By CCA Chair Matthew Bowser and the Senators of the CCA Committee, we call for the University of Massachusetts Boston to include language in the student code of conduct protecting substance abuse users, who in good faith, seek medical assistance for a drug-related overdose.

The University of Massachusetts Boston Be it enacted by the Senate of the Undergraduate Student Government assembled, and by the authority of the same, as follows: WHEREAS, The University of Massachusetts Boston is an urban public state university; WHEREAS, currently it is a violation under the alcohol, drug, and smoke-free policy in the student code of conduct; WHEREAS; the University lacks a policy protecting students seeking medical treatment and for any reporters of the incident who may also be using the substance; WHEREAS, a policy of this nature would promote a safer school environment; WHEREAS, student safety should be our University’s utmost concern allowing all substance overdoses to be reported for medical attention without repercussion; WHEREAS, the Commonwealth of Massachusetts state law legally protects persons with good faith reporting substance overdoses under Part I Title XV Chapter 94C Section 34A allowing illegal substance users with no intent to distribute, to seek medical attention for themselves or others due to overdosing without repercussions of the law; WHEREAS, The University of Massachusetts Dartmouth abides by a Medical Amnesty Policy that promotes reporting of overdoses without code of conduct repercussion; WHEREAS, the construction of residence halls creates the possibility of an increase in substance abuse use on campus grounds; WHEREAS, there have been reported accounts of substance presence on campus from the Public Safety crime statistic yearly reports; WHEREAS, the more students seeking out medical attention for substance abuse promotes more students to get help with their addictions; WHEREAS, punishing substance abusers does not adequately address the reasoning for their use; Be it resolved that this Undergraduate Student Government hereby recommends that the University of Massachusetts Boston, should amend the student code of conduct to provide amnesty for student reports of good faith of substance overdoses. Be it also resolved that this will promote safety to our students and to allow these students to get help with their substance use problems.
