The World of the Chief of Engineers Authorities • Statutes establishing the Duties of the Chief of Engineers (not inclusive).

• CoE is designated as the Chief of the Engineer Branch under Title 10 U.S.C., Sec 3036. • Military construction shall be carried out under the direction and supervision of the SecArmy, acting through the CoE under Title 10 U.S.C., Sec 2851. • Navigation and flood control projects must be executed under the direction of the SecArmy and supervision of the CoE, unless specified otherwise by law, codified under Title 33, U.S.C, sec 540 & 701b. • CW emergency authorities permit the CoE to expend funds in support of preparation for and in support of flood fighting, rescue operations, flood control, repair and restoration of flood protection, emergency dredging, and provide emergency supplies of clean water under PL 84-99 • Plans, proposals, reports of the CoE for any works of improvement for navigation or flood control shall be submitted to Congress per Title 33 U.S.C., Sec 701-1.

Maintenance Deficiency Correction Period (MDCP) • A one year and one-time only grace period. • Allowed public sponsors time to correct unacceptable project maintenance deficiencies before being placed in an inactive status. • MDCP required sponsors to submit a correction plan including: • a schedule for correcting the deficiencies; • a summary of the interim actions to be taken; • an evacuation plan to reduce the flood risk created by the deficiencies; and • an outreach plan to notify the public of the deficiencies and correction process

10 Communities Notified • 5 are currently Inactive in the PL84-99 program • 3 did not provide adequate plans and were inactive April 2007 • 1 had significant deficiencies that could not be corrected within the MDCP placed inactive in May 2007 • 1 placed inactive in October 2007 due to significant schedule slippage, lack of progress, and local funding issues

• 3 are currently completing the correction of the deficiencies and are on schedule to complete by the January 31, 2008 deadline • 2 have requested extensions to the MDCP due to environmental permitting concerns and local funding referendums

National Levee Safety Program The program will help achieve three goals: • 1) Reduce risk and increase public safety through an informed public, empowered to take responsibility for its safety; • 2) Develop a clear national levee safety policy and standards; and • 3) Maintain a sustainable flood damage reduction system that meets public safety needs.

Basic Levee Certification Requirements Per 44 CFR 65

• Official determination by FEMA that a levee protects against base flood (1% event). • Defines flood insurance zones and rates which impacts grants, mortgages, emergency relief, and land management policies of local community. • To certify levee performance, engineering analysis by a registered professional engineer is required • Demonstrate a high degree of assurance of protection for the base flood. • Freeboard requirement: – Riverine: Minimum 3 ft., another foot by structures, up to foot less elsewhere depending on uncertainly analysis; – Coastal: 1 ft. above 1% wave or maximum run up (2 ft. minimum).

• Closures by engineered devices as part of levee system. • Embankment protection: – Erosion protection and seepage integrity from erosion; seepage analysis for base flood; foundation stability; settlement not to compromise freeboard; interior drainage.
