The site plan shows that landscaping will be installed up to the shared property line. Staff determined that if the lack of screening becomes a problem in the future this issue can more clearly defined and addressed then. The second issue is a concern expressed by
the adjoining property owner to the north that people sometimes drive vehicles through his property, from Ethel Ave. to Frances Ave. Frances Ave. is posted with a ‘No Outlet’ sign. Staff feels it is the responsibility of the property to address this problem, possibly by placing a ‘No Trespassing-No Vehicle Access’ sign in his front yard or gating his property. The third issue involves the detention pond and possible safety issues if someone were to fall into the pond and if the pond were to be full of water thus presenting a possible drowning hazard. Staff feels that because of the dense planning of shrubs within the pond and along its sides that this should make a falling hazard improbable. The pond will be dry most of the year and it will contain runoff water only on an infrequent basis. No additional design measures need to be taken. STRATEGIC PLAN GOAL(S) IMPLEMENTED The Milliken Comprehensive Plan 2004 designates a Downtown Commercial Mixed Use Development District for the Milliken Town Center site and surrounding area. The proposed Milliken Town Center Subdivision site will provide a number of civic uses that are consistent with the downtown mixed use concept of the Comprehensive Plan. In addition, the site plan shows cross walks on Broad Street, Ethel Avenue, and Frances Avenue that meet the intent of the following Transportation Plan Policies: T.2.B Provide safe pedestrian crossings at key intersections on Broad Street. Improve pedestrian access in existing neighborhoods and require good pedestrian connections with all new development. BUDGET IMPLICATIONS None PLANNING COMMISSION RECOMMENDATION
The Planning Commission recommends approval of the Milliken Town Center Subdivision and Milliken Police Station and Meeting House site plan with a condition that minor technical corrections, as required by Town staff, be made prior to signing and recording of the site plan document. SUGGESTED MOTION “I move that the Milliken Town Center Subdivision and the Milliken Police Station and Meeting House site plan be approved with the condition that minor technical corrections, as required by Town staff, by made prior to signing and recording the site plan document. ”
ORDINANCE NO. 584
AN ORDINANCE REPLATTING REAL PROPERTY KNOWN AS THE TOWN OF MILLIKEN SUBDIVISION IN THE TOWN OF MILLIKEN, WELD COUNTY, COLORADO. Section 1. WHEREAS, the applicant and owner of the property has submitted an application and paid the attendant fee for the replat of Blocks 37 and 38 of the Town of Milliken Subdivision; and, WHEREAS, pursuant to the Land Use Code of the Town of Milliken, the Planning and Zoning Commission and the Board of Trustees have determined that the hereinafter-described area of the Town requires this replatting. Section 2. NOW THEREFORE BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF MILLIKEN, WELD COUNTY, COLORADO: Lots 10 to 23, along with the vacated North 5 feet of Broad Street abutting Lots 12 to 16 on the South, Block 37, Town of Milliken Subdivision and the South 12.5 feet of Lot 10 and Lots 11 to 23, Block 38, Town of Milliken Subdivision being a portion of the Town of Milliken, Weld County, Colorado, are hereby replatted as Lot 1 and Lot 2 of Milliken Town Center Subdivision described in the legal description attached hereto as Exhibit A and incorporated herein by reference. Section 3. Effective Date: The Board of Trustees of the Town of Milliken herewith finds, determines and designates that this Ordinance shall take effect and be in force 30 days after publication. At its meeting June 11, 2008 this Ordinance was read, passed and ordered published by the Board of Trustees.
