CITY COUNCIL MEETING MINUTES June 2, 2014 7:00pm
1) Call to Order Mayor Hunt called the meeting to order at 7:00 p.m.
a) Pledge of Allegiance b) Swearing in of Tyler Abens to City Council Mayor Hunt administered the Oath of Office to incoming City Council member Tyler Abens
c) Introductions In attendance: Mayor Anne Hunt, Council members Mark Vanderlinde, Arlene Donahue, Bob Christians and Tyler Abens; Interim City Administrator Mike Barone, Finance Director Brian Grimm, Community Development Director David Abel, Director of Public Safety Paul Falls, City Clerk Terri Haarstad, City Attorney Ron Batty (Kennedy and Graven) and City Engineer Paul Hornsby (WSB & Associates) Absent: None
d) Approval of Agenda Motion by Vanderlinde second by Donahue to approve the agenda as amended. Remove Items 4a, 4b and 4c to Item 7d. Motion carried 5 – 0.
2) Persons to Be Heard Tracy Anderson (9200 County Road 26) discussed her concerns about recent City Council behavior, conflicts of interest, and possible forced removal from office. Ron Root (3850 Enchanted Lane) discussed his concerns about flooding problems and resulting potholes. He discussed the need for a solution to the inability to use the road safely as a result. Cindy Notch (1250 Morningview Drive) discussed concerns about hazardous infiltration into the aquifer, issues with her well water quality, and urged the Council to do their homework with regard to the water treatment plant, and to be civil. Andrea Fall Moody (1260 Morningview Drive) requested a public meeting be held to discuss all the options for the proposed water treatment plant and cost benefits. She discussed her concerns about the reverse osmosis process. Todd Wilson (130 Manor Circle, Orono) requested a letter from the City to support the rowing club’s need for a permit to use the lake for rowing practice. Carrie Schroyer (Chaska) discussed rowing opportunities in the area for her daughter who looks forward to training in Minnetrista. Jane Norling (5450 Ridgewood Cove) noted Council member Abens participated in the work session discussion prior to being sworn in as an official member. Norling was concerned about the contamination of the main aquifer.

George Gulso (1635 County Road 110 North) discussed history of prior City Council members. He urged the Council to do the best they can do. Rick Wybel (Mayor of St. Bonifacius) thanked the police for their service. He also updated the Council on the Glacier Road barricade. Casey Rasmussen (Orono) discussed the quiet nature of the rowing sport and also requested formal support for their training.
3) Special Presentations a) 2014 Quarterly Financial Update Grimm presented the staff report dated June 2, 2014 Motion by Donahue and second by Christians to accept the 2014 financial report. Motion carried 5 – 0
4) Consent Agenda Motion by Vanderlinde, second by Donahue, to approve the Consent Agenda as amended: Remove Items a), b), and c) to a future meeting. Motion carried 5 – 0. Items so approved included:

5) Public Hearings a) Res. No. ___ Vacating Drainage and Utility Easements at 950 County Road 110N, PID# 12-117-24-22-0027 Abel presented the staff report fund in the City Council packet dated June 2, 2014. Hunt opened the public hearing and hearing nothing, closed the public hearing. Motion by Donahue, second by Abens, to adopt Res. No. ___ Vacating Drainage and Utility Easements at 950 County Road 110N, PID# 12-117-24-22-0027.
6) Business Items a) Orchard Cove Final Plat Abel presented the staff report found in the packet dated June 2, 2014. Discussion included the following: A small title issue will need to be worked out Development agreement is almost complete

b) Res. No. ___ Establishing Policy for Sign Retro reflectivity Assessment and Management Hornby presented the staff report dated June 2, 2014 Motion by Vanderlinde, second by Hunt, to adopt Res. No. ___ Establishing Policy for Sign Retro reflectivity Assessment and Management. Motion carried 5 – 0.
c) Authorize Interim City Administrator to enter into a temporary agreement from June 3, 2014, through June 16, 2014, for building official services. Barone reminded the Council that staff provided information regarding this item during the June 2, 2014 Special Meeting at 5:30pm. Motion by Abens, second by Donahue, to authorize Interim City Administrator to enter into a temporary agreement with MNSpect from June 3, 2014, through June 16, 2014, for building official services. Motion carried 5 – 0.
d) Thrive MSP 2040 Plan Discussion Hunt stated a letter will be mailed following additional input from City Council. There were no comments.
7) Administrative Items a) Res. No. ___ Approving Claims Motion by Donahue, second by Christians, to adopt Res. No. ___ Approving Claims. Motion carried 5 – 0.

Discussion included: Need to get input from residents in the area first; will be scheduled for June 16 meeting Motion by Hunt, second by Vanderlinde, to schedule June 18, from 6:00 p.m. to 8:00 p.m. for the public meeting to discuss water treatment plant options. Motion carried 5 – 0. Hornby updated the Council on the Enchanted Island flooding issue. Signage is needed if this continues to be a recurring issue. Hunt stated she would like a correction made to the minutes to clarify that when the City Council came out of closed session, the City’s HR Attorney, Mick Waldspurger from Rupp, Anderson, Squires, Waldspurger, PA was in attendance via telephone. Vanderlinde expressed concern about accusations made against the City Council. St. Bonifacius Mayor Rick Wybel presented his thoughts regarding issues in St. Bonifacius with drilling through aquifers to get to another and the importance of sharing ideas and information with other city officials.
