APPLICABLE DEVELOPMENT CODE REGULATIONS Section 09-050 (B) from the Lehi City Development Code states that in approving a conditional use permit, the Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of the Lehi City General Plan and this Code, and to assure the operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses in the general vicinity. These conditions may include: 1. That the site will be suitable landscaped and maintained and that the design, setbacks, fences, walls, and buffers of all buildings and other structures are adequate to protect property and preserve and/or enhance the appearance and character of the area. 2. That all buildings or other structures are architecturally attractive and add to the quality of the area. 3. Provision of parking facilities, including vehicular ingress and egress and the surfacing of parking areas and driveways to specified standards. 4. Street and highway dedication and improvements, including sidewalks, curbs, and gutters. 5. Water supply and fire protection. 6. The mitigation of nuisance factors such as noise, vibrations, smoke, dust, dirt, odors, gases, noxious matter, heat, glare, electromagnetic disturbances and radiation. 7. The regulation of operating hours for activities affecting normal neighborhood schedules and functions. 8. Regulation of signs. 9. Provisions for a guarantee, bond, or other surety that the proposed conditional use will be maintained and operated in compliance with all approval, conditions, and requirements. Such other conditions determined necessary by the Commission to allow the establishment and operation of the proposed conditional use in an orderly and efficient manner and in compliance with all elements of the General Plan, and the intent and purpose of this Code. HISTORY January 8, 2015 – The Planning Commission approved the Ascent Academies of Utah site plan and conditional use to have a charter school at this location with the following motion:

Kordel Braley moved to approve Tyler Bodrero’s request for Site Plan and Conditional Use for Ascent Academies of Utah, a charter school to be located at approximately 1993 West 900 North in an existing A-1 zone with several conditions: that a traffic impact study be completed for this site and that it address two issues: that it insure the adequacy of the onsite circulation and that it can handle the planned build out loads based on the documented assumptions of the demographics of the school and that it analyses the surrounding off-site roadway network within reasonable distance of the school and that it be studied to determine what type of off-site mitigation requirements there are and once those are determined then it will be up to City staff to work with the applicant to determine how those off-site improvements will be completed.

Kordel continued his motion stating that based on testimony from the applicant we could expect 20% of the kids to walk to the school and we find that the need for the traffic impact study arises in part for the safety of the school children and the same for the onsite issues as well, and place a condition that with adjacent developed neighbors to the south, the west and north east that an agreeable fencing solution that’s agreeable to both parties be provided for and the based on the finding that there is a potential safety issue with the school and agricultural uses that any property adjacent to the school with agricultural uses that a fencing agreement between them and the school be reached and include any other DRC comments that have not been resolved yet and finding that schools are an incredibly important component of our community and our code allows for them in residential zones and this fronts a master plan collector road and so with all of that he doesn’t find any reason why a school can’t be conditional in this vicinity with the other mitigation measures he discussed, and that this is conditional on the water dedication being met and we grant an exemption to the landscaping based on the fact that it appears to be required to handle the stacking of cars and with the proposed additional phase that they come back in for approval when they decide to do ahead with that. Second by Donna Barnes. Motion carried 6-1 with Paige Albrecht opposed. ANALYSIS The applicant is requesting review of a site plan with an existing building and a conditional use for the IDEA Academy to be located at 1999 West 900 North within the existing Ascent Academy school. The Development Code classifies school uses as a conditional use within all residential zones. The applicant provided a plan which shows IDEA Academy occupying two currently unused classrooms within the building as Ascent Academy is not currently operating at the maximum approved capacity. There will be no improvements or modifications to the site. The applicant has indicated that Ascent Academy is currently operating at 73 percent of their approved capacity. IDEA Academy plans to enroll no more than 35 students and will not have more than 4 teachers, bringing that number up to 76 percent of the original approved capacity for this site. Additionally, the applicant has indicated that classroom hours will be offset from Ascent Academy hours in order to avoid traffic congestion during student pick-up and drop-off times. IDEA Academy will operate between 8:00am and 2:15pm while Ascent Academy operates between 8:30am and 3:30pm. The only DRC comment was that the applicant should consider the option of circulating the pick-up and drop-off traffic around the entire building to allow more stacking and avoid cars parking on 900 North. RECOMMENDATIONS/POSSIBLE ACTIONS Planning Division staff recommends APPROVAL of the IDEA Academy site plan and conditional use. This recommendation is based on the following findings: A. The proposed site plan maintains the use and capacity of the original approved charter school site plan at this site. B. The proposed site plan is not detrimental to the public health, safety, and welfare of Lehi City. C. The proposed site plan meets the requirements of the Lehi City Development Code.
