APPLICABLE DEVELOPMENT CODE REGULATIONS Section 09-050 (B) from the Lehi City Development Code states that in approving a conditional use permit, the Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of the Lehi City General Plan and this Code, and to assure the operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses in the general vicinity. These conditions may include: 1. That the site will be suitable landscaped and maintained and that the design, setbacks, fences, walls, and buffers of all buildings and other structures are adequate to protect property and preserve and/or enhance the appearance and character of the area. 2. That all buildings or other structures are architecturally attractive and add to the quality of the area. 3. Provision of parking facilities, including vehicular ingress and egress and the surfacing of parking areas and driveways to specified standards. 4. Street and highway dedication and improvements, including sidewalks, curbs, and gutters. 5. Water supply and fire protection. 6. The mitigation of nuisance factors such as noise, vibrations, smoke, dust, dirt, odors, gases, noxious matter, heat, glare, electromagnetic disturbances and radiation. 7. The regulation of operating hours for activities affecting normal neighborhood schedules and functions. 8. Regulation of signs. 9. Provisions for a guarantee, bond, or other surety that the proposed conditional use will be maintained and operated in compliance with all approval, conditions, and requirements. Such other conditions determined necessary by the Commission to allow the establishment and operation of the proposed conditional use in an orderly and efficient manner and in compliance with all elements of the General Plan, and the intent and purpose of this Code. HISTORY October 28, 2010 – The Planning Commission approved the Ferrell Family Dental site plan for dental offices at this location with the following motion: Ed James moved to approve Verl Greenhalgh’s request for Site Plan for Ferrell Family Dental, a proposed dental office located at 10 East State Street in an existing Mixed Use zone and as part of the motion to include DRC comments. Second by Carolyn Nelson. Motion carried unanimous. ANALYSIS The applicant is requesting review of a site plan with an existing building and a conditional use for the ATS of Lehi to be located at 10 East State Street within the existing Center Creek Dental building. This will be a dental assisting school to be located in the basement of the existing dental office building on site, and the Development Code classifies a vocational and technical school use as a conditional use within the Mixed Use zone.

The applicant has indicated that the school will run on Saturdays from 8am to 5pm in their first year of operation, and if there is demand for more sessions, they would like to have evening classes as well. All the class hours they are proposing will be during times when Center Creek Dental is not open. As the applicant estimates they will have 8-10 students per session with 2 instructors, there is enough parking on site for this use with the existing 16 parking stalls on site (including 2 ADA stalls). Vocational and technical schools require 1 stall for each employee plus 1 stall per each 3 students at maximum capacity. While the applicant has not indicated maximum capacity, they have more than enough stalls for each student and each instructor based on their plans. The DRC commented that a final fire inspection will be required on the school space in the basement before a business license may be issued. There was an additional comment regarding the building permit on the basement of the building which has since been resolved. RECOMMENDATIONS/POSSIBLE ACTIONS Planning Division staff recommends APPROVAL of the ATS of Lehi site plan and conditional use including the requirement to get a final fire inspection for the basement. This recommendation is based on the following findings: A. The proposed site plan meets the building architectural requirements. B. The proposed site plan is not detrimental to the public health, safety, and welfare of Lehi City. C. The proposed site plan meets the requirements of the Lehi City Development Code.

DRC GENERAL COMMENTS: 1. All signage will require a separate review and approval process 2. The approval of a development shall be effective for a period of two (2) years from the date the development is approved by the Planning Commission or City Council, whichever is applicable. THIS ITEM WILL BE SCHEDULED FOR PLANNING COMMISSION ON OCTOBER 13, 2016.
