Use of Parking Spaces License Agreement between The Church of the Covenant and The Cleveland Hillel Foundation

This license agreement is between The Church of the Covenant (“Licensor”), 11205 Euclid Avenue and The Cleveland Hillel Foundation (“Licensee”), 11303 Euclid Avenue to state that Licensor is authorizing Licensee to use eight parking spaces on the curb along the north (rear) side of the church and two spaces in the front parking lot along the curb adjacent to the Hillel building (hereinafter the “designated spaces”). This agreement supersedes and terminates a longstanding unwritten agreement for ten spaces in the rear. That agreement predated any parking fees being collected by Licensor from vehicles using its parking facilities. This agreement is effective beginning June 1, 2016. Licensor hereby grants Licensee a revocable license for the use of the designated spaces. This license agreement may be terminated by either party as of the end of any calendar month upon giving at least 10 days written notice to the other party. The agreement will be on a monthly basis for use of the spaces Monday thru Friday between the hours of 6:00 a.m. and 10:00 p.m. No overnight parking is permitted. The two front spaces shall be at the current normal rate of $5 per day per space or $200 per month. The eight rear spaces shall be at a discounted rate of $100 per month. The total monthly fee shall be $300 per month, which monthly payment shall be made to Licensor on or before the first of the month in which the parking spaces will be used. At the Licensor’s current rate, this is a discount from $12,000 annually to $3,600 annually. Any vehicle parked in Licensor’s lot pursuant to this license agreement is parked at the risk of the Licensee or the owner. Licensor is not responsible or liable for any loss or damage to the vehicle, its contents or its owner. Licensee and any persons accessing Licensor’s property pursuant to this license agreement assume full responsibility for any personal injuries that may occur while a vehicle is present in the parking lot, or while it is entering or exiting the lot. Licensee hereby waives any claims against the Licensor for any loss, damage, or injury to person or property, or any other potential liability arising from the use of parking spaces on Licensor’s property. Licensor may, upon forty-eight (48) hours advance notice, by telephone, email or in writing, prohibit any use by Licensee of the designated spaces, for any period of time necessary to accommodate the needs of Licensor or its guests.

As part of this agreement, the Hillel Foundation will arrange for signs to be placed at the designated spots indicating that the spots are reserved for Hillel use Monday through Friday 6:00 a.m. to 10:00 p.m. These signs shall be approved by the Church of the Covenant before they are installed.
