ZONING AMENDMENT BYLAW NO. 3945

A Bylaw Amending Regulations Related to Agricultural Properties and Agricultural Uses _____________________________________________________________________________________

The Council of the Corporation of the City of Port Coquitlam enacts as follows: Citation 1.

This Bylaw may be cited for all purposes as “Zoning Amendment Bylaw No. 3945, 2016”.

Purpose 2.

The purpose of this Bylaw is to amend certain regulations applicable to agricultural properties and uses.

Bylaw Amendments 3.

That Section 1, Definitions be amended as follows: 1)

by deleting the definition for Accessory Residential;

2)

by replacing the definition for Agriculture with the following definition: “Agriculture means a use designated as a farm use in the Agricultural Land Reserve Use, Subdivision and Procedure Regulation.”;

3)

by replacing the definition for Animal boarding with the following definition: “Animal boarding means the provision of overnight boarding services for domestic animals and may include the provision of animal breeding or training services.”; and

4)

by adding the following definitions in alphabetical order: “Farm home plate means that portion of an agricultural lot that includes the farm residence and farm residence accessory facilities. Farm residence means a single residential building on a property located within the Agriculture zone. Farm residence accessory facility means a building, structure or improvement associated with a farm residence including a garage, carport, driveway, ornamental landscaping, artificial pond, greenhouse, sunroom, pergola,

workshop, tool shed, storage shed, swimming pool, tennis court and similar facility.” 4.

That Section II, Zones and Zone Regulations, be amended by replacing Section 1, Agriculture Zones with the following Section 1: “1.

AGRICULTURAL ZONES

1.1.

ZONE INTENT

Information Note: Where land is in the provincial Agricultural Land Reserve, all uses and regulations of this zone are permitted only if they are also permitted by the Agricultural Land Commission. 1.2.

Notes to Table 1.3 Note 1. The symbol ■ indicates that the use is permitted in the zone in question. Note 2. A boarding use is limited to accommodating no more than four boarders in a farm residence. Note 3. A child care facility is only permitted in a farm residence.

REGULATIONS FARM HOME PLATE 1)

A farm residence and all farm residence accessory facilities must be located within the farm home plate. The area of the farm home plate is limited to the greater of 10% of the lot area or 1000m2, up to a maximum of 2000m2. A farm residence must be entirely located within an area no more than 50 m from the front lot line or the exterior side lot line, whichever provides access to the farm residence. Farm residence accessory facilities on lots with a lot width of more than 33m must be entirely located within an area no more than 60 m from the front lot line or the exterior side lot line, whichever provides access to the farm residence.

Notes to Table 1.4 Note 1. A Type 1 agricultural structure means any building or structure that is used for agricultural purposes and uses such as farm retail sales, agricultural production or processing, greenhouses or a farm education and research facility unless specifically listed as a Type 2 agricultural structure. Note 2. A Type 2 agricultural structure means any building or structure that involves the keeping of swine or fur bearing animals or a medical marihuana production facility. Note 3. A lot with a greenhouse may have a lot coverage of up to 75% inclusive of all agricultural structures and agricultural structures other than a greenhouse on the lot may not exceed a cumulative lot coverage of 35%. Note 4. The floor area of a farm education and research facility is limited to 100m2. Note 5. Agricultural structures must be sited a. at least 30 m from all sand points, wells and streams;

b. for a Type 2 agricultural structure, at least 45m from properties in a residential zone; and, c. for a Type 2 agricultural structure that involves a medical marihuana production facility, at least 150m from all properties zoned P1 – Civic Institutional or P3 – Parks and Natural Areas or designated in the Official Community Plan as Park or Park Reserve.”

That Section III, Supplementary Regulations, Section 2, Accessory Buildings and Structures, subsection 2.3 be amended by deleting the following: “other than an accessory residential building in an agricultural zone”

That Section III, Supplementary Regulations, Section 2, Accessory Buildings and Structures, subsection 2.4 be amended by inserting “A” before “RS and RD”.

7.

That Section III, Supplementary Regulations, Section 4, Screening, Landscaping, Outdoor Storage and Fences, be amended by inserting the following new Subsection 4.6. and renumbering the other subsections accordingly “4.6.

In the A zone, a fence for an agricultural use to the rear of the front setback area is not subject to a height limit.”

That Section III, Supplementary Regulations, Section 5, Accessory Home Businesses, Section 5.4 be amended by inserting “A,” before “RS1 and RS3 zones”;

9.

That Section III, Supplementary Regulations, Section 8, Child Care Facilities be amended by replacing subsections 8.1.(a) and 8.1.(b) with the following “a. b.

In an RS1 and RS3 zone, a maximum of 25 children may be cared for at one time; In an A, RS2, RS4 and RD zone, a maximum of 8 children may be cared for at one time;”.

In Section III, Supplementary Regulations, Section 8, Child Care Facilities, by adding a new subsection 8.1.(f) as follows “f.

Child care facilities in the A zone may not occupy more than 100 m2.”.
