This Agreement made this I day of 2005 by and between the VILLAGE OF TIJPPER LAKE hereafter referred to as the "Village" and the TOWN OF TUPPER LAKE (formerly known as the Town of Altamont) hereafter referred to as the "Town", both municipal corporations located in the County ofFranklin, State ofNew York. WITNESSETH WHEREAS, the Village furnishes water and provides sewage collection service through its Municipal Water and Sewer System to customers located in various Water and Sewer Districts outside the Village and within the Town, and WHEREAS, the parties have previously entered into an Agreement dated September 10, 2001 with several Amendments, and the parties wish to consolidate said Agreement and Amendments together with other revisions. NOW THEREFORE, the parties agree as follows:

WATERDISTRICTS
Subject to all regulations imposed by the New York State Department of Health and Department of Environmental Conservation the Village agrees to continue to supply excess municipal water for all legally connected customers in the following Water Districts heretofore established in the Town and outside the Village boundaries: DISTRICT NUMBER
