Indemnity and Hold Harmless Agreement MALL WALKERS _________________________, hereafter referred to as (“Indemnitor”) agrees to indemnify and hold harmless Marelda Retail Development, LLC; Valdosta Mall, the shopping center owner, its agents, servants, and employees, from and against any and all claims arising from any act, omission or negligence of the Indemnitor or the Indemnitor’s contractors, licensees, invitees, agents, servants or employees or arising from any accident, injury or damage whatsoever caused to any person occurring within the Premises* or arising from any accident, injury or damage occurring outside of the Premises, whether such accident, damage or injury results or is claimed to have resulted from an act or omission on the part of Indemnitor, or Indemnitor’s agents, employees, independent contractors or invitees. *Applicable Hours (Mall Walkers Hours) are the non-operating hours of the mall, Monday – Saturday 7:30am – 10:00am and 11:00am – 1:00pm on Sunday Indemnitor agrees to use the Premises at its own risk and acknowledges that Marleda Retail Development, LLC; Valdosta Mall, the shopping center owner, its agents, servants, and employees, does not assume any responsibility whatsoever for any property of Indemnitor used by or brought by Indemnitor, its agents, servants and employees onto the Premises, and the Indemnitor will take whatever steps necessary to protect the same.
