Payment and Cancellation
All studio hire bookings are subject to the following terms and conditions.
1. The fees payable shall be as listed in the price list that can be found in the booking pack sent with this booking form. All studio bookings must be paid in full within the seven working days before the hire period (internet banking details will be supplied on request). Late payments will be subject to a weekly accumulating 5% penalty fee. In the event of any cancellation, deposits are non-refundable, and cancellations within 24 hours of the hire period will be charged the full studio-booking fee.
Definitions In these terms and conditions the following expressions have the following meanings: • Contract: The studio hire booking form which incorporates these conditions. • Client: The person or company who purchases services from Square Up Media Limited. • Employees/Associates: Individuals present during hire period working with or for the client. • Period: The period of time for hire of the studio premises and related facilities and equipment which has been ordered by the client on the studio hire booking form. • Equipment: All fixtures, lighting, props and other equipment supplied by Square Up Media Limited or by its’ nominated subcontractors. • Premises: The photographic and filming studio and associated rooms available for hire from Square Up Media Limited. Website: tunyardstudios.com • Pencilled: When the client shows interest in booking the studio on a specific date Square Up Media Limited will pencil this in the diary. This will give the client priority over this day but will not be considered booked until the client notifies Tun Yard Studios that they would like to proceed. • Confirmed: When the client and Square Up Media Limited have agreed the terms and conditions and date of the rental an invoice will be sent to the client. By confirming, the client is committing to pay the full amount of the invoice. The client will be liable for charges if this payment is not received by the date provided on the invoice. • Booked: Payment has been received from the client and the studio rental is then confirmed. The client will not be given access to the studio until the payment is complete and this contract is signed. See Booking for more information.
Booking Studio rental is considered booked after receiving the full payment, a refundable 50% deposit payment, an email confirmation and a completed copy of this studio hire booking form (available on the Square Up Media Limited website). The client must include set-up and takedown time within the hours booked or pay applicable over-time charges (for a comprehensive list of charges refer to the booking pack sent with this form).
2. Square Up Media Limited reserves the right to make an additional hourly labour charge to cover any costs incurred by Square Up Media Limited as the result of failure to comply with these terms and conditions. 3. Any additional equipment, services or modifications to the booking will be billed to and paid for by the customer. 4. Any additional charges incurred during the rental period will be taken from the client’s deposit. If the deposit does not cover said additional charges an invoice will be raised and the client shall pay this within 14 days of receiving this. If it is not paid within this time limit it shall be liable to interest at 8% above the Bank of England base rate per day. 5. At the end of the hire period the client may be charged at the discretion of Square Up Media Limited an additional rental where the studio or any equipment is delivered to or returned to Square Up Media Limited or our sub contractors in a bad or damaged condition so as to preclude use or hire of the said studio or equipment.
Use of Studio Space The client shall only use the studio premises for photography or filming and only for the hire period agreed on the booking form. [email protected]. The studio premises and equipment hired by the client are only available for the use of that client and those named on the booking form during the hire period. The client is not permitted to sub-contract, sub-let or otherwise allow any third party to use or occupy the studio or use the equipment or consumables without the prior written permission of Square Up Media Limited. Square Up Media Limited shall insure the studio premises and the equipment against all normal insurable risks but not further or otherwise. The client shall be responsible for insuring their own equipment and personal property and that belonging to their servants and agents whilst it is on the studio premises. During the hire period the client and their employees/ associates shall abide by the following rules: 1. Under no circumstances will Square Up Media Limited entertain any claims arising out of any failure of the client to effect its own insurance. The client must ensure that his own
public liability insurance is operative for all persons in the studio during the hours of use, to cover any accident, injury or death.

Exclusion of Liability
2. Nothing shall be done or permitted on the premises or adjacent to them which may cause nuisance, damage or disturbance to the owners or occupiers of adjacent premises.
iv.) allow or suffer the equipment to be used by any untrained or unauthorised personnel; nor v.) part with possession sell, pledge or encumber or suffer any lien to be created on the equipment.
Square Up Media Limited shall not be liable to the client for any loss, damage, expense, liability or for any consequential loss (including loss of profit) whatsoever or howsoever arising out of or in connection with the following.
3. No smoking is allowed on any part of the studio premises, which includes the use of fire, haze and smoke machines. If smoke alarms are set off a fine of £250 will be imposed.
15. Where at the request of the client, Square Up Media Limited supplies to the client the services of assistants, sub contractors, freelancers or other persons. Such persons shall be deemed the employee/associate of the client and the said services shall be deemed to be rendered by the client and Square Up Media Limited shall not be liable for loss or damage of any kind however caused.
4. Noise shall be kept to a reasonable level and the client and their agents and servants shall respond to any request to reduce the noise level if necessary. 5. The client and their employees/associates shall take all reasonable steps to ensure that the studio premises and equipment are not damaged, removed or altered in any way. 6. The client is responsible for ensuring that the security and fire alarm systems are not tampered with or activated except in instances believed to be a genuine emergency. 7. The client shall abide by all relevant statutory health and safety procedures. 8. Any materials used in connection with sets constructed by the client shall be removed immediately from the studio premises by the end of the hire period.
16. Square Up Media Limited shall not be liable for any loss or damage howsoever arising out of any statement, advice, instruction or any other representation given by an employee/associate of Square Up Media Limited or any other person whose services are supplied to the client. 17. Equipment must be returned promptly at the end of the hire period in good condition. The client shall pay or compensate Square Up Media Limited or its sub contractors for the replacement value of lost or damaged equipment or in respect of any cancellation or variation of any order or failure to return equipment on time.
1. Any damage to or loss of property by the client or employees/associates of the client or any third party. 2. Any breakdown, stoppage or failure of the facilities and equipment provided in the studio or any other equipment or services provided by Square Up Media Limited. 3. Any death or injury occasioned to any client or employee/ associate of any client occasioned by the use of the studio or any equipment unless such death or injury is directly attributable to the negligence of Square Up Media Limited or the employees/ associates or subcontractors of Square Up Media Limited. 4. For any fine and/or legal costs incurred by Square Up Media Limited or the client for any activity connected with the hire of the studio premises, equipment and services. 5. Any failure on the part of Square Up Media Limited to comply with its’ obligations to the client due to any circumstances beyond the control of Square Up Media Limited.
Breakages, Losses and Damages
Termination
1. The client hiring the studio is responsible for all breakages, losses or damages caused to the studio or equipment by him/ her, or any other person, during the use of the studio.
Square Up Media Limited may terminate any hire contract if the client shall be in breach of any of the terms and conditions.
2. All equipment and services are supplied by Square Up Media Limited entirely at the risk of the client. Square Up Media Limited shall not be liable for any loss or damage to materials or props or equipment, including consequential loss and loss of profit however caused, arising out of the use or the inability to use the equipment supplied or agreed to be supplied.
Your Details
11. The client and any of its employees/associates shall not become intoxicated or behave in such a manner which would result in them being unable to safely occupy the studio premises or operate any equipment.
3. No alterations, decorations or additions to the studio are permitted without the written consent of Square Up Media Limited.

12. The client must ensure that all persons under the age of 18 have parents’ or guardian’s permission to be at the studio, for the purposes of the photography or filming, during the period of studio hire.
5. The client must notify Square Up Media Limited at the time of supply if the condition of the equipment or studio space is not acceptable.

13. The client shall ensure that neither they nor their servants / agents shall perform any illegal acts or create anything which is illegal or which infringes any applicable laws or third party rights whilst on the studio premises.
6. Any props or equipment brought to the studio by the client is not the responsibility of Square Up Media Limited. Square Up Media Limited shall not be liable for any loss or damage of any kind to material, props or equipment entrusted to it however caused including consequential loss or loss of profit.

9. The studio premises shall be immediately surrendered to Square Up Media Limited at the end of the hire period in the same condition as they were at the beginning of that period. No alterations, decorations or additions to the studio are permitted without the consent of Square Up Media Limited. The client will pay any costs incurred by Square Up Media Limited arising out of any breach of this condition. 10. The client shall be responsible for removing all rubbish and belongings from the studio premises by the end of the hire period. (Or incur disposal costs as listed in the booking pack provided with this form).
14. The client may not without the written consent of Square Up Media Limited i.) Remove the equipment from the studio premises or ii.) Modify or alter or tamper with the equipment in any way; nor
4. The client shall pay any costs incurred by Square Up Media Limited arising out of any breach of these conditions.
7. In no circumstances shall Square Up Media Limited be liable for any loss or damage, including consequential loss, however caused arising out of the use or the inability to use the equipment supplied or agreed to be supplied.
